It is of course to be understood that the Commission are absolutely unanimous in the following and recommend their adoption without any avoidable delay, nevertheless the Commission will at a future date submit for the approval of Par- liament a comprehensive report of their finding, together with the reasons therefor. 1, Gas Boats in District Mo. 2. - Your Commission have fully considered this matter, and recoreeend for adoption that on the opening of the fishing season of lp/P in District He, 27-the use of motor boats be permitted. 2, Japanese Licenses, - The Commission find that the • number of arhite men and Indians holding licenses is not in any way commensurate with the number of Orientals, and as a consequence the Commission recommends that there be a reduction on all licenses issued to fishermen other than white fishermen ' and Indians of ^0 per cent in 1923, this to include all methods of fishing, and that licenses issued in District No. 2 to others than whites and Indians be attached to the canrers pro rata. Local residents and returned sold7.ers to be given preference in all districts. 3, License fees, - The Commission are strongly of the opinion that the present system of exacting license fees is of such a character as to eliminate progressive citizens from engaging in the industry and also bec.rs heavily upon an industry which is already taxed to the limit. Drag and Purse Seines. - Your Committee submit and recommend for your approval that drag and purse-seines should not be permitted to be operated save where demonstrated to be the only practical .effective and reasonably economic method of catching fish, and in cases where purse-seines and drag- seines are permitted, the boundary to be moved out to not less than f mile from the mouth of the creek or stream, or further if in the discretion of the Chief Inspector it is deemed advisable'. The Commission most strenuously urges and recommends that in cases where drag-seines or purse- seines are permitted, none other than white British subjects and Indians (natives) be employed. This recommendation to be most imperatively enforced, S Cowichan District,- Inside of a line drawn in Cowichan Bay, from Separation point to Cherry creek, that no fishing be allowed by net,, except as provided for Indians, Neither in ail waters south ox Toe aine drawn from Graves point to Erskine point, and to a point drawn from Separation point to Musgrave point, including the writers of Sansan narrows and Bourgone and Maple Bay, shall ar-.y fishing be allowed in these waters by net or live bait * 6, Licenses for cod fishing for commercial purposes to be issued without fee* 7. Close Season for Salmon. - That all the words in clause S, on page 10',' of the Regulations as found in the last five lines, of said paragraph, commencing at the word "provided" in the said fifteenth line, be struck out. 0, .Weekly Close Time. - The Commission recommends that the close season for salmon fishing be in all parts of British Columbia from 6 a.mn* Saturday to 6 p.m. on the following Monday of each week, provided, however, that this shall not apply to salmon trolling as provided in subsection D of section 27 of the Regulations. 9* Fines for Illegal Fishing. - In this connection the Commission feels thai penalties as provided for in the laws at present extant are unduly oppressive and harsh in many instances, and they therefore r ecommerid that the law be amended so as to make confiscation or forfeiture for a violation of the laws a permissive rather th.an an imperative act, The Commission have found thovt there is a great deal of fishing done during the close season and in closed areas and also the use 01 mare apparatus then that permitted by law, and \\70 recoomenl that drastic action be taken to prevent such abuses of ahe law. 10. Herring■ - Your Commission are strongly of the opinion and recommend that no purse-or drag-seine be permitted to be operated for the catching of herring in Na.naimo harbour and Departure Bay, Your Commission after investigation realize the possibilities for the development of the jr.ild cured herring industry, and a'ould strongly recommend that the Government encour.age said industry by making experiments with steamers equipped as drifters, and make any other experiments which may be necessary. • . * A-r-'y, '-"^y - 5 - I1* Halibut> - WG strongly recommend that a close season on halibut be enforced dating from about the 15th of November to the 15th of February in each yOar, and that experiments, be made to ascertain the movements of said fish, the banks where said fish are to be found and as to the advisability of cAosing certain banks for certain periods. 12. Embargo. - Your committee recommends be taken on the proposed embargo. that no action 7 13. Life-Saving Patrol. - We recommend that in order to help fishermen in distress, that one or more boats be placed in readiness on the coast so that they may proceed to the assistance of fishermen in distress. Sox 15, Vancouver, [Extract from The Canada Gazette of August 5, DEPARTMENT OF MARINE AND FISHERIES REGULATIONS GOVERNING THE INSPECTION OF CANNED FISH AND SHELLFISH AND THE OPERATIONS OF CANNERIES. (Adopted by Order in Council of July 24, 1922, P.O. 1545). In these Regulations unless the context otherwise requires:— " Minister " means the Minister of Marine and Definitions. Fisheries. " Sardine" means any small clupeoid fish. ''Processing" means cooking and sterilizing the contents of the cans after they are filled and closed. " Swells" means cans, the tops and bottoms of which bulge outwards some time after being •_ processed as a result of fermentation. " Dead-heads" means cans with such large leaks in them that they do not swell after processing. " Fat Cans " means cans of sardines that are overfilled and close so quickly that the surplus contents cannot escape. " Do-overs" means cans that are processed a second time. 1. Canning operations shall be conducted in a Where building or a separate portion of a building canning maintained exclusively for canning purposes or inducted, for manufacturing cans; but during the time that canning is not being carried on the building may be used for storage or other purposes not injurious to its use as a cannery, subject to the approval of an inspecting officer. 2. No license shall be issued for the canning Canning of fish or shellfish until the building in which t'*^e operations are to be conducted has been cleared only after and cleaned and the walls and ceiling thoroughly inspection, whitewashed and the inspecting officer has visited the building and satisfied himself as to its fitness for such operations. 3. Canneries and the wharves, stages and Ca"neries houaes used in connection therewith, shall at all surroundings times be kept in a clean sanitary condition, and to be kept clean. canneries shall have effective ventilation. The ground and the beach under and within twenty- five yards on either side of a salmon cannery shall be kept free from all offal or other objectionable matter. Water closets to be provided. 4. There shall be provided at every cannery separate water closets for male and female employees. Each closet shall be over the water, below low water mark or shall be provided with sufficient water flush and be connected with the water below low water mark by sewage or other suitable pipe. There shall be no cross timbers or piles under closets built over the water. Provided that in connection with lobster canneries or canneries where the water front is used for retaining live shellfish, separate dry closets for male and female employees may be built back from the wharf and buildings. Floors and drainage. 5. The floors of all shellfish canneries, if not cement, shall be made watertight. They shall be given sufficient slope to a drain in the centre to which shall be connected an outside drain to carry the drainage to a point foelow high' water mark. No floor or part of a floor shall be of earth in any cannery. Lcxbsters to be kept free from bilge water in boats. 6. The inside bottom of lobster fishing boats and carrying smacks bringing lobsters to a cannery for canning purposes shall be either lined or fitted with a grating in such a manner as to keep the lobsters free from bilge or other offensive water. Washing of floors, tables and utensils. 1. All canneries shall have an abundant supply of clean water, and packing tables and all utensils used in connection with the operation of fish or shellfish canning shall be thoroughly washed with boiling water immediately after each days' operations and the floor shall be thoroughly washed with hot water or steam at least once each day the cannery is in operation. Separate space for packing. 8. The entire space for packing or filling cans either mechanically or by hand shall be divided off by suitable space, from that reserved for cleaning the fish7 "Red feed" 9. Sardines containing what is commonly in sardines, known as "red feed1" shall be regarded as unfit for human food. Washing of fish or shellfish. 10. The washing of fish or shellfish meat for canning purposes shall fee done in clean water, preferably running water. 11. (a) Can fillers or packers shall thoroughly wash' their hands with soap and warm water before beginning to fill or pack. This shall be done also on each occasion following a stoppage of filling or packing for any reason, and all operators shall wear an overall apron or coat and a suitable cap to cover the hair, all of which shall be thoroughly washed before each day's use. (b) When gloves are used in filling and packing they shall be thoroughly washed before use each day. Operators to keep their hands and clothing clean. 12'. Wash-basins or washboxes supplied with Wash-foasins, hot and cold water and soap together with clean soap and towels daily shall be provided at convenient be supp_°e(j places in all canneries for the use of the employees. 13. Where fish or shellfish meat is packed by hand it shall be conveyed to the fillers or packers in individual trays and each tray shall be emptied before another is used. These trays shall be washed at least twice each day that packing operations are carried on, and after each washing they shall be scalded out with steam or hot water. ' kisuteh) either as "Coho" or "Silver Salmon." In addition thereto the name "Medium Red" or "Red" may be used. (d) Humpback Salmon (O. gorbuscha) as "Pink." (e) Dog salmon (0. Keta) as "Chum" or "Qualla." (/) Provided that the name "Blueback" may be used to designate the fish locally known as such, and whose flesh is not quite so red as that of sockeyes, but redder than that of pinks. Kinds of utensils for holding shellfish meat. 16. All washing boxes, basins and vessels for holding shellfish meat in course of packing shall be of agateware, porcelain, zinc, tin-plate or galvanized iron, or shall be lined with such, and all packing tables shall be covered with plate glass, marble, agateware, porcelain, zinc or galvanized iron. Provided that tin-plate utensils shall be renewed annually. Coolers. 17. Coolers in shellfish canneries shall be cov ered with galvanized iron, zinc, or wire allowing of thorough cleansing and sterilization and shall have sufficient slope for drainage. Limit of time for shellfish on coolers and for meat remaining unprocessed 18. In localities where it is impracticable to keep lobsters alive in the water adjacent to the cannery, lobsters may be allowed to remain on the coolers until noon of the day after they have been boiled. Shellfish meat that has been removed from the shell shall be immediately packed and processed. No such meat shall be allowed to remain in an unpacked or unprocessed condition overnight. Disposal of offal. 19. Offal from canneries in British' Columbia, including waste, entrails, parts, scales, etc., shall be carried away from the cleaning tables or cleaning machinery in watertight receptacles. . It shall be either deposited below low water mark or removed in scows or retained in boxes or chutes for removal in scows. If retained in boxes or chutes such boxes or chutes shall be high enough to enable scows to be placed under them at any stage of the tide. Canneries on the Atlantic coast shall have suitable receptacles, satisfactory to the inspecting officer for offal and all such receptacles shall be regularly emptied and thoroughly cleansed and limed during March and April and daily during the balance of the season. Disposal 20. Fish or shellfish found, during the process of unsound 0f canning to be unsound or unfit for human shellfish food, and canned fish or shellfish found to be unsound or unfit for human food shall, subject to appeal for re-inspection, be seized by an inspecting officer and destroyed. If a proportion of cans in any one case of canned fish or shellfish is found after a sufficient test, to be unsound or unfit for human food the whole ones may be seized and destroyed. 21. Cans of fish or shellfish other than lobster, which, after processing, contain less than the weight shown on the labels1, and cans of lobster which, after processing, contain less dry meat than that prescribed by the Meat and Canned Foods Act, for each size of can and which have been seized and held may, subject to appeal for re-inspection, be disposed of by the packer or owner, only after the underweight cans have been plainly and indelibly stamped on the top with the word "Underweight," and the packer of the light weight cans shall be liable to a fine of five dollars per case of such cans. If a proportion of cans in any one case of fish or shellfish is found after an adequate test to have underweight contents the whole of the cans in the case may be treated as underweight. Disposal of cans of fish or shellfish underweight. 22. If a dispute should arise between an inspecting officer and the packer or owner of fish or shellfish either before or after, canning as to the condition and quality of the fish or shellfish before canning or as to the condition, quality and weight of the contents of the cans after canning, such packer or owner may appeal to ihe Minister who may order a re-inspection aaid such re-inspection shall be final. Provided, however, that there shall be no appeal unless the Minister is satisfied that the identity of the goods under appeal has been carefully preserved. Provided further that if deemed necessary, for the preservation of identity the goods under appeal may be removed by an inspecting officer to a place of safekeeping. Appeal for re- inspection. 23. (a) No children under eight years of age. Children nor any dogs shall be allowed inside a cannery. c]?gs a9 " ., diseased (6) No person shall be employed in a cannery debarred who has any infectious or contagious clw .ise from canneries. 24. Cans of fish or shellfish that are to be exported for sale in markets outside of Canada are hereby exempted, from the labelling provisions of 12A of the Meat and Canned Foods Act, i nd may be exported without labels or with such labels as the buyer in the country of destination may supply. Provided that on all unlabeiled cans of fish or shellfish whether for export or not a sticker be placed showing the name of the packer and his license numbei. Collectors of Customs shall not clear any importation of fish or shellfish preserved for food in cans, or such like hermetically sealed containers, unless such shipment is accompanied by an affidavit, taken before a Justice of the Peace or other person duly authorized, in the country of origin, to attest such declarations, in the following form— Place Date I, (or we) hereby declare that the shipment described herein was manufactured from sound raw materials, and that its manufacture was carried on under proper sanitary conditions, and under proper supervision that the products are, at the time of shipment, sound, wholesome and fit for human food; that the containers show thereon the name and address of the packers, or of the importer, the place of origin, a true description of the contents and the weight as required by section 12H of the Meat and Canned Foods Act, of the Dominion of Canada. We are advised by the Freight Clerk on the Steamer who measured the boxes, that the measurement was as follows:- 1'3" X 2'1» x 3'7" or 9'4" each. The writer has personally measured a number of shipments and has found that the measurement v.ill always run over the measurement as given by the packers, who usualy give us the dimentions of the shocks, as ordered from the mills, but tlae measurements do not conform to the specification. The Commisswn further recommends that an international arrangement be made towards the secuJtwa' of the said close season in extra territorial waters, and we have the assurance of the Washington Fisheries Board that they will render aid towards assistingV'the said arrangement being arrived at on the part of the United States Federal authorities. Organization.—In all parts of Britph Columbia there is a demand as is felt obtains in all places in Canada where jlie fishing industry is of paramount importance that ever since Confederation, thl fishing industry has not received the consideration its importance so adequately '^deserves. Witness after witness prominent in the fishing industry, both from the strpidpoint of merchant and fisherman, strongly accentuated the fact that there should be a Minister of Fisheries, with an organization under him thoroughly qualified andtso organized as to give the fishing industry the consideration which it properly dei'^rves. The Commission will subsequently submit a full and comprehensive report hut suffice it to say for the purpose of this memorandum that all persons intimately connected and associated with the fishing industry demand that the matter of al minister with practical knowledge of the fisheries, and a thoroughly competent stiff be no longer temporized with or unduly delayed. A new Department of Fisheries, separate and apart from the Department of Marine and Fisheries, should be established without delay, and thorough reorganization of the fisheries both in Ottaw'i and British Columbia should in the public interest be undertaken instanter. Re Orders in Council.-—It is felt by the Commission that having regard to the exigencies of the service that no Order in Council should be promulgated without due notice of its effect upon the fishing industry and those engaged in it first having been given as far as reasonably possible. Naturalization Papers.—Whilst realizing that the matter of the method of granting naturalization papers is beyond the scope of this Commission, yet your Commission have found that there has been a flagrant abuse of the same in so far as Orientals are concerned. The Cc.mmission therefore recommends that all naturalization papers in the province of British Columbia in so far as they affect Orientals, be called in and revised, and that in future whilst it is piot desirable to naturalize Orientals, yet if this is done-the papers be not granted to them without a photograph first being attached as well as finger prints, in accordance with the usual conditions approved by law. ISO Oriental should receive a return of his naturalization papens unless he complies with the provisions that should be made by the department to protect wholesale fraud. NEILL. 7 S- - p ,,v The Honourable Ernest Lapointe, K.C., M.P., Minister of Marine and Fisheries in and for the Dominion of Canada, Ottawa, Canada. p Sir,—The Committee appointed pursuant to the provisions of the Public Enquiries Act on recommendation of the House of Commons realizing that the matter of the British Columbia fisheries, which was submitted to them for investigation, is of great importance, and having in mind the fact that all interested in the industry are entitled to the earliest possible notice of impending changes affecting the industry, beg to submit, pending the final submission of a full report, the following recommendations in which they have unanimously concurred, except as hereinafter mentioned. It is of course to be understood that the Commission are absolutely unanimous in the following and recommend their adoption without any avoidable delay, nevertheless the Commission will at a future date submit for the approval of Parliament a comprehensive report of their finding, together with the reasons therefor. - 1. Gas Boats in District No. 2.—Your Commission have fully considered this matter, and recommend for adoption that on the opening of the fishing season of 1924 in District No. 2 the use of motor boats be permitted. 2. Japanese Licenses.—The Commission find that the number of white men and Indians holding licenses is not in any way commensurate with the number of Orientals, and as a consequence the Commission recommends that there be a reduction on all licenses issued to fishermen other than white fishermen and Indians of 40 per cent in 1923, this to include all methods of fishing, and that licenses issued in District No. 2 to others than whites and Indians be attached to the oanners pro rata. Local residents and returned soldiers to be given preference in all districts. 3. License Fees.—The Commission are strongly of the opinion that the present system of exacting license fees is of such a character as to eliminate progressive citizens from engaging in the industry and also bears heavily upon an industry which is already taxed to the limit.' The Commission feels that a person should not be called upon to pay extravagant license fees without being assured of an adequate return, and to that end it unanimously and energetically recommends the following:— The fee for an abalone license shall be $ 1 00 For crab license shall be '. 1 00 Herring or pilchard drag-seine license 5 00 Herring or pilchard purse-seine license .. ...... 5 00 Salmon drift or gill-net license 1 00 Salmon drag-seine license 20 00 Salmon purse-seine license 20 00 Salmon trap-net license 50- 00^ Sturgeon gill-net or drift-net license "... 1 00 Annual fee for salmon cannery license, we recommend it shall be $20 for said license and in addition 10 cents for each case of 48 1-pound cans, or the equivalent thereto, of sockeye salmon, and 5 cents for each case of any other species of salmon. 4. Drag and Purse Seines.—Your Committee submit and recommend for your approval that drag and purse-seines should not be permitted to be operated save 3, 1 I where demonstrated to be the only pra^e pi-effective and reasonably economic method of catching fish, and in cases where puV'se-seines and drag-seines are permitted,, the boundary to be moved out to not less than _ mile from the' mouth of the creek or stream, or further if in the discretion o£ the Chief Inspector it is deemed advisable. The Commission most strenuously urges and recommends that in cases where drag or purse seines are permitted, none other than white British subjects and Indians (natives) be employed. This recommendation to be most imperatively enforced. 5. Cowichan District.—Inside of a line drawn in Cowichan bay, from Separation point to Cherry creek, that no fishing be allowed by net, except as provided for Indians. Neither in all waters south of the line drawn from Graves point to Erskine point, and to a point drawn from Separation point to Musgrave point, including the waters of Sansan narrows and Bourgone and Maple bay, shall any fishing be allowed in these waters by net or live bait. 6. Licenses for cod fishing for commercial purposes to be issued without fee. 7. Close Season for Salmon.—That all the words in clause 8, on page 10, of the Eegulations as found in the last five lines of said paragraph, commencing at the word " provided " in the said fifteenth line, be struck out. 8. WeeMy Close Time.—The Commission recommends that the close season for salmon fishing be in all parts of British Columbia from 6 a.m. Saturday to 6 p.rm on the following Monday of each week, provided, however, that this shall not apply to salmon trolling as provided in subsection D of section 27 of the Eegulations. 9. Fines for Illegal Fishing.—In this connection the Commission feels that penalties as provided for in the laws at present extant are unduly oppressive and harsh in many instances, and they therefore recommend that the law be amended so as to make confiscation or forfeiture for a violation of the laws a permissive rather than an imperative act. The Commission have found that there is a great deal of fishing done during the close season and in closed areas, and also the use of more apparatus than that permitted by law, and we recommend that drastic action be taken to prevent such abuses of the law. 10. Herring.—Your Commission are strongly of • the opinion and recommend that no purse or drag seine be permitted to be operated for the catching of herring in Nanaimo harbour and Departure bay. Your Commission after investigation realize the possibilities for the development of the mild-cured herring industry, and would strongly recommend that the Government encourage said industry by making experiments with steamers equipped as drifters, and make any other experiments which may be necessary. 11. Halibut.—We strongly recommend that a close season on halibut be enforced dating from about the 15th of November to the 15th of February in each year, and that experiments be made to ascertain the movements of said fish, the banks where said fish are to be found and as to the advisability of closing certain banks for certain periods. 12. Embargo.—Your committee recommends that no action be taken on the proposed embargo. - 13. Life-Saving Patrol.—We recommend that in order to. help fishermen in distress, that one or more boats be placed in readiness on the coast so that they may proceed to the assistance of fishermen iai distress. The said boat or boats can also be used in studying the habits of all classes of fish and prospecting with regard to habits of said fish. - r ' S3 /p % 14. Practical Scientific 'Investigation/ •_£& strongly recommend that such a Board be established and which shall eon. ,t of practical scientists, who shall be '""located one on the Pacific and one on the/ Oantic coast. 15. Hatcheries.—Your commission has ;one into this matter very thoroughly and heard a great deal of evidence both frt^n employees of the said hatcheries and men engaged in the fishing industry, both 3 fishermen and purchasers of fish, and we are of the opinion that most of the hater/Try operations could be suspended except that two hatcheries be kept in operation teft experiment with the new proposed system and that a certain amount of the moneys now spent in hatchery operations be used for the clearing of streams, obstructions in rivers and improving the spawning grounds for natural propagation. We also.Recommend that the bottom of the river near Hellsgate Canyon be cleared of obstructions as the evidence goes to show that that work was not properly completed. J 16. Dog Fish.—Your Commission strongly recommends that every available means be used for the extermination of this pest, and with that end in view it submits that dog fish should be permitted to he taken with all sorts of contrivances without any restriction of any sort whatsoever. Further, the Commission recom- , mends that a bounty should be placed upon the catching of these dog fish and encouragement should be offered by way of financial or other assistance to those engaging in the extermination of this pest and the utilization if at all possible of the same. 17. Clams.—Your Commission recommends that there be a close season 'on clams either for canning, the selling fresh or any other purpose, the said close season to be fixed.as to the time deemed best for the protection of said fisheries. 18. General Observations.—Your Commission have had the privilege of a conference with the Fishery Board of the State of Washington and have discussed with said board matters generally advantageous to our joint fisheries. The Fraser river matter was thoroughly discussed in an extensive manner and in a spirit of International comity and good-will. The majority of your commissioners were able to arrive at a tacit understanding with these commissioners, subject to the approval of the proper authorities, and we have authorized the Chairman of the Commission to set before the proper authorities the results of our deliberation, owing to the fact that this is a short memorandum of our 'conclusions. However, to speak tersely and comprehensively, the majority of your commissioners, consisting of Mr. Chairman Duff, M.P., Mr. H. C. Dickie, M.P., Mr. Alfred Stork, M.P., and Mr. A. W. Neill, M.P., have agreed to recommend to the proper authorities that a close season of five years for Sockeye salmon fishing on the Eraser river and its tributaries and all coast waters leading up to the same be instituted for a term of five years, provided Americans do the same on Puget Sound, and that an International Commission be appointed consisting of representatives of the state of Washington and of the Dominion of Canada to govern the matter of regulations during the said period and during the term thereafter, this to embrace the right to deal with all kindred subjects. Commissioner W. G. McQuarrie and Commissioner L. H. Mar- tell. M.P., dissented from the foregoing and reserved the right to submit alternative proposals. _ .. Your Commission also had the benefit of a conference with Mr. C. E.
