Hanson, Attorney-General, Victoria, B.C. Sir,—The Twelfth Annual Report of the Department, covering the year ended December 31st, 1922, is hereby submitted in accordance with the " British Columbia Fire Insurance Act" and " Insurance Act." I. "BRITISH COLUMBIA FIRE INSURANCE ACT." The year 1922 closed with a further increase in the number of companies licensed under this Act for fire insurance. The total was 143, of which only one holds a Dominion licence. There were nine new companies licensed, as follows:— British.—The British Oak Insurance Company, Limited; The Cornhill Insurance Company, Limited; United British Insurance Company, Limited. Canadian.—Ensign Insurance Company; Dominion Gresham Guarantee & Casualty Company (already licensed under the "Insurance Act"). United States.—The American Insurance Company; The Franklin Fire Insurance Company of Philadelphia; Security Insurance Company of New Haven, Connecticut. Switzerland.—The Baloise Fire Insurance Company. Five companies withdrew during the year, namely:— British.—National Benefit Assurance Company, Limited; The Traders & General Insurance Association, Limited. Canadian.—Pacific Marine Insurance Company; Union Fire & Casualty Company. United States.—Vulcan Fire Insurance Company of Oakland, California. II. "INSURANCE ACT." At the end of 1922 there were 148 companies licensed under this Act. Nine new companies obtained licences, as follows:— British.—Atlas Assurance Company, Limited; The Cornhill Insurance Company, Limited; Sun Insurance Office. Canadian.—Casualty Company of Canada; Fidelity Insurance Company of Canada; Imperial Underwriters Corporation of Canada; Mount Royal Assurance Company; Policy Holders Mutual Life Insurance Company. United States.—Insurance Company of the State of Pennsylvania. Five of these companies were already licensed under the " British Columbia Fire Insurance Act." Y 6 British Columbia. 1923 In addition to these new licences, ten supplementary licences were issued to companies already licensed under the Act. Three companies withdrew from the Province, namely:— British.—National Benefit Assurance Company, Limited. Canadian.—Pacific Marine Insurance Company; Union Fire & Casualty Company. The General Accident Fire & Life Assurance Corporation, Limited, which was authorized to write automobile insurance (in addition to fire insurance), ceased to write this class of business in the Province. Also embodied is a report of the Fire Marshal, covering the year 1922, pursuant to the " Fire Marshal Act," passed at the second session of the Legislature in 1921. In August of last year the Superintendents of Insurance for the Provinces of Canada held a conference in Vancouver, Ontario, Manitoba, Saskatchewan, and Alberta, in addition to our own Province, being represented. At that conference the Superintendents adopted the uniform " Automobile Insurance Policy Act," and the uniform " Accident and Sickness Insurance Policy Act," and at the session of our Legislature in 1922 the " Automobile Insurance Policy Act" was passed and brought into force by Proclamation on July 1st, 1923. The " Accident and Sickness Insurance Policy Act" was also passed, but has not yet been brought into force owing to our awaiting the other Provinces to have similar Acts passed, which no doubt will be done at the approaching sessions of their respective Legislatures, and it is hoped that the Acts will automatically come into force in January, 1924. Another matter dealt with at the conference was the uniform fire-insurance policy conditions and the uniform life-insurance policy conditions, but while some progress was made, these matters were laid over and will be fully discussed at the next conference to be held in Winnipeg in October of this year. At the last session of our Legislature, as you are aware, the " Insurance Agents' Licensing Act" was enacted, and up to the present time it is working very well, and it is hoped that as time goes on this legislation will prove its value to the agents themselves and the public at large. An amendment to the " British Columbia Fire Insurance Act" now makes it compulsory for all underwriters' agencies to obtain a licence and furnish this Department with separate annual reports of their transactions in the Province. Office of Fire Marshal, Vancouver, B.C., June 1st, 1923. J. P. Dougherty, Esq., Superintendent of Insurance, Parliament Buildings, Victoria, B.C. Sir,—I have the honour to submit my first annual report as Fire Marshal for the year ended December 31st, 1922. Organization. • The staff consists of the Fire Marshal, Deputy Fire Marshal, Chief Clerk, and Stenographer in the head office. In addition, there are ninety-seven Local Assistant Fire Marshals located in the cities, municipalities, towns, and Are districts throughout the Province. Fire Districts and Provincial Police Districts. Twelve towns and villages in the unorganized districts of the Province have been gazetted as fire districts under section S of the Act. In a number of these the Provincial Constables located in the districts have, with the consent of the Superintendent of Police, been appointed Assistant Fire Marshals. The excellent work done by these men cannot be too highly commended. In other unorganized districts the assistance of the Deputy Inspectors, Chief Constables, and Constables in investigating and holding inquiries into suspicious fires has been of great value. With the present staff it would be simply impossible to do this work without their assistance. Policy. In carrying out the provisions of the Act it has not been our policy to have orders issued from this office. In every case the responsibility for enforcing fire-prevention laws and providing for a regular system of inspection has been put squarely up to the Councils and Assistant Fire Marshals. Advice and assistance has been given when requested. No attempt has been made to override any local by-laws, and only in eases where there 's no local by-law to cover the situation have regulations been made by the Fire Marshal, and then only after consultation with members of the Council or local officials. After an experience of twelve months we feel that the Act is working successfully and that we are receiving the support and co-operation of the best citizens of the Province. Education. The work of educating the public as to the danger from fire has been carried on during the year. Addresses have been made before public service clubs, public meetings, and schools. A projection-machine has been purchased and has been of great value in showing fire hazards and the best means of preventing fire. In addition to this, advice and assistance in making inspections has been given to the Assistant Fire Marshals in the rural municipalities and smaller towns of the Province. Assistance in ihe work of organizing and equipping fire departments has been given in a number of cases when requested. Fire Investigations. One thousand six hundred and eighty-nine fires occurred during the year, every one of which was investigated and report filed in this office. Eighteen inquiries were held by the Fire Marshal, and while but few cases of arson were discovered, yet the moral effect and the experience gained has been of great value in preventing similar fires in other places. One result of these inquiries was to remove suspicion from and prevent the arrest of innocent parties who had been the victims'of circumstances over which they had no control. Fire Losses. The fire-loss tables which are part of this report show a loss for the year of $3,252,308, as against $2,342,968 for the year of 1921, giving an increase of $909,400. This increase of fire losses for the year was common to the United States and Canada and has been ascribed to Y 30 British Columbia. 1923 the unusual dry season. A glance at our table of causes shows that sparks were responsible for 434 fires, causing a loss of $033,757. Of these sixty-eight were due to bush fires, with a loss of $205,310. The fires from preventable causes still loom large. On the other hand, we had 159 fires, with a loss of $524,035, from exposure, a cause over which the sufferer had no control. Industrial Plants. The loss on industrial plants for the year amounted to $1,250,673. These figures do not take into consideration the enormous economic loss in wages to the working-men, loss of profits to the owner before the plants could be rebuilt, and general business depression in the immediate locality of the plant. It is obvious that, in a Province with a population of less than COO.OOO which is trying to develop its Industries, this is a serious matter and should receive very careful consideration on the part of the Government. On the line of fire-prevention in these plants surveys have been made during the year with the view of installing automatic sprinkler systems. Estimates of cost have been made and submitted in several cases, but the question of finance has always interfered. Many serious fires have been caused by sparks from sawmill burners. The question of a proper burner for consuming refuse and preventing sparks from "spreading over the adjoining property is receiving our serious consideration. Incendiary Fires. Of the number of fires for the year, only ten, or 0.59 per cent., have been ascribed to arson. Several arrests were made, but in no case were we able to convince the jury that the man was guilty. We believe, however, that the small number of fires ascribed to this source is very creditable to the morals of the people of British Columbia. Loss op Life. Ten lives were lost through fire during the year, eight adults and two children. Seven of these fires occurred in dwellings and the causes assigned show clearly the need of warning parents and children against carelessness. Conflagration Hazard. These hazards, in the shape of old and dilapidated buildings, are still with us. On another page is shown a number of pictures taken by the Deputy Fire Marshal during his inspections. A glance at these will show clearly the danger of these old deserted buildings in a number of our cities and towns. While an attempt has been made with some measure of success to do away with some of the worst of these, there has been considerable feeling against the enforcement of orders in this regard. Only a conflagration will awaken the civic officials to the dangerous menace of these disreputable old shacks. Fire-prevention Work. During the year 41,000 inspections have been made. In all cases recommendations and suggestions have been made on the line of fire-prevention. A number of serious hazards were discovered and 6,000 orders were issued under section 17 of the Act. Out of this number, 125 persons failed to carry out the orders and were convicted and fined. That this work has brought results is shown in the report of the Fire Department of the City of Vancouver, an extract from which is attached:— " We have also the Provincial ' Fire Marshal Act,' which has been in operation since the beginning of 1922, and under the provisions of which a great amount of our work is done. It is a very good Act. Wide in its scope, and so far has not appeared to have a technical loophole. I would consider myself remiss if I did not say a word of praise regarding the support we have received from the Provincial Fire Marshal and his staff in the enforcement of orders issued under the Act. We find that they have backed us to the limit and enabled us to carry on the good work. " As to the benefit of inspection-work carried out and enforced, I can do no better than take the City of Vancouver as an example, for it is here that prevention-work has shown by facts and figures that prevention pays. " From the date of organization, August 9th, 1920, to the end of the year 1922, this Department made 44,546 inspections and served 9,706 notices: 381 summonses were issued, of which 13 Geo. 5 Report of Fire Marshal. Y 31 only nine were dismissed in the Courts, while fines totalling $3,870.50 were paid into the city treasury through the Courts; 237 fire-escapes were ordered erected; 164 buildings were equipped with fire-exit lights and 391 buildings equipped with fire-gong systems; 180 basements and furnace-rooms were protected and made fire-resisting. " For the three years previous to organization the fire loss for the City of Vancouver was $2,925,559, while for the latter three years it was $1,074,933, a direct saving of $1,850,626. We find also that the fire loss was never so low in this city since the year 1911. Surely these figures prove the benefit of inspection. Then let us take the loss of life. For the years 1918, 1919, 1920, the loss of life from fire reached the total of fifteen. For the years 1921, 1922, and the present year to date, we find it reduced to two, one being the death of a young lad, caused by the explosion of a gasolene-torch, and the other the death by suffocation of a man smoking in bed. Can more be said in favour of inspections? " Another result is shown in the following extract from a letter by the Secretary of the Underwriters to the Fire Marshal:— " In connection with the request you made to us some few weeks ago for information in* regard to the amount of rerating-work done in this Province, I have pleasure in advising you that reinspections have been made and new rate-books issued in nineteen cities and villages. Generally speaking, a substantial reduction in fire-insurance rates has resulted therefrom." Appeals. Fifty-seven appeals from the orders of the Assistant Fire Marshals were made and disposed of by the Fire Marshal. There has been no appeal from the Fire Marshal's ruling to the County Court during the year. Cost of Fire-protection. In addition to our fire losses, our records show that the people of British Columbia paid during the year 1922 for salaries for fire departments, $635,861; for new equipment, $42,415; for improvements to :water systems, largely for fire-protection, $231,790; a total of $910,066.
