C, that he has been successful in the appeals to the Full Court of the Giant debenture holders against the orders of Mr. Justice Martin. The first order refused the ap plication of the debenture holders to compel registration of the de bentures as a oharge on the "Giant" mineral olaim, the Registrar having refused registration on the ground that the property sought to be charged was not specifically deaoribed. The second order denied the application of the same parties for leave to proceed with their foreclosure aotion cothwithstanding the Winding Up order, Mr. Justioe Martin considering that the relief sought in the action oould be obtained in the Winding Up. The effeot of theBe decisions is to make the debentures a first mortgage on the real estate instead of a merely floating oharge, and to give the holders thereof the right to proceed to enforce their security. Previously the Bank of Montreal, as the holders of the first recorded judgement, were the first encumbrancers, and as such had a preferred claim for their coats and the duot of any sale proceedings under the Judgments Aot. Although the debentures have now been held to be registrable, the other creditors may, if they desire, contest the foreclosure action, they being parties to it. . The most -interesting question involved is the right of an English oompany to oharge their property and the secured creditors to aome in ahead of looal creditors who have been in ignorance of what has taken plaoe. The Bank of Montreal, having advanced a large sum of money apparently without knowledge of the debentures, will probably consider any money expended in determining this questions well spent, aa they will then know their position when dealing with foreign companies in the future. As many of the mining oompaniea operating in British Columbia are English corporations, the merchants and miners doing business with them are also largely interested. It is true that the miners have a right to a first lien, land the merchants have a lien second only to the wage earners for such supplies as to go into and from part of the mine, but the latter form only a small portion of the large purchases made by mining oompaniea. Viotoria, AP«* 26—Three million yen in gold from Japan had been stored here sinoe last Tuesday by the Wells, Fargo & Co., and was shipped to New York laBt night to be expended for supplies for the Japanese army, ammunition and magazine rifles being most in demand. Great secrecy has been maintained sinoe the shipment was made as to its oharaoter, purpose, destination and consignee. Employes of the Express company say it is for a confidential agent in New York but deolihe to divulge the name or addreas. To divert attention the gold, packed in little wooden boxes, was, when unloaded here, stored ae common freight in the wharf warehouse for a day without the polioe or military guard. Two or three Japanese hovered in the vicinity constantly but ostensibly without any oonneotion with the business. The previous Empress also bought a million and a half dollars Japanese gold. EXPROPRIATING LANDS Railways Quarrel Over Kernel of Boundary's Nut Vancouver, April 25—The question of what permission is necessary to be obtained by one railway oompany to build branoh lines was briefly discussed this morning in Supreme Court Chambers before Mr. Justice Duff. Incidentally the case had some remhrkable feat* uers. Mr. C. B. Macneill on behalf of the Columbia & Western Railway, whioh is one of the interior connections of tbe C. P. II,, applied for the appointment of an arbitrator to act in proceedings to expropriate certain land of the Vanoouver, Viotoria & Eastern Railway, whioh ie the Great Northern extension in the Boundary distriot. He suggested Mr. Leamy as arbitrator, but Mr. A. H. MaoNeill of Rossland, solioitor for the V. V. & E. objected to the whole proceeding. Mr. C. B. Maonaill said that the Columbia & Western had built the branch lines indicated near Greenwood, in 1899, having made an rarangement for the necessary property with Mr. Robert Wood. A sale was talked of and tbe consideration was to be $600. Last year the rival line oame along and Mr same property to that oompay. The V. V. & E. was therefore the reoorded owner of property whioh the C. & W. took possession of four years ago. Mr. A. H. MaoNeill disputed the authority of the C. & W. to build this line. He denied that the authorization of the Minister of Railways, whioh O.B. MaoNeill pro duced, was sufficient. It could not be built exoept by order ot the Railway Committee. The judge dismissed the application without prejudice to any subsequent application whioh may be made on behalf of the C. & W., after the assistance of the Railway Department is called in to settle the matter.
