From and after the passage of this Bylaw the Mayor and City Councillors may from\ntime to time nominate three members of the\nCity Council to act as a Sanitary OotwnUfiO-\nfor the purpose of inspecting, ordering the\nremoval and reporting nil nuisances and other\nmatters, the continuance of which may be\ndeleterious to tbe public health.\nIII. The Commission shall perform their\nservices gratuitously.\nIV. The Commission shall have power to I\nenter any Messuage, Dwelling House, Shop,\nBuilding or other Erection or Land or other\npremises within the City, and whether or not\nthe same be occupied or the curtilage of nny\nof the same, and inspect the condition of the\nsame between the hours of eight in the morning and eight in the evening.\nV. No person or persons shall permit, nftcr\ndue notice in that behalf given, any animal\nor vegetable matter in a decomposed or\nputrifying condition to remain on the premises\noccupied or owned by him or them.\nVI. The Commission on behalf of the Mayor\nand Council may notify any person or persons\non or occupying any messuage, dwelling\nhouse, shop, building, or other erection, or\nthe curtilage of any of the same or other land\nor premises within the city, or if the same bo\nunoccupied, then the owner of nny such messuage, dwelling house, shop, buiding or other\nerection, or tho curtilage of any of the same or\nother laud or premises within the city on\nwhich any matter or thing may be done, permitted, or suffered, contrary to the intention\nof this by-law (according to tho form of\nschedule A annexed) to remove such nuisance as before mentioned, or to close up, purify, cover, or cle-inse any well, cesspool,\ndrain, privy, ditch, or gutter, or otherwise to\nabate or remove the mailer or thing noticed in\nsuch notice as in tbeir judgment shall seem\nmeet by giving noiice in writing, (as per\nschedule aforesaid) signed by two or more of\nthe Commission on behalf of the Mayor and\nCouncil, specifying the act to he done and the\ntime in which the same is required to be done,\nsuch notice may be given to the occupier or\nowner of such messuage, dwelling house,\nshop, building, or other erection, or the curtilage of any of tbo same or of the land or\npremises in the city, or by leaving the same\nat his, her, or tbeir hist kuuwn place of\nmnnlc, or by fixing thesnme or a copy thereof\non somo conspicuous part of the premises,\nVII. It thinks the Governor merited it, then it thinks he didn't.\nIt believes the House was treated scar>\nvily, then it believes the House was the\nprincipal party in fault. It is tho old\ngame\u00E2\u0080\u0094the man and the donkey trying to\nplease all parties, aud ending in pleasing I\nnone ; for if there is one thing more than\nanother which. is demanded of a public\njournal, it is a clear and decided tone on\npublic affairs. When the Chronicle is not\nstupidly raving about some imaginary\n\"radicalism \" aod \" demagogueism\" it is\nsnre to be wishy-washy. Its whole career\nis an oscillation between sour beer and\nmilk and water. When it has got tho\nbeer fit it falsifies, when it is in the milk\nand water humor it evinces the weakness\nof a ricketty child. Under any and all\ncircumstances it is unreliable. It starts\noff this morning with the glaring mis.\nstatement that the parties in Victoria who,\nnearly four years ago, prayed for the removal of Governor Douglas, desired \" two\nGovernors, two sets of officials, and two\ncolonies.\" This is an old falsehood of the\nChronicle, and its continued repetition\nmakes it no nearer the truth. There never\nwas such a prayer from any party or in.\ndividual in Vancouver Island. The prayer\nwas simply for a removal of the Governor\nand his advisers and a constitution that\nwould enable the people of the Island to\ncarry out the policy which they thought\nmost conducive to the country's interests.\nWe Jiave no desire to rake up old abuses,\nbut our contemporary shows a woeful lack\nof historic knowledge, or a queer idea of\nofficial functions, when he tells us Gov.\ncrnor Douglas' administration was a desirable one. Why, during tbe five years\nprior to 1863, Victoria was in one cease\u00C2\u00AB\nless political turmoil against the administration, and against it for some of tbe\nvery reasons wlich tbe people now bring\nnp for Governor Kennedy's removal,\nThere wns the same indisposition to exhibit a detailed statement of the pnblic\naccounts, tho same disposition to place or\nretain Improper and unpopular men in\noffice, and tbe same defiance of pnblic\nopinion. There wns even more,\u00E2\u0080\u0094there\nwas the violent partisanship\u00E2\u0080\u0094disgraceful\nin Ihe annals of the colony\u00E2\u0080\u0094of the principal officials hustling and squabbling\naronnd the polls at the time of election,\nand using every illegitimate means and\ninfluence to return their candidate. Who\ndoes not recollect the conduct of the ex-\nAttorney Geuerol and the present Colonial\nSecretary at the Esquimalt election, when\ntbe torn of a finger would have thrown\nthe colony into bloodshed ? and who does\nnot recollect the numerous other efforts\nthat were made to stifle public opinion ?\nIf such a Government could be obtained\nfor nothing it would be ruinous even at\ntbat price. Our contemporary, however,\nstates the taxation was small and \" tbe\nbnrthen of sustaining the Government fell\nupon the shoulders of those wbo were best\nable to support the weight.\" It is true\nthe taxation was small, but it was only\nsmall because tho people were frugal and\nexhibited but little of tbe extravagance\nof later years; society was in an unformed\nand unsettled state, and it would have\nbeen impossible to have got much revenue\nont of the population. Even, however,\nbefore Governor Kennedy's time official\ndemands were becoming alarming enough.\nThe supplies voted during the last year\nof Governor Douglas's administration\namouuted to no less a sum than $257,-\n0.0. With regard to the statement that\nthe burthen of taxation fell upon tbe\nshoulders of those who conld best bear\nthe weight- nothing conld be farther\nfrom the truth. The harbor dues and\ntrades licenses of that day were the most\nrascally pieces of legislation that were ever\nintrodnced into a country. By the system then in vogne, the rich merchant\ncontributed little more to the revenue\nthan the poorest trader, The whole policy\nseemed indeed to be to exempt the\nrich and overburthen tbe poor. We are\nquite ready to admit, however, with all\nthis, tbat the latter part of Sir James\nDouglas's administration was a great improvement on the earlier part, ar.d showed\nclearly enough that the Governor only\nwanted good advisers; bnt we bare no\ndesire to see things back in tbeir old\nchannel; nor becanse one administration\nhas proved nnsatisfactory to accept greater\nevils. We believe British colonies are\nmade for tbe people that are in tbem\u00E2\u0080\u0094for\nthe pioneers of civilization, who spend their\nmoney and labor in extending the power of\nBritain in almost every corner of tbe globe.\nWhen anything, therefore, obstructs the\nconctry.s progress\u00E2\u0080\u0094that acts autogonis-\ntically to tbe people and their interests\u00E2\u0080\u0094\nwe believe in getting rid of it, if it had all\ntbe dignity aud all the power of fifty\nGovernors. Solus populi suprema est lex.\nTbo welfare of the people is the first great\nlaw. Everything else is secondary, and\neverything wbicb opposes it must go\ndown. Governor Kennedy bas opposed\nit unceusingly, unremittingly. He bas\nnot only placed himself in a defiant attitude\nagainst reductions in tbe public expenditure\u00E2\u0080\u0094 made appointments and paid salaries\nwhere tbe Assembly said tbey should not\nbe made and should not be paid\u00E2\u0080\u0094but he\nhas endeavored as strenuously as man\nconld to lower tbe representative body\nin tbe eyes of the Imperial authorities. Our morning contemporary says\nthis is not true ; but as we have always a refutation for its own assertions in\nits own columns, we merely direct its attention toits editorial of July 10th, whero\nit says Governor Kennedy's message was\n\" written with a view to prejudice the\nHouse of Assembly in the eyes of the Colonial office.\" Waxing warmer a little\nfarther down it declares that \" the message is designed to destroy tho only representative body we rejoice in, and to place\nthe Government of tho country be.\nnenth the despotic heels of a Governor and a Council of officeholders.''\nForgetting all tbis \"hifalutin,\" which is\nbarely a fortnight oh', it now says \" the\nclanse that charges His Excellency with\nendeavoring to place tbe Assembly in a\nfalse and undignified position beforo Her\nMajesty's Government is untrue.\" In\nkeeping witb this is its assertion that it\nagrees witb the principle of the resnlu*\ntion but that it should not bo brought\nforward at this particular time. After\nassailing tbe Governor as above, it wonld\nbe interesting to know at what particular\njuncture it wonld think it wisdom to vote\nno confidence in His Excellency. We\nare afraid our contemporary resembles\nSydney Smith's Noodle family on \"reform''\n\u00E2\u0080\u0094always in favor of the principle, but\nalways opposed toits introduction, on the\nground that it is \" ill-timed.\" We have\nonly space to notico tho \" wind-up\" of\nthe Chronicle's effort of this morning. It\nsays, after a column of the most extraordinary conglomeration of appeals to both\nsides, that the want of confidence vole m\nafter all but a trap which His Excellency\nbas set to catch the House.
