FARRIS, Attorney-General. Victoria, B.C., June 30th, 1921. REPORT OF THE SUPERINTENDENT OF INSURANCE. Department of Insurance, Victoria, B.C., June 30th, 1921. The Honourable J. W. de B. Farris, Attorney-General, Victoria, B.C. Sib,—The Tenth Annual Report of the Department, covering the year ended December 31st, 1920, is herewith submitted in accordance with the " British Columbia Fire Insurance Act" and the " Insurance Act." I. " BRITISH COLUMBIA FIRE INSURANCE ACT." (1.) FIRE INSURANCE COMPANIES. The year 1920 closed with a further increase in the number of companies licensed under this Act for fire insurance. The total was 132, of which all except two also hold Dominion licences. The new British companies were: British Crown Assurance Corporation, Limited (a reorganization of a company of a similar name previously licensed under the Act) ; The British General Insurance Company, Limited; Essex & Suffolk Equitable Insurance Society, Limited; Motor Union Insurance Company, Limited; Railway Passengers Assurance Company; Royal Scottish Insurance Company, Limited; and The Traders & General Insurance Association, Limited. The Canadian companies were: Canada Security Assurance Company, Canadian Indemnity Company, and Pacific Marine Insurance Company, holding Dominion charters, and the Union Fire and Casualty Company and the Wawanesa Mutual Insurance Company, being Provincial incorporations. The Canada Security Assurance Company was a reorganization of an Alberta company of the same name. The two Provincial companies are not licensed by the Dominion. Three new companies came from the United States, namely: Caledonian American Insurance Company, Columbia Insurance Company, and The Sterling Fire Insurance Company of Indiana, U.S.A. Eight of the companies licensed under this Act in 1920 were already licensed under the " Insurance Act." The only companies which during 1920 ceased to carry on business in the Province were the reorganizations I have mentioned. A complete list of the companies licensed as at December 31st, 1920, is printed on page 25, and the origin of the various companies is as follows:— Dominion of Canada 28 Provinces of Canada 7 Great Britain 39 Australia 1 Hong Kong 4 United States 49 France 4 Total 132 There is again a large increase in net premiums for fire insurance, and, although the losses paid are also higher, it is obvious that the business of 1920 was very lucrative. The figures stated in Tables I. and II. indicate that the time is ripe for some reduction of rates in this Province, as the average amount paid for losses during the past five years is only 30 per cent, of the net premiums received. The statistics will be found on pages 29 and 30. V 6 Report op the Superintendent op Insurance, 1921 (2.) FIRES. The salient feature of the fire loss for 1920 is again the high proportion of fires involving a loss of $30,000 or over. The percentage for 1919 on the same basis was something over 25. Unfortunately, in more than half the cases the cause of the fire was unknown, but hot bearings and sparks were, as in 1919, responsible for part of the loss. Mill and mine property, too, appears regularly in the list of larger fires, while the latter part of the year, particularly the month of September, seems to be the more fatal. It is impossible to deduce any broad generalization, but it becomes more apparent each year that the efforts to lessen the fire waste should be concentrated primarily on the industrial hazard. By teaching fire-prevention in the factory more good will be done, in my opinion, than by a hundred " clean-up " campaigns at random. The number of fires reported for the year shows a little decrease, and it is hoped that this tendency will continue, now that the public is beginning to be familiar with the fire menace and its consequences. Although the figures of loss are larger, too much stress should not be laid on this aspect. The per capita loss works out at $4.80 for the Province, but, as already pointed out, the main responsibility falls on the industrial hazard. If the nineteen large fires referred to are deducted, the per capita loss for 1920 is smaller than that for 1919. The loss of life was larger than for several years, and five lives were destroyed by the fire which occurred in the Balmoral Apartments at Vancouver in June of last year. That fire taught a terrible lesson and stirred the people of this Province to a profound realization of the danger of fire and how easily it can be avoided by care and an observance of the existing laws. The public was alarmed when the inquiry into the fire exposed conditions which daily involved serious risk to life, and yet were due in no small degree to a failure to comply with enactments designed to prevent such conditions. The fire-prevention officer of the Department, Mr. J. A. Thomas, has had an extremely busy year, and his services have been more and more in request and, I cau safely add, appreciated by all sections of the community. The value of the work he has done needs no argument to prove it, and the only question to be considered is how far it should be extended. 11 Geo. 5 British Columbia. V 7 I append extracts from Mr. Thomas's report:— Fire-prevention.—In the work of fire-prevention there has been a very considerable advance over last year. This is particularly true in some of the larger cities where the fire-prevention work has been thoroughly reorganized and systematic inspection by the officials of the Fire Department is being carried out. Fires.—In regard to the fire at the Balmoral Apartments mentioned above he says: " The result of this fire and the investigation held before His Honour Mr. Justice Morrison, of the Supreme Court, was that the fire-prevention work of the City of Vancouver was thoroughly reorganized. A large number of fire wardens were appointed and are doing very efficient work throughout the city." Unorganized Districts.—Considerable work has been done in the unorganized districts this year, notably in the town of Princeton. The great need in these districts is some method whereby money can be raised for fire-prevention purposes. Fire-escape Act.—The work of assisting the different Fire Chiefs throughout the Province in carrying out the provisions of the Provincial " Fire-escape Act" has been carried on by this Department under your instruction. I find that there is a great need for expert advice in this regard. The local Fire Chiefs and others whose duty it is to enforce the provisions of this Act have not the technical knowledge required. Excessive Insurance.—During my investigation of fires I have found a number of cases where property was insured far beyond its sound value. It is obvious that this is placing a premium on arson. Fire Marshal Act.—The necessity for a Fire Marshal Act that will give the Provincial officers authority to enforce reasonable recommendations for fire-prevention throughout the Province, particularly in the unorganized districts where we have no Fire Chief or other official who is qualified to act, is becoming more apparent every year. This is particularly true where there are industrial plants located in the rural municipalities. II. " INSURANCE ACT." The number of companies licensed under this Act for insurance business other than fire reached 141 at the end of 1920, as compared with 130 for 1919. The particulars are set forth on page 27. Eleven of the new companies already held licences under the " British Columbia Fire Insurance Act" and two were reorganizations of licensed companies—namely, the British Crown Assurance Corporation, Limited, and the Canada Security Assurance Company, referred to above. There were two new British Companies, three Canadian and one Manitoba Company, and seven from the United States. The Equitable Life Assurance Society of the United States and the Maryland Assurance Company withdrew during the period under review. In addition to the new licences, fourteen supplementary licences were issued to companies already licensed under the Act for automobile, accident, burglary, forgery, hail, inland marine, inland transportation, marine, robbery, and sickness insurance. The statistics for life insurance (pages 40 and 41) set up new records, and the net amount in force in the Province increased to $171,000,000. But while the amount for premiums received took another big stride upwards, the figures for claims made on policies remained practically stationary. The war period and the influenza epidemic have run their course, and the amounts paid out will drop to their former ratio. It would appear that the present year will not approach last year for volume of new business written, and the companies will do well if they can prevent any large percentage of lapses, which unfortunately follow in the-train of hard times. Allusion was made last year to " group " life insurance. Two companies have written a few policies of this kind, covering employees in the Province. Turning to the miscellaneous forms of insurance (see Table XIII., page 41), the companies did not have a good year like the fire insurance companies. While the amount of business done increased, the losses were, with one or two exceptions, heavier. In the case of automobile insurance the premiums were much larger, but the claims paid amounted to nearly 50 per cent. This class included all kinds of damage done to or by motors, and the losses are not perhaps surprising when one regards the number of street accidents alone. In 1920 there were 4,044 accidents reported to the police in Vancouver and 17 persons killed, and in Victoria 63 accidents where persons were injured, involving 2 deaths. III. GENERAL. An important conference of the Superintendents of Insurance for various Provinces was held at Winnipeg in October last. Ontario, Manitoba, Saskatchewan, and Alberta were represented, but the official for Quebec was prevented by illness from attending, and I was on my way hack from England. The conference was also favoured by some members of the Provincial Commissioners on Uniformity of Law and numerous representatives of insurance interests. It was agreed by all parties that the conference proved a very valuable meeting. The chief subjects on which papers were read and which were discussed were these:—• (1.) Regulation of insurance agents, brokers, and adjusters. (2.) Fraternal societies. (3.) Hail insurance. (4.) Uniform statutory conditions for accident and sickness insurance. (5.) Model Fire Policy Act. (6.) Reciprocal insurance. (.7.) Uniform statutory conditions for automobile insurance. (8.) Uniform law relating to beneficiaries under life-insurance policies. (9.) Unlicensed insurance. It is proposed to hold another conference at Quebec in October next, when the Superintendents expect to arrive at definite decisions on some of these matters, so that they can make recommendations to their respective Governments. It is interesting to note that, in regard to subjects 5 and 8, the Commissioners on Uniformity of Law are also at work, and these subjects are in this way tackled from the legal as well as the insurance standpoint. In accordance with your instructions, legislation relating to the licensing of agents is in course of preparation and will be welcomed by the insurance fraternity; likewise legislation permitting the extension of the fire prevention and inquiry work of this Department will be submitted to you in time for the November session of the Legislature. It will'not, however, be possible by that date to revise the Insurance Acts, and indeed it would be better to await the holding of the conference in October, so that this Province can act with the others. The recent decision of the Privy Council in the cases of Great West Saddlery Co. v the King, etc. (a consolidated appeal), confirms the jurisdiction claimed by the Provinces over outside companies, and the principle is applicable to insurance legislation. On the eve of a change in the head of this Department, I may be permitted to express the hope that during my tenure of office as Superintendent I have given satisfactory service to yourself and the public.
