They have\ngiven to these various matters much\ngreater consideration than the avorago\nratepayer has either time or inclination\nto do, and their position enables them to\ndo this to batter advantage and therefore more intelligently than those who\nare not charged with responsibility for\nthem. If we trust the men, we can\nsafely adopt their recommendation.\nThey say the money is required,\nand they are more likely to know than\nthe reBt of us. Wo elected them to\nlook after these things, believing in\ntheir fitness, and if we are wise wo\nshall voto tho mouey and leave them\nto expend it in tbo public interest, on\nthe plan indicated in tbo by inwB.\nAnother thing: This town cannot\nafford to staud still; wa must continue\nto progress or drop out of the running.\nWe desire to attract population and\nmultiply businoss. Suhjoct to the fulfiiineut by tho\napplicants of tho terms, conditions and\nprovisos hereinafter contained, which\ntonus, conditions and provisoes and\ntbe duo fulfilment thereof are to ho\ntaken, as hereinbefore stated, as conditions precedent to the enjoyment of\ntho rights and privileges hereby granted, the applicants are hereby given\nand granted the exclusive right and\nprivilege to construct and maintain\ncomplete aud operate double aud single\ntraok railways or tramways, and from\ntime to time to change a double to a\nsingle traok railway or tramway, and\nvice verBB, with the necessary sidetracks, switches, turnouts, poles,\nwiroB, conduits, and all applianoes for\nthe running of cars, carriages and\nother vehicles adapted to the same on,\nover, and aloug any of the streets or\nhighways of the Oity of Nelson, and\nto run thoir cars, take, transport and\ncarry passengers and freight on tbe\nsame, by electrio power or such other\npower as may bo found prncticablo,\nbut suoh power other than electric\npower shall, beforo being UBed, be first\napproved of by the Oity Oouncil.\n2. The linos of said railway are to\nbe built, equipped andopcratod subject\nto tbe following regulations, aud the\napplicants aro to conform thereto:\n(a) The applicants before entering on\nany street to construct auy line of railway shall moke application to tbe\nOity for permission so to do, naming\nthe Btreet, or streets, across or ulong\nwhich they desire to operate their\nworks, and befoio in any way proceeding with tbo work shall roceivo the\napproval of tbo Oity Oounoil.\n(b) The construction of auy line of\nrailway on auy street or highway\nshall not be conimencod until a plan\nthereof showing the location oil street,\nposition aud style ol track, road bed,\nrails, poles, wires, and all othor appliances shall have heen submitted to uud\napproved by the Oity Engineer.\n(0) No approval either ot tho Oity\nOouncil or the Oity Egiueer shall have\nany forco or effect if the railway line\nfor which tbo same has beeu giveu has\nnot been fully constructed and in operation within twelve mouths from the\ntime of such approval.\n(d) The location on streets, tho position,style and gauge of all the tracks,\nroad bed, rails, poles, wires and all\nother appliances shall conform to and\nagree with the plans approved by the\nOity Egiueer, aud the Range shall be\nthe standard gauge (4 feet, 8)a inches).\n(e) No now line or oxteusiou of existing line shall bo opened for trullic\nuntil the applicants have obtained a\ncertificate in writing from the Oity\nEnginoor that tho same bas been constructed to his satisfaction, subject to\nappeal from the decision of the Oity\nEnginoer in the event of refusal to\ngrant such certificate.\n(f) The overhoad or trolley system\nis to be adopted.\n(g) All poles ereoted shall b\u00EF\u00BF\u00BD\u00EF\u00BF\u00BD so\nplaoed as to intorforo ns little as possible with all other uses of said streets,\naud both material aud workmanship\nof said poles shall bo of first class\nquality, and on all graded streets said\npolos shall bo painted; and the applicants shnll havo tha nso of all electric\nlight polos owned by the Oity for\nstreet railway purposes, provided tbo\nsaruo are proporly bracod and protocled\nby the applicants, with tho approval\nof the Oity Engineer.\n(h) The couches und cars to be used\non tho said lino of railway shall bo of\nthe most modern style and construction, suitable for tho safoty and comfort of the passengers; shall when in\noperation bo always sufficiently lighted\nand heated, and shall have painted\non conspiouous parts thereof in large\nplain letters, so that the same may bo\nreadily seen byjday or night, the route\nor street ou which the same are to bo\noperated.\n(i) Each car is to be in charge of a\nuniformed conductor, who shall clearly\naunonce tho names of oross streets as\ntho cars reach thorn. Oonduotors\nshall only receive and discharge passengers ou the right or curb sido of\nthe cars ou double track routes, Oars\naro not to bo ovorerowdod (u comfortable number of passengers for oach\nolnss of cars is to be determined by the\nOity Engineer nnd approved of by the\nOity Oounoil.) Oars shall be stopped\nat every orosu street clear of such cross\nBtreet for taking up or letting off passengers; provided uo car shall bo required to stop at such oross streot unless signalled by a preson or persons\ndesiring to board snob car, or by a person or persons ou snch car desiring to\nbe let off. Oars aro to commence run-,\nning on all routes not later than (I ;I10\na. in., and to run until 11 p. m., and !\neaoh day at least 15 cars shall be run\neaoh way on eaoh ronte, aud when a I lor,\ncensus taken by tho Oity shows that\nthe Oity has a population of 12,000,\nthen nt siu'h InterVah between II a. in.\nami ii p.in. ns the Oity Engineer with\nthe appinvul of the Oity Oouncil, umy\nfrom time to time determine.\n(j) The tracks of suid railway line\nshall be laid, on strecls improved and\ngraded so that onrriagea and other\nvehicles may easily travel over and\nacross at any or all points thereof with\nthe least possiblo obstruction and on\nstreets not constructed nooording to any\nestablished grade, the said tracks of\nsa'ii rialway lines may be temporarily\nlaid, but shnll he so constructed us not\nto interfere with or obstruct tbe crossings of any streets intersected bv snid\nline, anil on -moll streets between Hindi\nintersections the said railway shall be\nlaid so us to impede as little as possible truffle thereon, and according to\nplans approved of by the Oity Engineer ; and n-- soon us such strecls arc\nmailed, the snid trucks shall be altered\nto conform to such grade, at the expense of the applicants, and tlie suid\ntracks shall then be laid so that oar-\nriages and other vehicles may easily\ntravel over or across them.\n(k) Upon streets which ure not yet\nImproved nnd opened up by the Oity of\nNelson, the tracks or suid railway\nHues may be temporarily laid nooording to plans approved of by tbo Oity\nEngineer, and may bo thereafter altered by the applicants, and the Oity of\nNelson will assist the applicants by\npaying one-bnlf tbo cost of clearing\ntrees und stumps and ditching such\nlioition of the streets as may bo required to be so cleared and ditched, or\nat the option of the Oity, such work\nmay be done by the Oily, and one-halt\nof the cost thereof shall be defrayed by\nthe applicants, and should the applicants require to do such work in connection with the opening np of such\nstreets the Oity will give the applicants\nthe free use of earth and rock on (he\nstreets, which tbey may need for ballast or otherwise, and which in the\nopinion of the Oity Oouncil is not required by the Oity for Street purposes;\nbut su* b material is not to bu taken so\nas to bring the streets bolow the grade\nus established for such street or streets.\n(I) Ordinary carriages and othor vehicles amy travel, on, over and across\nthe said tracks, und it shall bo a lawful for all and overy person and persons whomsoever to travel upon und\nuse tbo said tracks with tbeir carriages, or other vehicles, loaded or\nempty, when and so ofteu as they may\nplease, provided they do not impede\nor interfere with tbo cars of the applicants running thereon, and subject at\nall times to the right of tho applicants\nto keen upou tiio said tracks with\ntheir curs when meetiug or overtaking\nany carriage or othor vehicle thereon.\nThe cars of the applicants shall bo entitled to the right of way ou said\ntracks, and any vehicle, horseman or\nfoot passenger upon suid tracks shall\nturn out ou the approach of any car so\nas to leave the said tracks clour; duo\nwarning beiug given at. tho intersection of streets of tbo approach of said\ncar by the ringing of gong or boll,\n(m) Said applicants shall at all times\nmaintain the tics, stiiugors, rails,\nturnouts, curves, sidetracks, pules,\nwires, aud conduits in a stato of thorough elllcioucy aud to the satisfaction of the Oity Engineer, and shall\nremove, rouew aud replace tho same\nas circumstances may require, and\nas tho City Engineer may direct.\nnu Said applicants shall at all\ntimes keep so much of the graded\nstreets occupied by their said hues of\nrailway as may lio between the rails of\nevery truck and between tbe lines of\nevery double track and for the space\nof eighteeu (18) inches on the outside\nof every track in good repair, cleaned\nof snow, ico anil other obstructions, and\nshall cause the snow, ice and otber obstructions to be removed as speedily\nas possible, tho snow aud ice to bo\nspread over the balance of the slreet so\nus to afford a safe and unobstructed\npassage way for carriages and other\nvehicles. Should tbe Oity Engineer\nat any time consider that tbe snow or\nice so obstrnoting tbe said portions\nof the said strcts bus not been properly or as speedily as possible removed\nfrom or about tbe trucks of the said\nrailway lines or not properly or as\nspeedily us possible spread ever the\nsaid streets, he may cause tho same to\nbe removed or spread us aforesaid, nnd\ncharge the expense thereof to the applicants, wbo shall at once pay the sumo\nto (lie City. if. however, the Oity\nEngineer is of the opinion that such\nsnow or ioe should be removed entirely\nfrom the streets so n-s to afford a safe\npassage for sleighs and otber vehicles\ntbe said applicants shall nt once do so\nat their own expense and charge, or ill\ncase of their neglect the Oily Engineer may do so nnd charge the expense\nto thorn, und they shall pay the same.\n(o) The Mayor, the Chief of Police\nor tho Ohief of tho Fire Department\nof the said City mny order a suspension of the running of the cars on the\nsaid streets used by the snid lines of\nrailway, or any of them, ns he or they\nmay ('com necessary during any fire\non such street or streets. In case of\ntire, the Chief of tbe Fire Brigade, or\nall ollicers of the Oity, authorized by\nthe Mayor, may cut or pull down any\nwires, poles, structures or appliances\nused to operate the curs on said lines,\nor any of them, or incidental thereto,\nand neither tho City nor such ollicers\nshnll be liable for any loss or damage\nresulting from the outtlng or pulling\ndown thereof, but shnll only be liable\nfor tho actual cost or expense of repairing or replacing the same. The members of the I'oliee or Eire Departments\nof the Oity of Nelson, when in uniform, and tho policemen and dectoe-\ntives exhibiting a badgo arc to be carried free of charge on all of the street\ncars operated by tbe said applicants.\n(p) The line of railway of the applicants, for tbo conveyance of passengers, shall bo oper ited daily, and\nshould the said railway cease to be\noperated at any time for a period of\ntwo (2) months iu any one year,\napplicants shall lose all rights\npriviloges lnrobv granted under this\nby-law. Such failure to operate tbo\nsaid railway lines during the said period mentioned is not to cause a forfeiture of the franchise and privileges\nhereby granted, if the same should result from failure to obtain electrio\npower, or from any otber cause for\nwhich the applicants are uot iu any\nwny liable.\n8. Single cash fures aro not to be\nmora than feu (10) cents each, aud\narB operated after 11\nright to buy tickets at tho rati,' nol exceeding six (ii) for twenty-live (86)\nco its, to bo used only on school days\nbetween the hours of eight a. m. und\nlive, p. iu A ticket shall bo deemed\na faro. A class of tickets must be sold\nto bona tide workmen at tbe rate of\ntwenty (2(1) for one dollar, tbo tame to\nbe used only by workmen When travelling on tho cars between tbe time the\nears commence running in Ihe morning and eight a. in., and between (i p.\nm. and 7:80 p. m., such tickets to be\nsold only at the olliccs of the company\nwithin the Oity of Nelson, to bona fide\nworkmen, who must State their names\nand occupations, aud comply with\nother reasonable conditions. The\nclasses of tiekots ubovo named, except\nworkmen's tickets, shall be kept for\nsale on the cars of tbo applicants at all\ntimes. In case of failure to supply\nsuch tickets for purchase by passsen-\ngcis, then said passengers shall be carried free until such tickets are provided.\n4. Tho applicants shall havo tbe\nright to charge and collect from every\nperson on entering any of their cars\na fare, and any person refusing to pay\nany such fare may be removed from the\ncar. Tbe rule of fare for euch passenger travelling on auy one of the suid\nlines shall not exceed ten cents, including ordinary band baggage, exoept\non nigh I cars us above provided; provided that no fare shall be required of\na child under live years of ago\ntravelling under tho euro of another\nolder person, and provided that when\nthe same passenger travels over two\nor more streets or lines iu tho City,\nthere shall be but oue fare tor the\nwhole distance so travelled, aud the\napplicants when desired by passengers\nshall issue transfer tickets at the point\nof connecting or crossing lino to any\npassenger wlio has paid one faro ou\nany lino operated by the applicants\niu the Oity of Nelson, which transfer\ncheck shall entitle tbe passenger so receiving tbo sumo to a passage on any\nconnecting or crossing line operated\nbv said appioauts in suid Oity. A passenger shall he entitled to as many\ntransfers for one fare BS shall be necessary to allow one continuous trip or\npassage over the lines ot tbo railway\nfrom any one point on the said lines\nwithin theJOity of Nelson to any other\npoints ou their said lines within the\nOity, and such transfer checks shall\nbe usod ouly by tbo person reoeiving\nthe same, and shall bo used within\nleu minutes, or upon tbo next available cur departing upon a connecting\nor crossing line upon which it is to\nbe used.\n5.
