With this object in view,\nthe Directors, with the approval of the shareholders,\nhave, after a careful study of the question, determined\nupon a plan of superannuation, the particulars of which\nare set out in the accompanying rules and regulations.\nThe system adopted calls for no contributions from\nthe employees themselves.\nThe Company hopes, by thus voluntarily establishing\na system under which a continued income will be assured\nto those who after years of continuous service are by\nage or infirmity no longer fitted to perform their duties,\nand without which they might be left entirely without\nmeans of support, to build up amongst them a feeling\nof permanency in their employment, an enlarged interest\nin the Company's welfare, and a desire to remain in and\nto devote their best efforts and attention to the Company's service.\nT. CANADIAN PACIFIC RAILWAY COMPANY\nPENSION DEPARTMENT\nRULES AND REGULATIONS\n1.\u00E2\u0080\u0094The administration of the Pension Department\nshall be under the direction of a Committee to be composed of the following Officers of the Company :\u00E2\u0080\u0094\nTHE PRESIDENT.\nTHE VICE-PRESIDENTS.\nTHE CHIEF SOLICITOR.\nA SECRETARY shall be appointed who shall have\ncharge of the records of the Department.\nThe PRESIDENT of the Company shall be ex officio\nChairman of the Committee.\n2.\u00E2\u0080\u0094The office of the Pension Department shall be at\nMontreal.\n3.\u00E2\u0080\u0094All Communications should be addressed to the\nPension Department.\n4.\u00E2\u0080\u0094Meetings of the Committee shall be held at 10\no'clock in the morning of the first Monday in each month.\nOther meetings may be held if necessary at the call of\nthe Secretary. 5.\u00E2\u0080\u0094The Committee shall have power :\nTo make and enforce rules and regulations for the\nefficient operation of the Pension Department;\nTo determine the eligibility of employees to\nreceive pension allowances;\nTo fix the amount of such allowances ; and\nTo prescribe the conditions under which such\nallowances may inure.\nThey shall make rules for their own government\nnot inconsistent with these regulations, and\nfrom time to time, as required, make reports\nof their action to the Board of Directors of\nthe Company.\nThe proceedings of the Committee shall be subject\nto the approval of the Board.\n6.\u00E2\u0080\u0094The benefits of the Pension System shall apply\nonly to those persons who have been required to give\ntheir entire time to the Company, or to the Company and\nsome other Company or Companies jointly. In cases of\njoint employment, and when the whole salary is not paid\nby this Company, the pension to be paid by this Company shall be estimated upon the proportion of salary\nor wages received from this Company.\n7.\u00E2\u0080\u0094All Officers and employees who have attained the\nage of sixty-five years shall be retired, and such of said\nOfficers and employees who have been ten years or longer\nin the Company's service shall be pensioned.\nThe Committee, however, shall have power to vary\nthe foregoing rule and retain in the service any employee\nwho has reached the age of sixty-five years if in their\nopinion it is in the interest of the Company to do so; provided, however, that no employee who has^ reached\nthe age of sixty-five years without having served ten\nyears continuously in the Company's service, and who\nshall be retained in the service after he attains the age\nof sixty-five years, shall be eligible for pension allowance.\n8.\u00E2\u0080\u0094Officers and employees between the age of sixty\nand sixty-five may, at the discretion of the Committee,\nhe retired with a pension either upon the application of\nsuch employee or upon the recommendation of the Head\nof the Department,\nThe Committee shall have power, subject to the\napproval of the Board of Directors, to retire with a pension, in special circumstances, employees who have not\nreached the age of sixty years, and also subject to like\napproval, to add additional years to the actual term of\nservice when there is sufficient cause for doing so.\nPhysical examination shall be made of employees\nrecommended for retirement who are under sixty-five\nyears of age, and a report with the recommendation of\nthe Company's Surgeon shall be transmitted to the Committee for consideration in dealing with such cases.\nSix months' previous notice shall be given to employees who are to be compulsorily retired.\n9.\u00E2\u0080\u0094Retirement shall be made effective from the first\ndays of January or July in each year.\n10.\u00E2\u0080\u0094The terms \" service \" or \" in the service \" shall\nrefer to employment upon or in connection with any\nother Railway, Express Company, or Steamship Line\noperated or controlled by the Company, and the service\nof any employee shall be considered as continuous from\nthe date since which he has been continuously employed\nupon such Railway, Express Company, or Steamship Line; whether prior or subsequent to their control or\nacquisition by the Canadian Pacific Railway Company;\nprovided, however, that in no case shall such service be\ncounted for any period prior to the incorporation of the\nCanadian Pacific Railway Company.\n11.\u00E2\u0080\u0094In computing service it shall be reckoned from\nthe day since which the person has been in the service\nto the date when retired.\n12.\u00E2\u0080\u0094Leave of absence, suspension, dismissal followed\nby reinstatement within one year, or a temporary lay-off\non account of reduction of forces, need not necessarily be\ntreated by the Committee as constituting a breach in the\ncontinuity of the service, and the time when so laid off\nor absent, unless the employee has during such absence\nentered other employment, may be allowed by the Committee to count as part of such service.\n%\nPersons voluntarily leaving the employment of the\nCompany when their services are required thereby become ineligible for pension allowance.\n13,\u00E2\u0080\u0094The pension allowance authorized shall be\ngranted upon the following basis:\u00E2\u0080\u0094\nFor each year of service an allowance of one per cent,\nof the average monthly pay received for the ten years\npreceding retirement, or preceding the date upon which\nthe employee attained the age of sixty-five years, should\nhe be retained in the service after such date; for example,\nan employee has been in the service for forty years and\nreceived on an average for the last ten years sixty dollars\nper month, the pension allowance would be forty per\ncent, of sixty dollars, or twenty-four dollars per month. 6\nNo pension allowance authorized, however, \u00C2\u00ABhall be\nless than twenty dollars per month.\nIn calculating the period of service upon which the\npension allowance is based, the broken period following\nthe completion of a year, when it is less than six months,\nshall not be counted; when it exceeds six months, it shall\ncount as an additional year.\n14.\u00E2\u0080\u0094When pension allowances are authorized, pursuant to these regulations, they shall be paid monthly\nduring the life of the beneficiary; provided, that the\nCompany may cancel any pension whenever it is established in the opinion of the Pension Committee that the\npensioner displays a decided lack of appreciation of the\nCompany's liberality in granting the pension, or is guilty\nof other serious misconduct.\n15.\u00E2\u0080\u0094Pay-rolls covering all pension allowances, showing the names of those to whom such allowances have\nbeen made and the amount of such allowances, shall be\nprepared at the close of each month by the Secretary of\nthe Department; shall be certified by him ; shall be\ncountersigned by at least one member of the Committee;\nand shall be forwarded to the Accounting Department\nfor registration and payment.\n16.\u00E2\u0080\u0094The Officer in charge of the Staff Records of the\nCompany shall report to the Pension Department on the\nfirst days of January and July in each year, the names\nwith the particulars of service of all employees who will\nattain, during the ensuing six months, the requisite age\nfor consideration for a pension allowance.\n17.\u00E2\u0080\u0094The Secretary of the Pension Department shall\nkeep himself informed of the whereabouts of all employees\nwho have been retired from the service, and shall require satisfactory evidence from each of such employees, at\nleast once a year, that he still comes within the rules of\nthe Pension Department.\n18.\u00E2\u0080\u0094Tn order that the direct personal relations between the Company and its retired employees may be\npreserved and that they may continue to enjoy the\nbenefit of the Pension System, no assignment of pensions\nwill be permitted or recognized.\n19.\u00E2\u0080\u0094The acceptance of a pension allowance does not\ndebar a retired employee from engaging in other business,\nbut such retired employee cannot so engage in other\nbusiness nor re-enter the service of the Company, except\nwith the consent of the Committee, without forfeiting\nhis pension allowance.\n20.\u00E2\u0080\u0094The establishment and continuance of this\nsystem of pensions is entirely a voluntary act on the\npart of the Company, and as the employees do not in any\nway contribute towards it, neither the action of the\nBoard of Directors in establishing such a system, nor\nany other action now or hereafter taken by them or by\nthe Committee in the inauguration or operation of the\nPension Department, shall be construed as giving to any\nOfficer or employee of the Company a legal right to be\nretained in its service, or any legal right or claim to\npension allowance. While it is the policy of the Company to encourage its employees to remain with it and by\nfaithful service to earn a pension, the Company expressly\nreserves its right and privilege to discharge at any time\nany Officer, Agent, or employee when the interests of the\nCompany, in its judgment, may so require, without\nliability for any claim for pension or other allowance\nthan the salary or wages due and unpaid. 21.\u00E2\u0080\u0094These rules and regulations shall take effect on\nJanuary 1st, 1903, and may be altered or repealed from\ntime to time as the Committee, subject to the approval\nof the Board, may hereafter determine.\n\ Revised to February 9th, 1915. In cases of joint\nemployment, and when the whole salary is not paid by this Company, the Pension to\nbe paid by this Company shall be estimated upon the proportion of salary or wages\nreceived from this Company.\n7. All Officers and Employees who have attained the age of sixty-five years\nshall be retired, and such of said Officers and Employees who have been ten years or\nlonger in the Company's service shall be pensioned.\nThe Committee, however, shall have power to vary the foregoing rule and\nretain in the service any Employee who has reached the age of sixty-five years if\nin their opinion it is in the interest of the Company to do so; provided, however,\nthat no employee who has reached the age of sixty-five years without having served\nten years continuously in the Company's service, and who shall be retained in the\nservice after he attains the age of sixty-five years, shall be eligible for pension\nallowance. 1\nA{e&~c\nfar- 8. For instance, an employee has\nbeen in the service for forty years and received on an average for the last ten years\nfifty dollars per month, the Pension Allowance would be forty per cent of fifty\ndollars, or twenty dollars per month.\nIn calculating the period of service upon which the Pension Allowance is based,\nthe broken period following the completion of a year, when it is less than six months,\nshall not be counted, when it exceeds six months it shall count as an additional year.\n2 /\n14. When pension allowances are authorized, pursuant to these regulations, they\nshall be paid monthly during the life of the beneficiary, provided, however, that\nthe Company may cancel any pension in case of gross misconduct on the part of the\nPensioner.\n15. Pay-rolls covering all Pension Allowances, showing the names of those to\nwhom such allowances have been made and the amount of such allowances, shall be\nprepared at the close of each month by the Secretary of the Department ; shall be\ncertified by him ; shall be countersigned by at least one member of the Committee ;\nand shall be forwarded to the Accounting Department for registration and payment.\n16.
