J. P. Myers Gray, city solicitor, was present on behalf of the the city of Greenwood while J. P. McLeod was retained to look after the interests of the Anaconda people who oppose the scheme, The water rights, of the creek were first staked by J. W. Lind as far back as 1896, claiming three . hundred inches of water for domestic and agricultural purposes. The city solicitor's contention is that the record obtained by Lind is void, as the requirements of the act relating to water rights have not been observed. On these grounds the water rights were again staked by the city of Greenwood on March 8th, 1904, in order to secure a larger and better water supply, the amount asked for being fifty inches. J. P. McLeod, on behalf of Anaconda, produced- witnesses to prove that this meant, out side of the freshets in spring time, practically all the water that was iu the creek, and that if Greenwood succeeded in its endeavors to secure Lind creek it was cutting Anaconda entirely out of its water supply. During the hearing it was learned from the evidence of the Mayor and city engineer, that the cost of bringing Liud creek into use in Greenwood would amount to about twelve thousand dollars, while the cost of obtaining the proposed supply from Boundary or Eholt creeks would be iu the neighborhood of $50,000. The commissioner instructed counsels to submit written arguments on the matter to him at Vernon, which will be forwarded to the office of the chief commissioner of Victoria, along with any recommendation which he might make. It is expected that the water question as far as Lind creek is concerned will be permanently settled one way or the other inside-of three weeks, as the decision of the chief commissioner will likely be considered final. R. C. Campbell Johnston, the -well known mining engineer and metallurgist, with Mrs1. Johnston are staying at the Imperial. This is not Mr. Johnston's first visit to the Boundary as he was here some years ago at various times as consulting engineer for companies purchasing big copper properties iu the Boundary. In this capacity he inspected the properties in Phoenix now comprising the Dominion Copper Company's group, for Messrs. McKenzie and Mann, and it is generally supposed he is here in their interest at present in-connection with the transfer of -their' property to the big new company, the Montreal and Bos ton Consolidated. During the few days he has been in town he has taken the opportunity to familiarize himself with the high grade properties of Greenwood and to use his own expression they turned out to be "eye openers" to him. Times in the Boundary have been somewhat quiet since the shut down of the Boundary Falls smelter and some of the mines whose products were treated there. This however does not disturb Mr. Johnston's ideas regarding the mining future of this locality. It is, he declares,- "only a matter of time and a very short time until all this will' be changed. Outside capital is begin ning to realize lhat mining in B. C, is a good investment. The continued satisfactory results from-'the L'e Roi, Tyee, Granby and other big properties is reviving interest in the bigmineB'of British Columbia, while the marvellous showing made by the Providence and Elkhorn and other high grade1 properties in Greenwood is bound to atttact capital to other adjacent high grade claims." While this perhaps may be the opinion of the most of us, it is particularly gratifying to hear such expressions of confidence in: the' district from one whose experience and knowledge of the mining business qualifies him as an authority on the subject. The meeting of the city council on Monday night was largely taken up with the final discussion of the new by-law relating to liquor licenses. The adoption of the by-law was deferred for a week to allow the hotel keepers to raise such objections and suggest such improvements as the interests of their business demanded, however no serious objections were raised, except on the point of securing the signatures of adjacent property holders. It was pointed out that should the time prove not sufficient to enable any of them to secure these signatures, a permit can be issued to admit of their business being carried on until the necessary number have been secured. The bylaw was therefor on motion of Alder man Caulfield, "reconsidered, adopted and finally passed. This matter has come up in the council at various times during the last two or three years* but action was always deferred iu hopes that a time would arrive when any rearrangement of hotel premises necessitited by the by-law would be less of hardship on hotelmen than is at present the case. Under the by-law adopted Monday night little change will be necessary and the council feel'that the new law- will be more acceptable to hotelmen generally than the old one. Permission was granted the Sisters Hospital to install a system of sceptic tank's in connection with that institution. This system of handling sewerage was tried largely as an experiment, but in every case they have been reported to the council ' as being a thorough success. J. McDougall wrote the council regarding damage done to his-road as a result of an overflow from Lind creek, due to a: small damn erected there by the city engineer while testing the amount of water in the [creek. The matter was turned over to the city engineer tb investigate. /The following accounts-' were submitted by the finance committee and ordered paid: Charles Kinney, $7.00; Cameron & Huff, 17.10; J. The entire ticket selected by the Republicans can be depended upon to further the interests of the railroads, that is, unless the action of the convention is repudiated by the rank and file who may desert the ranks in such numbers as to land the Democrats iu command of state offices. This is a not unlikely result as it is hardly possible that the Washington electors will acquiesce in this invasion of polical affairs by the railroad interests. .THE. LUMBER DUTY. There is a growing- impression that a recreation ground should ' be provided for the 3'oung and rising generation of. Greenwood by the city council. The Greenwood base ball club took the matter up, . and after considerable trouble was able to secure from the owners of the lots likely to be embraced in such grounds, a quotation for the use of the pro-: perty for five years on a lease. It ' is needless to point out that auy arrangement of this nature will have to be handled by the city or some responsible parties, as it is " unlikely' th at" theproperty owners "' will..;enter into any arrangement '.wi'tfi tiie-tlub no.-matter how sincere their intentions may be. The dity could readily procure these grounds, enclose them with a fence and lease them to the club for a stated amount, or for a percentage of the season's returns. It is more than likely the imatter will be brought to their attention at an ' early date, and we sincerely trust the council will give it favorable consideration. through the combine that for years regulated the lumber business in Manitoba and the Northwest Territories, and it is no wonder, therefor, that they strenuously object to a return of the conditions uuder which these combinations were successfully carried on. At the same time it seems hardly fair to the lumbermen of B. C. to refuse aid to them in a trying time. They rightly point out that other industries enjoy a certain amount of protection and why not them? It seems, that since both the consumer and the manufacturer are agreed as to the present prices, that it could be possible to arrange with the government for the imposition of a tariff on lumber which could be immediately -suspended, should any advantage be taken of such, to increase the price to the consumer. :..,_.,,,... C. are unable to compete with American producers, there is one item that should prove interesting to the apostles of high tariff. The lumber men declare that one reason is "that they have to pay a high dirt}' on the machinery required to operate their mills." And this after nearly a generation of high tariff. Since 1878 all sawmill machinery coming into Canada has been heavily taxed in order to foster the manufacture of such machinery at home, and yet iu spite of this, it is apparently still necessary to go to the United States to obtain the proper furnishings for a lumber mill. It seems to us that the proper course under the circumstances would be to entirely remove the duty on lumber machinery as well as on lumber itself and allow the people the benefit of the competition that would inevitably follow. fflgmmim^ CP* CP* CP* CP* Ji *=9 PtmwmmmmmMmmmMmmMmMi With.Which is Amalgamated THE BANK OF BRITISH COLUMBIA^ ..HEAD.OFFICE: TORONTO! The ocean distances are those given in the Century Atlas, and there is additional information given there that the sailing time from Vancouver to Yokohama is fourteen days and from San Francisco to Yokohama sixteen days. This is the advantage that we gain from our northerly position on the globe. The.direct line from San Francisco to Yokohama would involve a journey of 4,791 miles. By sailing- northwesterly to the 4Sth parallel the San Francisco steamers cut 255 miles from the distance. Starting from a more northly port, vessels from Canadian harbors save a still greater distance. An advantage which will be a considerable one is the road Cauada is about to construct will be built with the consciousness that it is to be one of the greatest highways between east aud west. Canada's new transcontinental railway will have two great purposes which are not only inconsistent, but are, indeed, complementary to each other. It will, as has been said, be the rail section between the west and the awakening1 east, and it will also double the habitable portion of the dominion. As it goes through an unsettled land it will be able to choose to a great extent the most direct routes, the best grades, the easiest curves. Altogether our new railway should be in an unapproachable position to compete for the vast commerce that is already setting in a great current westerly and easterly. Some may say, what of the Panama canal? Much of the traffic between the Occident and the orient will go by Panama. But Panama is longer than the Canadian route by 3,500 miles. Passengers or goods in a hurry (and the world is in a hurry these days) will'prefer the quicker despatch across the dominion of Canada. Last autumn the Senator was in a runaway accident in Cariboo, in which he was seriously injured, and from Ihe effects of which he never really recovered. He left for Ottawa before the opening of Parliament to attend to his legislative duties, but was taken seriously ill soon after his arrival at the capital. He was brought back to Vancouver, where he had made his home for sptne years past, in the hope that the mild climate of the coast would assist his recovery, and. he not only stood the journey well, but also showed a considerable improvement in health, and it was hoped .would recover. .-Unfortunately, however, he-suffered, a relapse and the end was somewhat sudden, as, while he was very;ill Tuesday after. noon, it was not thought he would pass away so soon; in'fact, there was hopes that he might rally. These hopes were disappointed, however, and he passed away at 8 o'clock that night. His death leaves a vacancy in the Senate for which there are already various aspirants, but it is more than likely that Hewit Bostock will receive the appointment. Delegations have interviewed Mr. Bostock requesting him to accept the position and he has been endorsed by the different Liberal Associations throughout the whole interior of B. C. A Daly of the Dominion Government Geological staff, is in the city preparing for the summers work in this district. With him are four assistants and together they will cover any section not investigated as well as to examine more particularly certain localities covered last year. Mrs. McKee, wife of Rev. Mr. McKee pastor of the Presbyterian church, Greenwood, received Ihe sad intelligence Monday of the death of her mother, Mrs. McKechnie, at Ingle- wood, Ontario, last week. Mrs. McKechnie has long been a sufferer from rheumatism (which was the immediate cause of her death) and for several years was confined to her room and her death was not unexpected. The sympathy of the community will go out to Mrs. McKee in her sad bereavement. Duncan Ross the Liberal standard bearer for Yale-Cariboo constituency, returned from Ottawa Saturday. He was joined by Mrs. Ross at Spokane who accompanied him home, both looking the better for their outing. While in Ottawa the coming member for Yale interested himself in several matters pertaining to the constituency chief of which was the settlement of the smelter site question at Hedley. This matter, involving a transfer to the mining company of some lands belonging to the Indian reserve, has been the cause of considerable discussion by the local press, which feared the possibility of the erection of the smelter works at a point over the line as was the case with the Le Roi plant at Northport. It is reported that the matter has been arranged to the satisfaction of all parlies concerned, and it is more than likely that the present summer will see the erection of a smelting plant in the Similkameen that will be second to none in British Columbia. PURE ECONOMICAL THOMAS DRUG CO increase the interest of the children, not only in study but in all things that appertain to school life. In this the trustees receive the hearty cooperation of the teachers who are enthusiastic in any work that tends to promote the welfare of the numerous youngsters under their charge. Among other things it was decided to open a library in the school to be stocked with books suitable for children of different ages. Cases for these have been ordered and will be placed at an early date in' the different rooms. It is not intended to use any of the general school funds for this purpose, as it is felt in a work of this kind, sufficient can be secured by voluntary subscription either in books or in money. The object is a worthy one and should be given the heartiest support by citizens generally. George McKenzie and Eugene Sullivan of Westbridge and H. B. Thone of Midway start on Saturday for the Peace River country via Quenelle. Their objective point is the head waters of the Peace river and-to there they will take the shortest route. They leave Westbridge on horses, pass through Beaverdell, and cross the summit to Vernon; from there they follow the wagon roads that will lead them to the Cariboo trunk road, following it to Quenelle. It is the intention of the trio to purchase their supplies at the point nearest to their destination so as to avoid a long pack. All three are experienced mountaineers that are not afraid of the rough knocks incidental to pioneering, and they will thoroughly prospect the country adjacent to the upper waters of the Peace river for mineral as well as for timber and farming land before making any permanent location. Last fall while installing the poles for the Cascade Light and Powei Company, a gang of men uncovered a small lead of galena ore on the Mavis mineral claim belonging to E. T. Wickwire, over which the right of way of the power line passes. The other day Mr. Wickwire gave a bond on this property to Mike Kane and associates for $11,000, the payments of which will cover two years. The first payment is to be made at the end of six months and balance in twelve and twenty- four months respectively. The bonders have the privilege of shipping ore up to any amount they can mine upon the payment of ten percent royalty and in every way the terms of the bond ;are such that the parties taking hold of the property will be well able to meet their obligationsout-of;the^ore, siiould-the claim turn out as expected. 'Thi sale was" the direct result of the accidental uncovering of this lead by the Power Company's men. Assays taken by Mr. Kane ran as high as ninety-nine dollars in gold and silver, and the boys are satisfied they have got a "good thing." There is no reason why it should not be, as its locality is favourable, lying as it does midway between the E. P. U. and Swylark. A gang of men will be at work in a few days on the property and prospecting and development carried on in a systematic manner. DR.
