CELLAR\nI      COVER CONDEMNED\nOn behalf of the Kootenay Jam Co.,\nLtd., H, C. Hatt last night made a request to tiie council -for a. .lease of 40\nfeet of the road abutting on the factory, so that it might be used for ex*\ntensions to *the company's buildings.\nAfter some discussion the council came\nto the unanimous conclusion that It\nwould be Impolitic -to grant the request\nand a resolution was passed embodying\nthe decision.\nMr. Hall explained 'to :the council that\nthe factory -had been founded last year,\nand that the-operations of the company\nhad met with such -success that the\npresent -factory was now insufficiently\nlarge for the Increased business. It\ntod become necessary'to enlarge. This\ncould cirity be .-floneby raising the build-\nlag, toy making use of the roadway, or\noy purchasing acreage outside the city.\nIt was .impossible to raise the building\nso that It would be suitable for the\noperations of the factory and he asked\nthe (council to grant the company the\nuse of part of 'tiie road that was now\ncovered 'by a mud bank. He thought\nthat .flre :full 7T5 feet. of roadway was\nnot required, and that tt would not affect the public interest If the company\nwere permitted to use part of the vacant ground. The C. P. R. plans would\nrender 'this street more dangerous than\nat present. Tf the council would grant\nthe company's request it would render\nthe site sufficient for the factory for\nprobably the next ten years and would\nprevent, the \u2022necessity for moving out\n*df the 'city. New Industries had not\nthe assets of .those longer in operation.\nThe stock in the company was held not\n\u2022only In England but 'by .people of Nelson and .among tthe .ranchers of the\nneighborhood, und it was necessary to\npay dividends to retain confidence. He\nthought the council might be willing\nto aid the industry ipy granting its request.\nMr. Hall proposed that the council\nshould, iby bylaw, .dtose the street and\nshould lease 40 feet to the company for\nten years at a rental of \u00a5100 a year and\nshould also remove the bank now on\nthe roadway.\nMr. Beech gave technical reasons\nwhy raising tlie building would not be\nfeasible. The steam would damage the\njam. Tho weight of the jam would\nnecessitate a particularly strong steel\nstructure which it might be impossible\nto have built in Nelson. Mr. Beech\nmentioned the case of a three-story\nbuilding in England used for a similar\npurpose, which, annough strongly built,\ngave way, and he said that his former\nemployers in England had found it advisable to place all their factory on the\nground floor even when land was very\ndear.\nIn reply to the mayor lie said that\nthe new building was required for storage purposes. Any other site would be\nobjectionable because of the extra cost\nof 'handling that would be entailed\nwere the .warehouse at a distance from\nthe factory.\nThe delegation then withdrew and it\nat once became evident that the council1 was not favorably Impressed with\nthe company's proposal.\nAlderman Kllby remarked that he\nthought the building might be raised\nand that the steam difficulty was not\nInsoluble. He said that the street\nwould be used much more by the public when tlie new wharf is built and\nthat it would be highly objectionable\nto close it.\nThe mayor said that lt would cost\nthe city some $2,600 or $3,000 to remove the earth bank and the total rent\nIn ten years would be only $1,000. He\nthought It would be a dangerous prece\ndent to grant the request and that to\ndo so would lead to numerous similar\napplications. He observed that the\nHudson Bay company had three or four\nwarehouses In different parts of the\ntown and that the Kootenay Jam company could also adopt a similar policy\nwithout great inconvenience. The closing of the street would be highly ob\nJectlonable.\nThe other aldermen agreed, and on\nmotion of Alderman Matthew, seconded by Alderman Kllby, a resolution was\npassed, stating that In view of the fact\nthat the foot of Josephine street would\nbecome the main thoroughfare to the\nwharf the council regretted that It was\nunable to entertain the company's proposal.\nMr. Hall, on returning to the council\nohamber to hear the council's decision,\nexpressed the opinion that the council\nwas under a misapprehension as to tlu\nInterference to traffic that would* he occasioned, but the mayor intimated that\nthe council's determination was Irrevocable.\nO. C. Mackay, city engineer, presented a report providing for a fortnightly\npayroll of $153.55. He reported that\nfor three hours early on Tuesday morning the water service had been cut oft\nowing to leaves choking the intake\npipe. He also reported that Mr. Svoboda had covered his cellarway with a\nwooden door, but not In accordance\nwitJh the promise made to the council\non his behalf.\nMr. Mackay stated that the wall had\nnot been lowered as promised and thai\nthe' alleyway was now in worse state\nthan before. He also stated that the\nelectric alarm that should give warning of the towering of water in the\nreservoir was broken and that, in an.\ncase, it would not work when frozen\nThe mayor said that the reservoir\nhad emptied ln one night. There was\nevidently a serious leakage of water\nsomewhere. The situation might become extremely dangerous ln case o\nfire.\nOn motion of Alderman McMorrls a\nwwolutlon was passed referring to tbe\ncity engineer and city electrician the\nfluty of devising a satisfactory scheme\nof -lilarm in case of water lowering In\nthe reservoir, and referring to the city\nengineer and city solicitor the mhtter\nof the Svoboda cellar, with a view 'or\nhaving it made safe in a proper manner as promised by Mr. O'Shea on behalf of Mr. Svoboda.\nThe following letter was received\nfrom A. M. Johnson, city solicitor, regarding the claim against the city of\nMrs. Q. B. Oulton, whose husband was\n>kllled in the city power plant:\n\"Further referring -to my last letter\nherein to you, In which I advised the\ncity to pay $1,500 In settlement-of this\nclaim, and referring to our conversation, in which you advised Jne that the\ncity 'had paid tlie funeral expenses ot\nthe deceased, amounting to $199, I beg\nto advise you that I Interviewed Mr.\nO'Shea, acting for Mrs. Oulton, as to\nwhether he would be .satisfied to allow\nthe city to take credit for the .sum paid\nfor funeral expenses.\n\"I am this morning In receipt of a\nletter from him in which lie advises\nme that he is Instructed to consent that\nthe amount paid by tue miy be deducted from the $1,500.\n\"I would ask you .to be good enough\nto -have a check in tue sum of $1,301\nmade out, payable to James O'Shea,\nand sent to me to be delivered to him\non obtaining u proper receipt and discharge from all further liability.\"\nMr. Johnson, who was present, discussed at some length the council's decision to have a general local Improvement bylaw prepared. He explainer'\nthat he considered the present system\nof effecting improvements inequitable\nbut he showed that the preparation o:\ntlie proposed bylaw would be a formidable and complicated operation, If it\nwere to be done lie asked that an ad\nvisory committee, consisting of the\ncity assessor, the city engineer and a\ncommittee of aldermen, be appointed to\nact with him. He pointed out that the\nwork would take at least three months,\nand in view of the approaching dissolution of the existing council, he recom\nmended that tiie entire matter be left\nto be dealt with by next year's council.\nTho latter suggestion was adopted.\nMr. Johnson also reported that he\nhad served Mrs. Walsh with notice to\nremove her house from the roadway\nand that tlie next step would be to enter action against her as a squatter.\nAlderman McMorrls, seconded by Alderman Hale, instructed the solicitor to\ntake the necessary steps.\nMr. Johnson was also authorized to\nexecute the lease of 73-100 of an acre\nof foreshore to tiie C. P.. R., to be used\nfor railway purposes. He was 69\nyears old.\n(Western Associated Press.)\nOTTAWA, Dec. G.\u2014Sir Wilfrid Laurier and Hon. F-. Oliver were today waited upon by a deputation representing\nthe South African Veterans' association.\nThe deputation, which consisted of\nLieut. Col. Hut-man, Maj. Woodslde and\nMaj. Winter, and Mr. Miller, secretary\nof the association, asked for an extension of time in which to locate land\ngiants. According to tbe act, lands\nmust be located by Dec. 31, .1910, and\nwork must be commenced by June 30.\nIt was pointed out, that if a two years'\nextension wera granted veterans would\nhave time to locate or dispose of theli\nholdings. On the other hand, If they\nwere obliged to sell, speculators wouh\nbe in a position to buy warrants at a\nlow figure. The ministers were in\nformed that up to the present time only\none-third of .the grants have been disposed of. After the time and place are decided caucus will deal with the basis\nof organization and the constitution of\nthe convention.\nMonday's sittings of commons closed\nwith a division on a motion to adjourn\ntlio debate on u resolution introduce!\nby tlie liberal lender, the government\nmajority being 22, three liberals voting\nwith the opposition.\nThe resolution, which called for the\nappointment of a commission to inquire\nInto the question of technical education, was moved by Hugh Guthrie, liberal member for South Wellington. The\nmotion to adjourn the debate was made\nby Hon. MacKenzie King. Three lib\nerals wlio voted against the motion'\nmade by tlie minister were Mr. Guthrie\nMr. Fowke, South Ontario, and Mr.\nVerviile, labor liberals.\nThe adjournment of the debate war\nmoved by Mr, King, not because he was\nopposed to the object of the motion\nhut because, on behalf of the government, lie had expressed the opinion\nthat there should be such delay as\nwould enable the government to decide\nwhether or not It would be trespassing\nupon the rights of the provinces for thi\nfederal government to take up the\nquestion of technical education. His\nspeech wus an appeal for an improvement in the industrial education of the\npeople.\nMr. R. L. Borden declared that the\nconstitutional difficulty was an Imaginary one only. S. Fisher on Sat\nurday and urged the government to extend the provisions of the civil service\nact to the outside service, increase the\nscale of pay, and to inaugurate a system of superannuation ror the benefT\nof the outside service. The ministers\nexpressed sympathy with the -demands\nmade by the deputation and said the\nmatter of the extension of the civil\nservice act to the outside service was\nengaging the attention of the government. The desirability of the system of\nsuperannuating being applied to the\nservice was also recognized by the ministers, who promised that tlie recommendation would receive serious consideration,\nOTTAWA, Nov. 6.\u2014The official British report of the Imperial defence conference has been received here. It con\ntains the correspondences between\nGreat Britain and Australia and New\nZealand, which was not contained in\nthe Canadian blue book.\nIt was provisionally arranged that\nAustralia should provide a fleet unit to\nconsist of oneiiimqrcd cruiser (new\nindomitable tyf\u00ae'\u00bb three unarmored\ncruisers (Bristol class), six destroyers\n(river class) aiid three submarines (C\nclass). The vessels are to be manned\nas far as possible by Australian officers\nand seamen. Tho members required to\nmake up the full complement for immediate purposes should be lent by the\nroyal navy. In peace time, and while\nIn the Australian station, this tleet unit\nwould be under the exclusive cominun*\nof the commonwealth government as\nregards their movement ami general\nadministration, but officers and men\nshould be governed by regulations similar to the king's regulations and be\nunder naval discipline, and when with\nvessels of the royal navy tiie senior officers should tliJ-ce command of the\nwhole. Further, when placed at the\ndisposal of the admiralty by the commonwealth, the Australian fleet uni\nshould form part of the eastern fleel\nof the empire, to be composed of similar units of tlie royal navy, to bo\nknown as the China and East Indies\nunits, respectively, and the Australian\nunit. The initial cost of such unit ts\nplaced at \u00a38,601,000. The annual cost\ninclusive of all charge, would be \u00a3600,-\n000, and a further additional sum would\nhave to be added In view of the higher\nrates of pay, etc, in Australia, making\nan estimated total of \u00a3750,00(1. They have at\npresent the same facilities in this respect as have many other towns and\ncities in the interior of British Colun?\nbla. They have the Crow's Nest branch\nof the C. P. H. running through their\ntown, which gives them mail connec\ntlon in every direction, and they also\nhave an ofllce of the same company's\ntelegraph system, but these they consider Insufficient. They want, in addition, telephone connection with the\noutside world, and if the opinions expressed In the past couple of issues of\nthe local paper, The Review, are a reflex of those of the people of Creston\nthey want it badly, They are not particular In which direction they get this\nconnection, whether east or west, that\nIs with Cranbrook or witli Nelson.\nIn their desire for telephone connection with either Cranbrook or Nelson\nthe people of Creston are exhibiting\nordinary business sense. Telephone\nconnection with either of these places\nwould prove a great convenience and\nalso a great benefit to the people of\nCreston, but not more so than to the,\nbusiness Interests of \"the city with\nwhich connection is secured. Creston,\nas most people know, Is situated ln the\ncentre of one of the best ranching districts In the interior of British Columbia. It has an exceptionally large area\nof first-class land immediately tributary\nto it which is rapidly being brought\nunder cultivation. No town in the interior hus made greater progress in the\npast couple of years than has Creston\nand none has a brighter a future before it. The people of Creston are\nfully alive to their town's possibilities,\nand It Is to enable them to take the\nfullest advantage of them that they\ndesire a telephone line either to Nelson or to Cranbrook.\nThere ls no necessity to enlarge upon\nthe advantage to either of these cities\nit would be to secure the trade of a\nrapidly growing town such as Is Creston. This trade will naturally go largely, at least, to the city to which a telephone line is built. The distance between Creston and Cranbrook and Creston and Nelson is, respectively, 67 and\n68 miles, or a difference of one mile ln\nfavor of Cranbrook. The distance be\ntween Nelson and Creston, however,\nwould not represent the length of telephone line which It would be necessary\nto construct to connect these two\nplaces, for, It Is understood, the Creston Power, Light and Telephone company already have the poles on the\nground for a line to Kootenay Landing,\na distance of 18 miles, so the 50 miles\nbetween Nelaon and the Landing would\nbe all that lt would be necessary to\nbuild. Another object which could he\nserved hy the same line would be th*\ngiving of the people along the west\narm the telephone service which many\nof them desire.   In view of these facts\nit Is only natural to suppose that Nelson will be the place with which Cres*\nton will be connected by telephone.\nThe matter of securing the building\nof such a line is one which might very\nwell be taken up by the board of trade\nof this city and representations on the\nsubject made to the British Columbia\nTelephone company,, the institution\nwhich, under existing circumstances,\ncould handle such an undertaking with\ntlie greatest degree of satisfaction to\nall concerned und the one which would\nbe ln the best position to make a success of such a venture.\nEDITORIAL NOTES\nThere are just 16 days left In which\nto do your Christmas shopping and the\nchoicest articles are going every day.\nThe Hosmer Times in Its last Issue\nsays: \"Judging from tlio tone of The\nNelson News one might Imagine that\nlt was complacently satlsllcd with the\nresult of last Thursday's election.\"\nWhy .shouldn't it be?\nThe mining men and the business\nmen generally of Nelson and of tlie\nKootenays should do everything In\ntheir power to make the mining convention which will open in this city a\nweek from tomorrow a success. The\nmeeting is especially important in\nview of the fact that at It an attempt\nwill be made to find a solution of the\nzinc problem, which has proved such\nan obstacle to the development of mining in many parts of tlie Kootenays.\nThe conservative members of the\nhouse of commons are working on\nplans for the holding of a convention of\nthe party during the coming summer,\nWinnipeg being the likely place of\nmeeting. The idea of holding such o\nconvention ls a proper one and one\nwhich should have been acted upon\nyears ago, while the place suggested is\nby all odds the best that could be selected. The west is the growing part\nof Canada, and the part that will, with\nIn a comparatively few years, largely\ncontrol the country's destiny. To It\nboth political parties must more and\nmore look for their support.
