L White, weie in\noffering the public as a attractive investment.\" Mr. Miner's statements to\nme applicable to these strict ores may\nhe summed up thus I\u00E2\u0080\u0094(a) Shareholders\nNew York negotiating for the sale of | have heen given all the information\ntlie property, or at any rate exchanging our purlers with the Amalgamated\nCopper Company having that niner!\nin view, tlie lalterconlil no! he Induced\nin give as much as two million dollais\nfor the property.\" To this I reply thai\nI have definite assurance that tlie cash\nexpended to date on the company's\nproperties is about $1,600,000, This\ndoes not represent their value, though,\nfor a consideralile proportion of the\noriginal consideration for the mineral\nclaims was in stock, whilst a large and\nvaluable tract, of land, situate near\nGrand Forks, was received as a smelter\nbonus or subsidy without any cash\ntherefore, further, that the (own nf\nPhoenix is partly on the company's\nmineral claims, adding very largely lo\ntheir surface value. As to the alleged\nattempts to sell, Mr. Miner assured ine\nthat the directors had not tried to sell\nthe property ! on the contrary tbey\nbad declined offers, which they had\nfully satisfied themselves were bona\nfide and hacked by the necessary cap!\ntill, for the purchase of the property at\nmuch higher figures than the $2,000,*\n000 inentintied.\n(4) \"No authoritative rtatement bus\nyet been given as to the average\nvalue per ton nf me treated although\nthe smelter has been in operation\nsince last year. Repealed applications\nhave been made to tbe coinpaiiy by\nshareholders for this information bin\nit has been refused fol motives of\npolicy.\" Mr. Miner staled to tne lhat\nno shareholder had been refused information that, he was reasonably entitled to. Statements of receipts and\nexpenditures had been submitted to\ngeneral meetings of shareholdeiswheri\never required by Iheprnvisionsgoverning thu conduct nl the financial affairs\nuf the several companies now consolidated. When presiding over general\nin.', tings he bad on several occasions\nstated to shareholders present that\nthe ore was yielding a profit, but just\nwhat that profit was the directors\nwere not yet prepared to make public\nIn adopting this attitude at the present stage of Iheir undertaking the\ndirectors considered Ibey were conserving the best interests of the company\nand were only doing the same as other\nmanufacturing concerns which do not\ndivulge details of the cost of production,\n(5) \"if, nf is correctly believed hy\nthese in the best, position to judge, the\naverage gross value of the ure treated\ndues not exceed Hve dollars, it is\ndoubtful if operation's are not being\ncarried on at a positive loss.\" Perhaps\nlhe most effective reply to this is contained in the following excerpt from a\ncircular, daied August 12, sent to\nshareholders with their stock In (he\ntbey are entitled to, (u) The directu\nhave not even thought of Increasing\nthe stock, (c) They are Hot ottering\nanv stock to the public.\nI desire to add that, not only in ilie\nBoundary dislrict, hut When at Boss*\nland and Nelsnn lately, lhe simple\nmention that the Canadian Alining\nReview bad attacked Ilie Granhy com*\npuny promptly elicited replies, remarkable in their unanimity, in effect that\nthat journal is notorious fnr Its general\nhostility towards llrilisli Columbia\nmining enterprises.\nAl the iUk uf making an unreason*\nable demand un your space I ask your\npermission to here briefly summarize\nthe history and work uf the Granhy\nConsolidated Mining, Smelting k\nPower Company, Ltd., which lias a\ncapital of $16,000,000 ill 1,600,000 $10\nshares, Tlie consolidation embraced\nfour incorporated companies, viz., tlie\nOld Ironsides Mining Company, Ltd.,\ncapital $1,000,1X10 ; the Knob Ilill Gold\nMining ('nnipany. They are lhe\nOld Ironsides Knob Hill, Victoria,\nFourth uf July, Phoenix, Aetna, Grey\nKagle, Banner, Tip Tup and Triangle,\nthese constituting, so far as known,\nthe biggest copper mining proposition\nin tlie Boundary and probably in the\nornvince. C 2,505\nSunset ,...., 50\nWinnipeg 1 100\nKing Solomon 440\nSnowshoe. 330\nNo. /, ..,.,, ,.,..,,,,,. i 120\nTolal,.,,,,,., ,,,,.,.,.. 26,557\nShipments during 1900 totalled 97,741 tons, and during\nthe current year to September 30, 27.1,196 tons, making, with\nOctober shipments, an aggregate of 395,494 tons.\nproVed tbe occurrence of ore down to\na depth of 81X1 feet. Large surface\nquarries have been opened in ore which\nis known to extend about 8,000 feet oil\nthe company's ground ami in have a\nwidlh nf 3IKI to 400 feet. As now\nopened the deepest face of ore In the\nquarries is about iXI feet but n cut is\nnow being run inin the hill that will\neventually give an open face uf more\nthan 200 feel in maximum depth. Tbe\nrailway cars will shorlly be run Into\nthe quarries and be tliere filled with\nore by means of a steam shovel, thus;\neconomising iu tlie cost of loading.\nShipment uf nre was commenced in\nduly, 11)00, and during that year 84,639\ntons were sent lo the smelter. The)\noutput for nine months uf I'.lul ended\nSeptember KU was 168,020 Ions, making!\nan aggregate tonnage to the latter1\ndale of 283,166 tons. At the Canadian\n.Mining Review's estimate of $;\"> pei'\nton this wnuld give a grass value ut\n$1,105,776. Court was held ill the Mil\nsonic Hall, which had been suitably\nprepared for the proper transaction of\nthe business, its several ante rooms\nproving convenient for the use of\njuries, witnesses and counsel. The arrangements were made by Registrar\nW. 0. McMynn and Deputy Sheriff F.\nM, Elklns, Sheriff Vale arrived from\nVernon on the afternoon \"l 21.-.I. The\nThe Deputy Attorney General W. A.\nMaclean,prosecuted. HisEonorJudge\nLeatny was invited to take a seat ou\nthe bench, whicli lie did.\nAfter the Brand Jury hud answered\nto their names Mr 11. ('. Shaw, on behalf of the Greenwood Law Association and the City of Greenwood, addressed a few words of welcome to His\nLordship, who replied, thanking the\nbar for their welcome, intimating his\nimpression thai the Boundary is a\nsuilable locality in which lo huld\nAssize and Supreme Court sittings\nand expressing ids astonishment at\nthe big mineral showings he had seen\nin visiting some of the mines iu the\nneighborhood. He iluniuht that comparatively few people outside the district had any conception of (he enormous mineral resources tho district\nappeared to possess.\nHis Lordship briefly addressed the\nGrand Jury, who retired and later\nbrought in true bills against Sandy\nGlencross and Slim llogan, indicted\nfor conspiracy (with L. C. Barnes, who\nhad pleaded guilty las'. Mi, in a court\nof speedy trials) to waylay and rob one\nFrank MeGoogan, and tiguir^t Joseph\nMurphy charged with maiming a cow\nthe property of Ceo. W, Gillespie, at\nSidley near Camp M Kinney,\nIn the first case the principal evidence against, the prisoners, who hud\nbeen nearly fiv. months in custody\nawaiting trial, wus that of Barnes,\nwho turned King's evidence, but as\nihis was not corroborated the jury\ndeemed the evidence in-tifiicieut\nto convict, gave its prisoners the benefit of the doubt an;l discharged. In\nMurphy's case the jury did not deliberate many minutes, hut quickly returned n verdict of not guilty. Tliis\ncompleted the Assize Court proceedings and the jurors were discharged,\nThc following cases were disposed\nof:\nWilliam Diamond vs. John William\nNelson.\u00E2\u0080\u0094Plaintiff's claim isagainst the\ndefendant for a declaration Unit the\nplaintiff is the owner and entitled to\nthe possession of the Diamond Fractional mineral olalm, situate in thu\nKettle River Mining Division, Yale\nDistrict, and that in so far us the San\nJuan Fractional mineral claim, situate in nr. K I'le Rivel' Mining Division aforesaid, interferes witb or over-\nhips the said Diamond Fractional\nmineral claim, the same may be declared to tie invalid and void. And for\ndamages for trespass. Claim allowed\nwith costs. Counter claim notallowed,\nCosts against Nelson,\nJames Fisher vs. CharlesL. Hoffman\nand the Deadwood Gold-Copper Mill-\ning compuny:\u00E2\u0080\u0094The plaintiff's claim is\nfor delivery Jo 1 lie plaintiff by the do-\nfend.iius of 125,01)0 fully paid up\nand non-assessable shares in the defendant company, being the purchase\nprice of an undivided one quarter\ninterest in the St.. Lawrence mineral\nclaim, situate in Deadwood camp, in\ntlie Kettle River Mining Division of\nYale District, sold by the plaintiff to\nlho defendants. And for damages for\nnon-delivery of said shares.\nOr in the alternative, for the rescission of said contract of sale and for a\ndecree of tliis Court, that the defendants transfer to the plaintiff the said\nundivided one quarter interest in the\nsaid mineral claim, and for damages,\nOr, for $15,000 as the, value of said\nshares, and for an injunction, and u\nlis pendens, and costs of this action,\nand such other relief as to the court\nseems meet. Settled out of court,\nJoseph Murphy, of Sidley, near\nCamp McKinney, was charged tbat on\nor about Septemher 10th, 1000, he did\nwilfully damage one cow, the property\nof George W. Gillespie, also of Sidley,\nliy maiming or wounding said cow.\nThe charge against. L, 0. Barnes,\nSandy Glencross and Slim Hogan, who\nhad a preliminary hearing at Greenwood on May 28 before P, M. Hallett,\nwas as follows:\n\"Louis Comfort Bailies, Sandy\nGlencross nnd Slim Hogan did on lhe\nll.h day of May last, unlawfully conspire, combine, confederate and agree\ntogether to commit a certain indictable\noffense, to wit, the crime of robbery,\nby then and Ihere conspiring, confederating and agreeing togsther to unlawfully and by means of violence to\nbe used by them to and against the\nperson of one Frank MGoogan, lo\novercome resistance, and then and\nthere to unlawfully and violently steal\nfrom the person of the said Frank iMc-\nGoogan, money,\" etc, etc.\nBarnes pleaded guilty anil turned\nKing's evidence. His confession, made\nbefore Mr, Jas. Kerr, J. P\u00E2\u0080\u009E is ns follows :\u00E2\u0080\u0094\nI, Louis Comfort Barnes, wish to\nmake a statement freely and without\ninducement to do so, 1 was playing\nblack jack in the Butte hotel, at Phpe\nnix, about four weeks ago last Saturday, I went broke then, I had some\nmoney to start with. Sandy Glencross\ncame to trie and said he wished to speak\nl.o uie. He said this man Frank Mc-\nGoogm is $1,500 to $1,800 strong and\nwo have been in hard circumstances\nall wlnler, it is just as easy as fulling\notf a log. All we have to do is to stick\nhim up and take the money away from\nhim. He said, 1 dure not go as 1 am\na cripple and wnuld be detected, Ynu\nand Slim Hogan go down the road between I'hoenix and Greenwood. He\nsaid thut MeGoogan had a prostitute\nand came up there every Saturday\nnight from Greenwood and you can\nhold him up on the road coming np to\nPhoenix. I told him that I had no gtm\nand he said that 1 did not need any ;\nthat he would give his gun to Slim\nHogan and he knew how to hold liim\nup.
