Wednesday, November 28, 1973.
A special meeting of the Senate of The University of British Columbia
was held on Wednesday, November 28, 1973 at 8.00 p.m. in the Board and
Senate Room, Administration Building, to discuss the report of the Senate
Ad Hoc Committee on the Universities Act.

Dean McClean presented the report of the committee, the basic
recommendations of which were: -
Recommendation  1
The committee recommends that there should be established a provincial
universities' commission.
Recommendation 2
Given that two or more commissions will be established, we recommend that
each commission should elect six of its members plus its chairman to serve
on a joint committee to consider coordination of programs and other topics
of mutual interest.
Recommendation 3
a) That the provincial universities' commission should consist of ten to
fifteen members.
b) That all the members of the commission should be appointed by the
Lieutenant-Governor-in-Council, but that at least one-third of the
members of the commission should be individuals who, at the date
of their appointment to the commission, are members of faculty at
a university in British Columbia and who have had at least five years
experience as a member of faculty at universities in the province.
(For the sake of clarity it should be understood that the reference to
faculty members in this recommendation should be read as including
the Presidents and Deans, although in recommendation 3(d) we
recommend that Presidents should be expressly excluded from
membership of the commission.)
c) Before any appointment is made to the commission the Lieutenant-
Governor-in-Council should:
(1) give public notice that an appointment is to be made;
(2) ask in the public notice for suggestions as to who might be
appointed; and
(3) allow at least six weeks to elapse between the date of the
publication of the notice and the last date for the receipt
of nominations for appointment. 5982.

d)        That the following persons are not eligible to be members of the
commission:
members of parliament; members of the executive council;
members of the legislative assembly; chairmen of the Boards
of Governors of the universities; Presidents of universities;
and employees in the service of the Department of Education.
Recommendation 4
We recommend that the commission should have the power of advising the
government on all matters pertaining to university education in the province,
and, without restricting its general powers, should have the following
particular powers:
a) to require the universities to prepare and forward to it both
short and long range plans for the academic development of the
universities, the plans to have been approved by the Senate and
by the Board of Governors of the university before being forwarded
to the commission;
b) to advise the government on the establishment of new universities;
c) to advise the government on the establishment of new faculties and
new degree programs, but not to require universities to establish
any new faculty or any particular degree program;
d) to receive from the universities budget requests for both operating
and capital funds, to appraise these requests, to transmit its own
recommendations concerning them and the original requests to the
Minister of Education, and to divide among the universities the sums
allocated for the university purposes by the Minister of Education,
each university to receive one lump sum for operating budget and
one lump sum for capital budget, and no part of either sum to be
expressly ties to any particular aspect of the universities operations;
e) to require the universities to consult with each other on actions which
might be taken to minimize unnecessary duplication of facilities and
programs of study and to report to the commission from time to time
on what action has been taken;
f) in consultation with the universities to establish appropriate standards
of space for various categories of space in university buildings so as
to provide a basis on which the commission may assess university
requests for total capital expenditures, and, in consultation with the
universities, to review these standards from time to time; 5983.

Recommendation 4   (continued)
g)        to publish an annual report which should at least include the
following:
1) the budget requests submitted to it by the universities;
2) recommendations made by the commission during the course
of the year to the government;
3) the government action on those recommendations, including
in particular the government allocation of funds for the
universities; and
4) the division by the commission of funds allocated by the
government among the various universities;
h) to require the universities to provide it with information which the
the commission may require in the carrying out of its powers under
the Act.
Recommendation  5
That The University of British Columbia should take immediate steps to
attempt to establish in conjunction with the other universities of the
province some form of co-operative machinery.
Recommendation 6
The committee recommends the continuance of a bicameral system of internal
government.
Recommendation 7
That the Board of Governors be made up as follows:
1) six members appointed by the Lieutenant-Governor-in-Council
2) the Chancellor
3) the President
4) three members of the faculty who are members of Senate, elected by
members of faculty who are members of Senate.    (For this purpose
faculty should be read as including the President, the Deans, the
Director of the Centre for Continuing Education, Librarian, members
of faculty elected to Senate from each individual faculty, members of
faculty elected to Senate at large and any other university officers
approved as members of Senate by a vote of the Senate.) 5984.

5) three members of the student body who are members of Senate,
elected by students who are members of Senate
6) three members elected from Senate who are neither members of
faculty or the student body, elected by members of Senate who
are neither students or faculty.
Recommendation  8
That the following people be ineligible for membership on the Board:
1) members of the parliament of Canada
2) members of the executive council
3) members of the legislative assembly
4) members of the Board of Governors of another university
5) Deans of faculties of the university
6) any employee in the service of the Department of Education
7) any person who resides outside the Province
8) any person who has not yet attained the age of majority
Recommendation 9
That a member of the Board having any personal interest, either direct or
indirect, in any contracts or other arrangement proposed to be entered into
or entered into by the university shall absent himself from that portion of
any meeting of the Board or any committee of the Board where that contract
or arrangement is being discussed, and shall not vote at a meeting of the
Board or of any committee of the Board on any matter respecting the contract
or arrangement.
Recommendation  10
That Senate should have the following membership:
a)        the Chancellor, the President, the Deans, the Director of the Centre
for Continuing Education and the Librarian (hereinafter referred to
as the ex-officio members) 5985.

b) community representatives not greater in number than the number of
ex-officio members
c) students in a number equal to the number of ex-officio members
d) members of faculty in a number equal to three times the number of
the ex-officio numbers
e) such other senior officers of the university as may from time to time
be determined by Senate
f) one member to be elected by the governing body of each affiliated
college.
Recommendation 11
That the ex-officio members of Senate be as follows:
1) the Chancellor
2) the President
3) the Deans
4) the Director of the Centre for Continuing Education
5) the Librarian
Recommendation  12
That there be on Senate a number of community representatives not greater
in number than the total number ex-officio members, and that the categories
of community membership be determined as follows:
1) four members appointed by the Lieutenant-Governor-in-Council, only
one of whom shall be an official of the Department of Education
2) three members appointed by the Board of Management of the Alumni
Association of the university
3) not less than six, not more than the number which would make the
total number of community representatives equal to the number of
ex-officio members, the number beyond six to be determined from
time to time by Senate, nominated by members of convocation and
elected by convocation, who shall not be members of the faculty at
the university. 5986.

Recommendation  13
That there should be on Senate one student from each of the faculties, plus
such other number of students as will ensure that the total number of student
members is equal to the number of ex-officio members of Senate.
Recommendation  14
That there shall be on Senate a number of elected members of faculty three
times the number of the ex-officio members, each faculty to elect from its
members one of these members, and the remainder to be elected by the
faculties either in joint meeting or in such manner as the faculties in
joint meeting may by regulation determine.
Recommendation  15
That Senate may add to its membership such senior university officers as
Senate may determine from time to time.

That there shall be included in the membership of Senate one member elected
by the governing body of each affiliated college of the university.
Recommendation  17
That section 23 (i) be deleted from the Act.   Section 23 reads as follows:
One or more members, as determined by the Senate, to be elected
by any society or group or organization in the province which in
the opinion of the Senate contributes in a significant way to the
economic or cultural welfare of the province.
Recommendation  18
That, after consultation with a committee designated by Senate, the President
nominate, for the approval of Senate, a member of Senate to act as Chairman
of Senate for a period of one year.
Recommendation  19
That Senate be empowered to delegate to a committee or committees established
by it, and subject to its review, such of its powers and duties as it may determine
by resolution receiving a majority of two-thirds of those members present at a
meeting. 5987.

Recommendation 20
That the university's power of expropriation under section 36 of the
Act be amended so that it be exercisable only with the consent of the
Lieutenant-Governor-in-Council.
Dean McClean explained that the report dealt with the relationship
between the government and the universities and the relationship among the
universities themsevles.   Minority statements concerning Recommendations 2
and 5 were appended to the report.

British Columbia.

equal representation on this Council.
(2) The Co-ordinating Council shall
include:

(b) at least one member of the Board
of Governors of each university
selected from the Board of that
university
(c) at least two members of Senate
of each university elected from
the Senate of each university. 5992.

(3) The Commission proposed in this
Report should consult the
Co-ordinating Council as well as
individual universities regarding:
(a) all proposals for new faculties,
schools, departments, institutes
and graduate programs;
(b) all proposals for long range
planning of university education;
(c) all proposals to eliminate or reduce
duplication of programs; and
(d) adoption and modification of
standards for various categories
of space in the construction of
university buildings.
(4) The Co-ordinating Council would have
no right of veto over any university
proposals, but would make
recommendations to individual
universities and to the Commission.
(5) The Co-ordinating Council should
have the authority to inquire into
any matter that in its opinion would
be assisted by co-operative decisions
or actions by two or more universities
in this Province.
Dr. Clark commented on the proposed amendment but discussion was
deferred since it had been agreed that the meeting would adjourn at 10.30 p.m.
It was agreed that if possible continuation of the discussion of the
report would take place at the December 12, 1973 meeting. 5993.
