Tho people quite\nunderstand this, aud as the whole\nmutter losolvos itself into a simple\nbusiness proposition they havo no (liiliculty in deciding how to vote. Subject to the fultiime it by the\napplicants of the terras, conditions aud\nprovisos hereinafter contained, which\nterms, conditions and provisoes and\nthe due fulfilment thereof are to be\ntaken, as hereiubefore stated, as conditions precedeut to the enjoyment of\nthe rights and privileges hereby granted, the applicants are hereby giveu\naud granted the exclusive right and\nprivilege to coustruct and maintain\ncomplete and operate double aud single\ntrack railways or tramways, and from\ntime to time to chango a double to a\nsingle track railway or tramway, and\nvice versa, with the necessary sidetracks, switches, turnouts, poles,\nwires, conduits, and all appliances for\ntho running of cars, carriages and\nother vehicles adapted to the same on,\novor, aud along auy of the streets or\nhighways of the City of .Nelsou, and\nto run their cars, take, transport and\ncarry passengers and freight on the\nsarno, by electric power or such other\npower as may be fouud practicable,\nbut such power other thau electric\npower shall, before being used, be first\napproved of by the City Council.\n2. The lines of said railway are to\nbe built, equipped aud operated subject\nto the following regulations, and tlio\napplicants are to conform thereto :\n(a) Tho applicants before entering on\nany street to construct any lino of railway shall make application to the\nCity for permission so to do, naming\nthe street, or stroets, across or aloug\nwhich they desire to operate their\nworks, and bofore in any way prooead-\niug with the work shall recoivo the\napproval of tho City Council.\n(b) The construction of auy lino of\nrailway on any street or highway\nshall not be commenced until a -plan\ntheroof showing tho location on streot,\nposition and style of track, road bed,\nrails, poles, wires, and all other appliances shall have heen submitted to uud\napproved by the City Engineer.\n(c) No approval either ot the City\nCouncil or tho City Egiueer shall have\nany force or effect if the railway line\nfor which tho same has been givon has\nnot been fully constructed nud in operation within twelve mouths from the\ntimo of such approval.\n(d) Tha location on streets, the position,style and gauge of all the tracks,\nroad bed, rails, poles, wires and all\nother appliances shall conform to nnd\nagree with the plans approved by the\nOity Egiueer, and the gauge shall be\nthe standard gauge (4 feet, 8Va inches).\n(o) No uew line or oxtonsiou of existing line shall be opened for traffic\nuntil the applicants have obtained a\ncertificate in writing from the City\nEngineer that tho same has been constructed to his satisfaction, subject to\nappeal from the decision of tho City\nEngineer in tho event of refusal to\ngrant such certificate.\n(f) The overhead or trolley system\nis to be adopted.\n(g) All poles erected shall bn so\nplaced as to interfere as little as possi-\nhlo with all other uses of said streets,\nuud both material aud workmanship\nof said poles shall be of first class\nquality, and on all graded streets said\npoles shall be painted | and the applicants shall have tha use 0/ all electric\nlight poles owned by the Oity for\nstreet railway purposes, provided tlio\nsame are properly braced and protected\nhy tho applicants, with the approval\nof the Oity Engineer.\n(h) The coaches and cars to be used\nou the said lino of railway shall bo of\ntho most modern stylo aud construction, suitable for the safety and comfort of the passengers ; shall when 111\noperation be always sufficiently lighted\nand heated, and shall havo painted\non conspicuous parts thereof in largo\nplain letters, so thai the same may he\nreadily soou by'day or night, the route\nor streot on which the same are to bo\noperated.\n(i) Each car is to bo in charge of a\nuniformed conductor, who shall clearly\nanuouce the names of cross streets as\ntho cars reach thorn. Conductors\nshall only receivo and discharge passengers on the right or curb side of\ntho cars on double track routes. Cars\naro not to be overcrowded (u comfortable number of passengers for each\nclass of cars is to be determined by the\nCily Engineer and approved of by tho\nOity Council. ) Cars shall bo stopped\nat evory cross streot clour of such cross\nstreet for Inking up or letting off passengers ; provided no car shall be required to stop at such oross street unless signalled by a presou or persons\ndesiring to board such cur, or by a person or persons on such car desiring to\nbe lot oil'. Ours ure to commence running on all routes not later than 0:110\na. m., aud to run until 11 p. in., and\neach day at least IB oars shall be run\nouch wiiy ou eaoh route, aud when a\ncensus taken by tbo City shows that\ntho City has a population of 12,000,\nthen at such intervals between (I a. m.\nand 11 p.m. as the Oity Engineer with\nthe appioval of the City Council, may\nfrom time to time determine.\n1 j) The tracks of said railway linn\nshall be laid, on streets improved and\ngraded so that carriages aud other\nvehicles may easily travel over and\nacross at any or all points thereof with\nthe least possible obstruction and on\nstreets not constructed accordiug to any\nestablished grade, tho said tracks of\nsa'd rialway lines mny bo temporarily\nlaid, but shall he so constructed as not\nto interfere with or obstruct the crossings of any streets intersected hv said\nline, and on --uoh streets between such\nintersections the said railway shall be\nlaid so as to impede us littlo ns possible traffic thereon, and according to\nplans approved of by tho Oity Engineer ; and as soou as such streols are\ngraded, the said tracks shall bo altered\nto conform to such grade, at tho expense of the applicants, aud tne said\ntracks shall then be laid so that carriages and olher vehiclps may easily\ntravel over or aoross them.\n(k) Upon streets which are not yet\nimproved and opened up by the City of\nNelson, the tracks of said railway\nlinos mny be temporarily laid according to plans approved of by the City\nEngineer, and may be thereafter altered by the applicants, and the Olty of\nNelson will assist the applicants by\npaying one-half tbe cost of clearing\ntrees and stumps nnd ditching such\nportion of tbo stroets as mny lie required to be so cleared nnd ditched, or\nut the option of tbe Oity, such work\nmay be done hy tbe City, aud ouo-hnlf\nof the cost thereof shall be defrayed by\nthe applicants, and should the applicants require to do such work in connection with tbe opening up of such\nstroets the Oity will givo the applicants\ntbo freo use of earth aud rock on the\nstreets, which tbey may need for ballast or otherwise, and which in the\nopinion of tho Oity Council is uot required by the City for street purposes;\nbut such material is not to ho taken so\nas to bring tbe streets below tbo grade\nns established for such street or streets.\n(1) Ordinary carriages and other vehicles mny travel, on, over aud across\nthe said tracks, and it shnll be a lawful for all and overy person aud persons whomsoever to travel upon and\nuso the said tracks with their carriages, or other vehicles, loaded or\nempty, when and so ofton as they may\nploaso, provided they do not impede\nor interfere with tho cars of tho applicants running thereon, and subject at\nall times to tho right of the applicants\nto keoD upon tiio said tracks with\ntheir cars when meetiug or overtaking\nany carriage or other vehicle thereon.\nThe cars of the applicants shall be entitled to the right of way ou said\ntrucks, and any vehiole, horseman or\nfoot passenger upon said tracks shall\nturn out ou the approach of any car so\nas to leave tbo said tracks clear; due\nwarning beiug given at the intersection of streets of the approach of said\ncar by tho ringing of gong or bell.\n(111) Haid applicants shall nr all times\nmaintain the ties, stiingers, mils,\nturnouts, curves, sidetracks, pules,\nwires, aud conduits in a stato uf thorough efficiency and to the satisfaction of the City Engineer, und shall\nremove, renew and replace tho same\nas oiroumstances may require, and\nas the City Engineer may direct.\n(11) Said applicants shall at all\ntimes keep so much of the graded\nstreets occupiod by thoir saitl lines of\nrailway as may lie between the rails of\novery track and between the lines of\nvery doublo track and for tho space\n\u00EF\u00BF\u00BD\u00EF\u00BF\u00BD\u00EF\u00BF\u00BDf eighteen (IS) inches on tho outside\nuf every track iu good repair, cleaned\nf suow, ico and other obstructions, aud\nshall cause tbo snow, ico nnd other obstructions to be removed as speedily\nas possible, the snow aud ice to be\nspread over the balance uf the street so\nas to afford a safo and unobstructed\npassage way for carriages and other\nvehicles. Should tho Oily Engineer\nut any time consider that tho snow or\nicu so obstructing tho suid portions\nof the said Btreits bus not boeif properly or as speedily as possible removed\nfrom or about the trucks of the said\nrailway lines or not properly or as\nspeedily as possible spread over the\nsaid streets, he may anuse the same to\nbe removed or spread ns aforesaid, nnd\ncharge tbe expense thereof to the applicants, who shnll at once pay the same\nto tlm City, if, however, tho City\nEngineer is of tho opinion thnt such\nsnow or ice should be removed entirely\nfrom the streets so ns to afford a safe\npassage for sleighs and other vehicles\ntbe said applicants shall 111 once do so\nuf I heir own expense and charge, or in\ncaso of their neglect the City Kngineer may do so and charge the expense\nto them, and they shall pay tbe same.\n(O) Tho Mayor, the Ohief of Police\nor the Chief of tho Eire Department\nof the said City may order a suspension of the running of the oars on the\nsaid stroets used by tbo said lines of\nrailway, or any of them, as he or they\nmay deem necessary during any (ire\non such street or streets. In case of\nfire, the Chief of the Eire Brigade, or\nall ollicers of the City, authorized by\nthe Mayor, may out or pull down any\nwires, poles, structures or appliances\nused to operate the ears on snid lines,\nor uuy of them, or Incidental thoieto,\nnnil neither tho Oi.ty nor such officers\nshall be liable for any loss or damage\nresulting from the outtlng or pulling\ndown thereof, but shall only be liable\nfor the actual cost or expense of repairing or replacing the same. The members of ibe Police or Eire Departments\nof the Oity of Nelson, when in uniform, nnd tho policemen and deetec-\ntivos exhibiting a badge are to be carried free of charge on ull of the slreet\ncars operated by the said applicants.\n(p) Tho line of railway of the applicants, for tho conveyance of passengers, shall bo operated daily, and\nshould the said railway oease to be\noperated at any time for a pi riod of\ntwo (2) months in any one your, the\napplicants shall lose all rights and\nprivileges hareby granted under this\nby-law. Suoh failure to operate the\nsuid railway lines during tlie snid period mentioned is not to cause a forfeiture of the franchise and privileges\nhereby granted, if the same should result from failure to obtain electric\npower, or from uny Other canso for\nwhieh the applicants uro uot iu any\nwny liable.\n3. In case of failure to supply\nsuch tickers for purchase by passseu-\ngors, then snid passengers shnll be carried free uutil such tickets aro provided.\n-I. The applicants snail have the\nright to charge and collect from ovory\nperson on entering any of their curs\na fare, and any person refusing to pay\nany such faro may bo removed from tbe\near. The rate of fare for oach passenger travelling on any one of the suid\nlilies shall not exceed ten cents, including ordinary hand baggage, except,\non night curs as above provided; provided that no faro shall be required of\na child under live years of ago while\ntravelling uuder the caro of another\nolder persou, aud provided that when\ntbo same passenger travels over two\nor more streets or lines in the City,\nthere shall be but ono fare for the\nwhole distance so travelled, and the\napplicants when desired hy passengers\nshall issuo transfer tickets at tho point\nof connecting or crossing lino to nny\npassenger who bus paid one fare on\nuuy line operated by the applicants\niu the Oity of Nelson, which transfer\ncheck shall entitle the passenger so receiving the sumo to a passage on any\nconnecting or crossing lino operated\nbv said appioants in said Oity. A pis-\nseuger shall he entitled to ns many\ntransfers for oue fare as shall be necessary to allow oue continuous trip or\npassage over the lines ot the railway\nfrom any oue point on the said l.ines\nwithin thejCity of Nelson to any other\npoints on their said Hues within the\nCity, and such transfer checks shall\nbe usod only by tho person receiving\ntho sumo, nud shnll be usod within\nten minutes, or upon the next avail-\nnble cur departing upon a connecting\nor crossing liuo upon which it is to\nbe used.\n5. Tho property of the applicants,\nconsisting of real estate, used in the\noperation of thoir railway, and necessary for such purpose, road bed (which\nhall include also the rails, poles,\nties aud any part or share of the pavement which has been constructed by\nthe applicants unless appealed from\nas hereinafter mentioned, All repair\nand construction shops, offices, ear\nsheds or barns aud general buildings\n(exoept power house) used hy the applicants iu the operation of their railwav shall be within the limits of the\nCity.\ns. It mny bo that other ministers besides Mr. Hume, \"havo it iii\nfor Nelsou\" or it may be that they\nare so discouragedjwith their failure nt\nmining legislation, of which the\neight hour law is au evideneo, thnt\nthoy are afraid of doing anything\nelse that effects this district for fear ot\na general explosion. It is just this explosion that Nelsou ueoplu fear, and if\nthe Provincial Government would see\nthat their laws nre carried out tie\ndanger of tho explosion would disappear.\nIn the powder magazine directly\nacross the river from the City there\nare stored at present 4b tous of dynamite and six tons of black powder. The\nlaw stales thut. no powder is to be\nstored within two miles of uu incorporated town or Village, Vet this serious menace to life and property in\nNelson is allowed to exist without\nany effort being made to remove it.\nThe awful consequences of nn explosion are bind to contemplate. It\nwould destroy every Jbuilding in Nelson and would probably kill every in-\nhnbitnut of tho City. The oro on these\nclaims is coppor and pynhotite. There\nare two distinct series of ledges\nthrough that part of the country, one\nconsisting of copper, pyrrhotite and\nquartz, und the other of copper, galena\nand oalcite. The Government is building a trail, which branches up from\nthe trail from Fort Steele to Pilot Bay\nthrough the Wliiro Grouse country,\ncoming out to the lake again at Stinky.\nThe Government last year also built\nseveral miles of a wagon road that runs\nup into tho St. Mary's country to the\nSullivan group near tho North Sim-\nmine. A considerable amount ofwork\nis also being done on a number of\nclaims on Crawford Creek, 011 White\nFish Oreek and on the side of St\nMary's Lako. A great deal of work-\nhas beeu done on tho Sullivan group\nwhieh is about 14 miles east of the\nproperties first, mentioned, while the\nNorth Star adjoining may be called a\nmine. It belongs to Mackenzie &\nMann, and a branch line is ro bo uni't\nto it from Cranbrook.
