He Tells Counsel How He Looks Upon the Contract Question at Conclusion of Evidence In the Supreme Court yesterday the taking of evidence in the case of Watson vs. City of Prince Rupert was completed. The address of counsel remains for today. Before adjournment, Mr. Justice Clement intimated for the benefit of counsel the lines along which he felt Inclined to give his decision so that counsel might direct attention to these ■ points if they wished. His Lordship said he felt that the $750 deduction made byt the city should not be allowed, not as to measurement, but on the legal aspect of it. Ou the subject of liquidated damage, he was Inclined against the city as to the strike period, and, in fact, as to any liquidated damages. On the retaining wall point, he felt that the contractor gained by reason of the wall being built, rather than suffered damage. The city was not liable for any damages during the strike, he felt. As to the disposal of waste, he felt inclined to allow 25 cents a cubic yard for that deposited beyond Beach Place, or 2,500 yards. A number of lesser amounts he did not feel like referring to. On the opening of court in the morning Colonel Davis again took the stand for cross-examination. Witness said he ept account of all the lumber taken away because he would want to know how much to return to the contractors. He did not know that the contractors were notified when planking was talcen away. Witness gave specific Instructions for the removal of the materia] from time to time. With respect to the settling of the fill, witness said that Watson explained that the material on the lots was due to the fill -yreailug out. Witness had examined it from time to time and he was convinced there was no spreading out. He had given this opinion based on expert knowledge and on what he actually saw on the ground which bore this out. In estimating the amount of filling on the lots, his assistants, he understood, had not used instruments. It was a rough estimate of 2,200 yards. A deduction of 7,500 yards was later made to allow a liberal allowance. Questioned as to the angle of the slope, witness said he had seen figures taken that morning by Mr. Oakley and an assistant. It showed that the slope was about 1% to 1. With a 40-foot ase there was a vertical height of 29 feet. At least three owners of lots had spoken to him about the dumping on these low lots. The complaints of these owners would not be the sole reason for his interfering with Watson in tbe matter. The city would be liable If the material was left on the lots. Colonel Davis said that his attention, he felt sure, was called ,} to the dumping on the lots by his construction engineer. The specifications being produced, the witness was asked what was the object of the disposition clause. His Lordship wanted to know aboift the proposed dumping on the low lots. Witness said that he had expected that there would be no difficulty about getting leave to dump waste on their lots. His Lordship said he could not see, for the life of him, why these owners sheuld not allow their lots to be filled. Witness called attention to the fact that it was specified that the material should life dumped in such of the places as were designated. His Lordship agreed with this, saying no doubt the city effectively saved itself by this clause. Later, witness said that when he found that these lot owners had a belief that the Q. T. P, would give them sidings, he did not attempt to get permission to dump on them. In reply to His Lordship, witness said that the dumping elsewhere than on low-lying lots close to the cut would extend the time for the completion of the contract. He could not say just how long. On the point that the city engineer not giving the contractors access to the final estimates before It was sub mitted to the council, His Lordship said that while this was the practice he did not think it was a proper course. He did not reflect at all upon the engineer, but he thought it was not a good practice. Mr. Peters asked leave to deal with this aspect before His Lordship disposed of it. The court said he did not regard it as material. Colonel Davis asked leave to explain. He said that the practice followed here was the usual one in municipal works. If access were given to the figures there was liable to be charges of collusion and of graft. His Lordship hardly thought this should follow. Mr. Peters pointed out that nowhere was the practice used of submitting the figures to the contractors before the council reiceved it. Witness saidd Watson knew the final estimate was being prepared, and should have put in any claims he had. Colonel Davis said that all damage done the contractor by reason of the construction of retaining walls should be allowed. 5 While any extra expense, like removing and returning rails, might be allowed in a case like that of the removal of extra muskeg, yet the actual removal of muskeg and filling-in would come under the general terms of the contract. Witness said he always felt that if reasonable dispatch was shown by the contractors the liquidated damages should not be collected. He had not allowed in the estimate for working on Sunday. He had held the opinion at that time that the contractors should not work on Sundays. He personally had no objection to contractors subletting provided reliable sub-contractors were employed. About March 27 the Streets Committee ordered that no subletting should be allowed. In reply to the court, witness said that Watson had, in his opinion, used due diligence in completing the work. Upon resuming in the afternoon the first witness was Mayor Manson. He said that at the time he left ihe city to attend the legislature there was no strike. The force was then under Chief McCarvill and was sufficient for the needs. When witness returned, on March 15, his first, idea was to bring the two sides together, the contractors and the men. There is Every Indication That Next Summer Much of the Line Will He Completed Vancouver, Dec. 12.—There will be an era of unprecedented activity in railway construction circles next year, as the management of the Grand Trunk Pacific Railway has intimated to Messrs. Foley, Welch & Stewart its desire that the uncompleted 415-mile gap between Tete Jaune Cache, fifty miles west of Yellowhead Pass, and Aldermere In the Bulkley Valley, be completed without any delay. Owing to the departure for Paris of J. W. Stewart, the managing director, Pat Welch, a partner in the firm, has gone to Edmonton and Winnipeg on business in connection with the award of subcontracts for the eastern half of the work. It is understood that the subcontracts for the western portion of the gap will be awarded to various subcontractors who are now engaged on the line east of Hazelton. Messrs. Foley, Welch & Stewart last fall were given the contract for the entire unfinished gap. They have gangs in the field clearing the right-of-way from both ends. The firm is also building the sternwheel steamboats at Tete Jaune Cache for tne purpose of distributing material and supplies along the route between that point and Fort George. The south fork of the Fraser b)as been demonstrated to be navigable from the end of April until October. The two boats will be launched next spring. CAPITAL OF INDIA WILL BE DELHI Reception Given King George and Queen Nary is Such that the Removal of the Seat of Government will be made to the old Head of Sovereignty in the Indian Empire Delhi, Dec. 12.—The King and Queen were proclaimed today Emperor and Empress of India. The culminating act in the British monarch's accession took place amid a scene for which richness of color and magnificence of decorations have never been surpassed in modern times. The announcement was made through the Viceroy that the King personally had given large sums of money for popular education. It was also added that further handsome figts would also be made. So pleased was, His Majesty with the reception given at Delhi that the capital of the Indian Empire will be removed from Calcutta to Delhi, it was announced on behalf of His Majesty. The loss is estimated at over $150,000. o WIRELESS HOUSE Dominion Government Will Build Additional Accommodation for the Staff The Dominion government is to provide additional accommodation for the staff at the wireless station on Digby Island. This is in common with a similar move at Point Grey and also at Cape Lazo. An all night service being now maintained at this point, it has been decided to provide a home for the second and third operators as well as those in charge. It Is Complained That Passports Are Not Recognized by the European Country Washington, Dec. 12.—The House committee on foreign affairs agreed today on the Sulzer resolution directing the immediate abrogation of the treaty of 1832 between the United States and Russia. The complaint is because of discrimination by the latter country against American Jewish citizens in the non-recognition of passports. OffhN SOI Nil KIBE Ontario Port on Georgian Bay Suffers Severely—Over a Million Dollar Loss Owen Sound, Dec. 12.—This city was visited by the worst fire In Its histy last night, when the entire elevator plant, including two elevators and a million bushels of grain belonging to the C. P. R., were destroyed, nothing being saved. The steamers Athabasca and Keewatin were damaged also, as were a number of buildings in the vicinity. The loss exceeds a million dollars. Accidental Death A verdict in the case of Muslke Ragkovlch who was shot by the discharge of his own rifle while out hunting, was reached hy the coroner's jury last night. Advertising Rates Upi n Application. Wednesday, December 13, 1911. ANOTHER COUNCIL There seems to be a great deal of uncertainty as to candidates for the council next year. It is drawing near to the time when a new body must be selected to take the place of the one now serving and yet but few names are mentioned as likely to be in tbe field. The persistent attacks, made without foundation in most of cases, upon men who serve the public at the council board is apparently having a deterring effect upon good men entering the field. We have long pointed out that the course pursued in criticising without foundation and in too many instances without definite information would have this result. It would drive men who ought to go into nubile life as far as the municipality is concerned out of it. In their place would arise those who were but poorly qualified for the positions. This, we believe, applies to the treatment of this year's council as well as to that of last year. (December 13, 1893) Thomas W. S. POTATOES British Columbia Championship Baked Potatoes Arc Served at Railway's Dining Tables Travellers on the transcontinental trains of the Canadian Pacific Railway are now being served in the dining cars of the company with "British Columbia Championship Baked Potatoes." As an aftermath to the recent big land show at New York, where the Province of British Columbia won first prize in the competition for the best potatoes grown in America, the Canadian Pacific sent agents to the districts where tlie prize potatoes were grown and bought up all the championship variety of "murphys" that they could secure. The C. P. R. now intends to make a specialty of this potato on its dining cars. Other railways are able to serve big potatoes, but they cannot secure British Columbia potatoes, as the C. P. R. has a monoply in the line. Already inserts for the regular i.ienu cards have been printed, in which the championship baked potatoes occupy the place of honor on the "ready-to-serve" list. PRINCE RUPERT JOURNAL DEAD BODY FOUND Remains of Settler Near Masset Have Been Located on the Trail on Way to Pre-emption. Deceased Was Peculiar Man Who Had Served With Colors ' In India (Special Correspondence) Masset, Dec. 9.—The remains of a recent settler on Graham Island were found, a few days ago, on a trail leading from Masset Inlet to a rpe-emption on the Nadu .River. Near the body was a quantity of household effects which the deceased had been attempting to pack to his lately taken up pre-emption, about two miles inland. The discoverer of the body notified the authorities; but it was not considered necessary to hold a post-mortem examination or an inquest. The deceased was known as Ernest Burke, and arrived at Masset about a year ago. He was about fifty years of age and was a pensioner of the British army, having served in India, where. It Is believed he was connected with the Essex Regiment. He was a very eccentric man and suffered from the effects of a sunstroke. On the arrival of the deceased in Masset he made several attempts to reach the spot on which he located, building a raft and afterwards a sled, on which he attempted to move his effects from the townsite to a hollow log, in which he first made his home, on the Woden River. During the summer he took up a pre-emption a few miles farther up Masset Inlet, on the Nadu River, and was moving to his new horn when death overtook him. He placed the property owned by him, consisting of several trunks and other personal goods, in a boat and rowed to the outlet of a trail, on November 9, In a snowstorm. Leaving the trunks on the beach, he endeavored to carry a pack to his building; but he sank down from exhaustion and died. The remains were found by a settler who became alarmed at his absence and who was walking to the clearing. It was apparent that the man had been dead for some weeks. An examination of the body, made by Dr. A. Ross Fraser, showed no signs of foul -play and the authorities removed the remains to Masset, where they were interred on the 3rd Inst. The deceased was, apparently, a man who belonged to a good family in England. He was well educated and kept a well stocked library. Little is known of his relatives or former friends, he being alone in the country and very reticent regarding his former life. On nis trunks were painted the words: "Private Burke, Essex Regiment." With his many pecularitles, the deceased conducted himself in a very gentlemanly manner and the few friends he made were very much grieved at his untimely end. ■ o Lots of people who marry for money are investing in gold bricks. Nothing was accomplished, neither side being willing to yield. He had meetings with the contractors and the men separately in an endeavor to get them together. The city was very quiet at the time. About that time a change in the chief was brought about, Mr. Vickers taking charge. About March 24 some trouble occurred. Some of the contractors started work and trouble started. Mr. Vickers was given full charge, with instructions to maintain the peace. Cross-examined by Mr. Williams, witness said that he was not aware that the contractors were driven off work except on March 24, when God- sen was arrested. All references to him as to protection were referred to the chief or acting chief. In reply to questions he said that he received, while in Victoria, word from the acting mayor, Alderman Smith, as to the situation, and suggesting that the Rainbow might be kept nearby. "You communicated with Ottawa In the matter?" asked Mr. Williams. Mayor i.ianson said he did not. He referred the matter to the provincial authorities. They communicated through the proper channels here and as far as he knew nothing was done. Witness had on some occasions seen the strikers go down to meet Incoming steamers with banners. There was no outbreak whatever except on the occasion referred to. He was asked if he had not promised Mr. Kelly that if he would settle the strike by raising the men's wages that the question of liquidated damages would be forgiven. The mayor said he had never made any threats or held out any promise of the kind to Mr. Kelly. He had advised Mr. Kelly to settle up and to get with the men. He had never made any threat in the matter He had not given Mr. Ke'ly to understand that if he settled the matter that the city would deal leniently with the contractors in the matter of the liquidated damages. Alderman J. A. Kirkpatrie*k, one of the police commissioners, was called, but his evidence took only a few minutes, being corroborative in large part of the mayor's as to the situation. M. M. Stephens, the next witness, was a police commissioner during the year. There was little troub'e during the strike. He could not recall anything that could have been done before Mayor Manson came back that was not done. The chief of police had instructions to place as many men on duty as the situation required. He was not limited. Witness said that Sergeant Phillipson was never ordered to court trouble, but he was instructed to maintain law and order. Sergeant Phillipson, during the time of the strike gave the commission to understand that there was no danger that he could not cope with. Frank Kelly was called In rebuttal by the plaintiffs. He testified as to meeting Mayor Manson and said that the mayor gave him to understand that If he could settle with the men for 40 cents the question of liquidated damages would be regarded In a lenient way. Mr. Morgan wns called for a similar purpose but gave little evidence. J. H. Plllsbury was also called to put In an estimate of the amount of material to be removed from the lots. Ho said there were 318.4 yards on the ground. To remove the amount, together with what would slide down, assuming that the angle of rest was 1 to 1, a total of 471 yards would have to be removed.
