Laing-Stocks\nwas given at the assizes yesterday by\nMr. Justice Murphy in the suit of\nStocks vs. the China Creek Lumber\ncompany. The case has occupied the\nattention of the court for two and a\nn\"alf\"\"days and even yet is not quite\nfinished, as the judge has reserved his\ndecision as to whether Mr. Laing-Stocks\nIs entitled to interest.on the payments\nmade on the land, and arguments on\nthis point will be heard this morning.\nMr. Laing-Stocks sued for the rescission of an agreement to purchase certain fruit lands from the China Creek\nLumber company for $16,250, and for\nthe return of the amount of the purchase price, $9,750 already paid, on the\nground that the water available for irrigation had been misrepresented. It\nwas also contended that at tlie time of\nsale the defendant's title to ithe land\nwas not complete.\nHis lordship in a lucidly reasoned\njudgment reviewed the evidence. He\nsaid that the question of law was not\nin dispute. He had failed to see what\nbearing much of the evidence regarding nature of soil and irrigation questions had upon the question as to\nwhether there bad been misrepresentation. Mr. Campbell, president of the\nChina Creek company, in bis evidence\nindignantly repudiated the suggestion\nthat he Would be guilty of misrepresentation, and bis lordship believed that\nhe would have told Mr. Laing-Stocks\ntbe truth about the water If he had\nThe flrBt thing his lordship -had to\ndecide was, had there been failure of\nwater. On this point there were measurements, 22 Inches in August and 11\ninches In October. It was clear that\na stream of this volume would be useless for the irrigation of 104 acres. He\ntherefore came to the conclusion that\nthere bad been failure of water.\nAs to the representations that had\nbeen made regarding the purchase, he\nlaid aside those of Mr. Stewart, who\nhad died, and confined himself tol those\nmade by Mr. Deschamps. He then\nsought to discover the attitude of mind\nof the^partiea. Mr. Lalng-Stocks undoubtedly had irrigation ln mind, as\nwas shown from his letter to Mr. Stewart. When he met Mr. Deschamps both\nparties knew that the land was,being\npurchased for agricultural purposes.\nThe question of water was discussed.\nMr. Deschamps says that he referred\nto the supply as for domestic purposes.\nBut surely any British Columbian\n, talking of water In such a connection\nwould refer to agricultural purposes\nand to the purposes of irrigation.\nThe question next arose did Mr. Deschamps make representations that were\nan Important factor In Mr. Lalng-\nStocks' decision to purchase. Mr.\n. Laing-Stocks had said he preferred to\ndeal with a responsible company. He\nwas buying land to sell. He was not\nas much concerned ln the matter as\nif he were to live on'the Jand himself,\nbut he believed that there was a good\nminimum of water for irrigation that\nwould enable him to sell the land. Mr.\nDeschamps evidently, innocently, led\nMr. Lalng-Stocks to believe that there\nwas a considerable body of water in\nthe dry season for irrigation. But the\nwater was not there.\nHls lordship said that he was\nstrengthened in this conclusion by what\noccurred in the sale of the Merry block.\nMr. Lalng-Stocks knew that he could\nhave bought it for $4 on the day before\nand Mr. Deschamps admitted that the\npurchase had something to do with the\nstream. There could be no other explanation except that It was bought to\nsecure control of the stream for Irrigation. . ThiB was corroboration of the\nview that Mr. Deschamps led him to\nbelieve that there was a good quantity\nof water.\nHis lordship believed that this bad\nbeen done Innocently and with no intention of misrepresentation. Mr. Deschamps was of an optimistic temperament and probably said more than he\njnow remembered, while Mr. Laing-\nJStocks was a careful, cautious man. He\nbelieved that Mr. Deschamps' statements had been a deciding factor in\nInducing Mr. Lalng-Stocks to purchase,\nlas the wnter would make it easier to\nsell the land.\n, His opinibn was strengthened by\nwhat happened after the letter was received by the China Creek company\nfrom Mr. Johnson, acting for. Mr. Lalng-\nStocks, It was a characteristic Scotch\nfetter and called a spade a spade. But\nthe company did not indignantly repudiate tbe accusations. Mr. Campbell\naid not call to see Mr. Johnson, but\nappeared to have tried to see Mr.\nLalng-Stocks to see if the matter could\nhot be smoothed over.   An attempt was\nide to find another purchaser and\nthe company finally fell back upon de-\nlending the action.\nThen came the contention that Mr,\nLalng-Stocks bad waived his right to\nseek remedy by paying the note and by\nrailing to promptly inspeot the water\nsupply. Immediately Mr. Laing-Stocks\nhad a report from someone who \u00abad\nvisited the property that caused him\nto suspect there was a possibility of\nanything being wrong he arranged for\nan engineer to go down and measure\nthe water, but owing to an abnormal\nspell of wet weather occurring just\nthen he was prevented from doing so\nfor that season; he had no grounds to\njustify him in, withholding tbe next\npayment coming due In the following\nMarch, as no information could have\nbeen obtained as to tbe minimum flow\nin tbe creek.at tbat season, and tbe\nmaking of that payment was the only\nthing for him to do ln the circumstances, and his doing so was not a\nwaiver or re-affirmation of the arrangement. Mr. Lalng-Stocks did all he pos-#.\nsibly could do, and it was only the ex- j\nceptionally heavy rainfall in the later\nfall of 1057 which prevented him discovering then what he afterwards discovered in 1908.\nAs to the suggestion that Mr. Lalng-\nStocks was down there and the cr\"*ek\nwas .there for blm to see if be wished,\nand measure; in the first place, there\nis the evidence of Mr, Campbell that\nlt is a common thing for these creaks\nto have from BO to '80 times the amcuat\n-of water flowing In them in the spring\nthat there Is in the late summer, so\nhe had no opportunity of judging tne\nminimum flow by inspection In May and\nJune, There was no reason why he\nshould have been expected to determine\nthe flow in the fall of 1906 becaui? t'-e\narrangement was not entered inn until\nthe gpring of 1907, and as for denial'!-\nIng measurements at tbe time of his\npurchase, It Is not usual for farmers cr\nanyone not engaged In some large industry which requires this exact technical knowledge to measure witer; it\nrequires skill beyond that possessed by\nmost people, and also.time and trouble;\nand what the average man would ask\nis Just generally how much watsr is\nIn the creek; one would not e'.pt-ct\nhim to cross-examine tho peop e irom\nwhom he was buying, especially when\nthey were the officers of a company\nof financial responsibility and stanaiJig.\nThese being the facts, I find there\nwere misrepresentations, innocent, but\nat the same time going to the root of\nthe contract and being one of the deciding factors ln bringing about the\nbargain. Therefore Mr. Lalng-Stocks is\nentitled to judgment.\nCosts go with the judgment, hut argument as to the right of the plaintiff\nto recover interest, in view of tbe fact\nthat the misrepresentations were not\nwilful, will be heard this morning.\nAt the morning session Lome A. C.\nCampbell of Rossland gave evidence\nthat he did not take over tne deal. He\nhad just completed the former arrangements and had entered the deal\nafter the plaintiff had protested. Asked\nby Mr. Taylor why he did not repudiate the accusation made In the letter\nsent by A. M. Johnson, solicitor for\nthe plaintiff, witness said that he had\ncome over to Nelson and tried to see\nMr. Stocks, but failed to locate him.\nHe admitted not having seen A. M.\nJohnson, solicitor for the plaintiff, who\nwas in the next office. The deal had\nbeen closed between Mr. Lalng-Stocks\nand Deschamps. Witness admitted that\nthe company had attempted to find another purchaser for the lands after Mr.\nLaing-Stocks had attempted to secure\na cancellation of the agreement. Vvit-\nness disclaimed any Knowledge of\nwater having been taken into consideration at all, but in reply to Mr. Taylor he said that the water record was\nintended Tor domestic and not Irrigation purposes,\nJ. D. Anderson, surveyor and civil\nengineer of Trail nnd Spokane, who\nowns land near the property purchased\nby Mr. Laing-Stocks, swore that irrigation was not necessary. He had taken\nthree tons of potatoes off three-eights\nOf an acre of unlrrigated land.\nMr. Lennie put In tbe titles of tbe\nproperty.\nThis closed the case ror the defense.\nMr. Lennie then addressed the court on\nhealf of tho defendant. He contended\nthat there had been no misrepresentation\nand that the statements of Mr. Deschamps\nwere corroborated by other evidence. Nothing had been said as to the quantity of\nwater available, in tho agreement of May\n22, prepared by Mr. Lalng-Stocks himself,\nnothing was said as to tne water record.\nIf water had been the main conBlseratlon\nIt would have been apeclfled. In 1906 and\n1907 Mr. Lalng-Stocks did nothing to ascertain tho quantity of water, HIb inspection of the property shows that his prime\nconsideration was the land. He did not\nexamine the creek but heard the roar of\nthe water and was satisfied. If water\nwere the prime consideration he would\nhave examined the creek and the\nmeans of distributing the water, He could\nnot have thougjff tbat he was buying Irrigated land for 420 an acre. Mr. Laim*-\nSlocks did not.mention to Mr. Descliamps\nthat Stewart had said there was plenty\nof water for Irrigation, as he would have\ndone If that had been Mr. Stewart's guarantee. He submitted that tho onus of\nmisrepresentation had not been established. Mr. Campbell hnd been the llrst to\nEoint out the existence of the water record\nut. nothing was said regarding quantity,\nMr. Laing-Stocks know that the maximum\nflow of a creek was much larger than the\nminimum flow. By taking no action when\nho learned of the water shortage and by\nsubsequently paying tho note Mr. Laing-\nStocks had waived his right of recovery\nand cannot now seek a remedy. Whatever\nmight have boon said ragnrding the water\nIn the creek was In any case only an expression of opinion anil not a statement\nof fact.\nMr. Taylor for tho plaintiff contended\nthat there had been false representation.\nMr. Deschamps must hnve known that the\nstatements were misleading. Mr, Lalng-\nStocks' evidence had been straightforward\nand frank and Mr. Deschamps had tried\nto evaile questions. Why did not Mr,\nDeschamps repudiate tho accusations\nIn Mr. Johnson's letter? He did not do\nso until he came Into court. Defendants\nhad staked water rights yet contended that\nirrigation was not necessary. Mr. Campbell had replied to Mr. Johnson that the\nwater was staked for agricultural purposes\nbut he now said lt was for domestic pur-\n(Continued On Page Five.)\nWRONOPLACE\nShould Go to British Columbia, Not Prairies\nLORD NORTHCLIFFE'S VIEW\nMEN FROM HOP AND FRUIT DISTRICTS OF ENGLAND WOULD\nBE INVALUABLE IN BRITISH\nCOLUMBIA\u2014TO TRAMPLE ON\nACT OF UNION\nLONDON, Dec. 16.\u2014A lengthy Interview with Lord Northcliffe appears\nin Illustrated Canada today. His lordship says that on his recent visit to\nCanada he found a distinct prejudice\nagainst Englishmen in the dominion,\ndue almost entirely to the fact that\nEngland in the last 20 yeara has made\nCanada the dumping ground Cor the\nsurplus cockney. Tbe prejudice, he\nsays, deters a great many people from\ngoing to Canada to reside and Invest\nthere. The fault, he added, was a little on the side of the Canadian immigration authorities. He bad found\nyoung men from the bop and fruitgrowing districts of Kent and Worcestershire on the prairie, wlio, with their\nknowledge, would have 'been invaluable\nto British Columbia. American emigration authorities were much wiser,\nhe said. They put tbe right men in\nthe right places.\nRegarding naval defense, Lord\nNorthcliffe did not believe that the\naverage Canadian knows anything\nabout the dangers of his overseas\ntrade. \"Thousands in Canada have\nnever seen sea ftt all and are never\nlikely to,\" he said. \"I found people in\nVancouver who had seen warships and\nthose in the maritime provinces anxious, but the fact that the whole of\nCanada's export oversea trade could be\nheld up by one or two modern fast\nforeign cruisers is quite unknown to\nthe people who are extremely busy getting their country into shape for residence and trade.\"\nRegarding his criticisms of Canada's\nstate-owned railway, Lord Northcliffe\nsaid he had received scores of letters\nthanking him for his plain English.\nLONDON, Dec 16.\u2014Ireland Is warming up with Celtic fevor rapidly over-\nthe elections. John Redmond, speaking in Dublin last night, was in the\nhighest spirits, though what moderate\nMr. Asquith was thinking as he reads\nthe Irish leader's words Is quite another question. Edward Hlake and his expressions of\nsympathy with his old colleagues in\nthe present great struggle.\nSome indication of difficulties Mr.\nRedmond has to face within the nationalist party is given by a fierce attack on him by the Sinn Fenn, which\nsays: \"By Mr, Redmond's resolution\nthe United Irish league unreservedly\naccepts the liberal program and declares that consideration of home rule\nmust be deferred until the English liberal and socialist parties have altered\nthe English constitution, as It has existed since 1688. It associates home\nrule definitely with opposition to one\nof the two great English parties, and\nabandons even a pretence of the Irish\nparty acting as an Independent factor\nIn the English parliament and accepts\ntbe budget which Imposes a new\n12,000,000 of taxes on Ireland.\"\nIn the unionist press the whole affair is frankly labelled as an Asquith\nbribe. Dec. 1G\u2014 News of massacres\nby Solomon Islanders because they objected\nto marriages of their women with white\nmen, was brought by the R. M. S.\nAorangl, which reached port this morning\nfrom the Antipodes.\nShortly before the Aorangl left sul'va FIJI\nIsland, on Nov. 20, news was brought from\nBagn. Solomon Islands, of the massacre\nof Joseph Blniskln, his wife and iwo\nchildren and several native servants by\nhunters led by a notorious chief named\nSUo, who made a vow lo exterminate all\nwhite men married to natives and their\noffspring.\nRev, Mr, Nicholson, who went to the\nscene of the massacre of tho Biniskin\nfamily, said the natives completely Bur-\nprised the planter, who was struck down\nwith tomahawks and backed to pieces, A\nnative boy, wlio witnessed the killing,\nswan across a bay to where some natives\nemployed by Blniskln were at work, ami\nword was then sent to T. Martin, a planter, who arrived an hour after the massacre. The sight oa his arrival was shocking, The two golden-haired children, aged\n5 and 9 years, lay one on the verandah,\nthe other on the path. Fifty feet away,\ngashed beyond description, Mrs. Blniskln,\na native woman, murdered, was In the\nwater, her body being washed out by the\nebb. She was overtaken when attempting\nto swim from the island.\nCharges of craeltv against officers of\nthe missionary yacht Jolm Williams were\nbrought from the cook Islands, It was\nalleged that after leavelng Altutakl a\nnative woman stowaway was found secreted, having sought thus to visit friends\nat Barotongn, 140 miles away. The case attracted\nconsiderable attention at the time by\nreason of the amount of damages\nasked, some $14,500 In all, and also because of the circumstances under\nwhlcli the action was brought.\nThe action arose from an accident\nwhich occurred at the Mother Lode\nmine at Greenwood on Aug. 17, 1908.\nAt that time the plaintiff was residing\nnear the mine with his wife and two\nchildren, having been employed as a\ncook there for some time previously.\nA large boring was made In the workings of the defendant's and shots put\nin, 22 of five to nine sticks of dynamite each. No precaution was taken\nexcept the three customary whistles\nfor warning. Tbe result in the Dimmick home was the death of one child\nand the Injury for life of Mrs. Dimmick, an arm and both legs being\nbroken.\nOn the above grounds J. H, Dimmick, the plaintiff, sought to recover\ndamages as follows: Special damages, particularized, $2,500; for present and future loss of wife's services,\n$4,000; for pain and suffering, and\npresent and future disability, $8,000, a\ntotal of $14,500.\nMr. Justice Martin's judgment is as\nfollows:\n\"After much reflection I have\nreached the conclusion that I must And\nthe facts in favor of the plaintiff and\nlikewise determine the legal issueB.\n\"I assess the damages to the wife\nat $4,500. She has undergone very\ngreat physical pain and suffering, and\n\u2022has sustained permanent injury In addition to the shortening of her stature.\nThe damages to tbe husband resulting\nfrom the injury to the wife I assess at\n$2,600.\n\"With respect to the husband's claim\nfor special damage the item of $600\nshould be reduced to $250, and in default of any definite evidence the fees\nof Dr. Spankle must be taken at the\nminimum, viz., $250. The other items\nI see no good reason for disallowing.\n\"Let judgment he entered in accordance with the foregoing.\"\nFrom a perusal of the judgment,\nhaving in view tho amounts sued for,\nIt will be soon that Mr, and Mrs. Dimmick have secured $7,000 out of $12,000\nclaimed for the Injuries sustained hy\nthe latter and her disablement for\nlife and a portion of Ihe $2,500 special\ndamages asked for. This In one Instance Is reduced by $360, from $600\nto $250, and there is* also a further reduction, although the amount of It is\nnot stated, in connection with Dr.\nSpankie's services,\nTAXATION UPON MINES\nSUBJECT  DISCUSSED AT  CONVENTION   IN  THIS  CITY.\nTHOSE PRESENT NOT IN FAVOR OF\nANY CHANGE.\nA considerable portion of the time\nof tbe afternoon session of Thursday's\nmining convention was taken up\nwith a discussion of the question of\ntaxation of mining properties, the subject being introduced by the following\nresolution, moved by J. C. Harris of\nNew Denver, seconded by G. O.\nBuchanan, lead bounty commissioner:\nThat as, in the opinion of this meeting, the present, method of taxing mining properties is unjust and tends to\nkeep owners ol' such property from\noperating their holdings, therefore, tbe\ngovernment of British Columbia be\nasked to reconsider the question of\nmining taxation and, if necessary, to\nappoint a royal commission to try to\ndevise some more scientific and workable system.\nIn support of his resolution Mr. Harris said that ho had lived In the country many years, and while not directly\ninterested in mining he was indirectly, being a rancher dependent upon the\nsale of his produce to those engaged\nin mining. Under the present system\nof taxutlon a g-*>od claim and a. poor\none paid the same taxes. EviSn If a\nmine were losing money the government still collected Ihe 2 per cent tax\non its output. This was an injustice.\nIf a mine was producing $100,000 per\nlyear, but just breaking even the 2 per\ncent tax, amounting to $2,000, would\nmean just that amount of less on operation for the year, while an adjoining\nproperty producing the same amount,\nhut making a profit ot $60,000, would\npay exactly the same'amount In taxes\nand would be left with $48,000 profit.\nIt would ibe better to put on an assessor and tax on output, less the\ncost of labor in extracting the ore.\nThis would not affect mines that were\nclosed down.\nMr. Buchanan, in seconding the motion, said he did so ln order that the\nmatter might regularly come before\nthe meeting. This question had been\ndiscussed several times in the past\nand the associated boards of trade had\npassed upon it, dealing particularly\nwith the taxation of properties which\nwere closed down. Since then many\nother properties had suspended. It\n(was not in the interest of the owners\nor stockholders or of the public that\nthese properties should be left idle. It\nseemed to him that a limit should be\nplaced upon tbe time that a mine\nmight be closed down. He was not\npreaching confiscation, but he felt that\nidle properties should be so taxed that\ntheir owners would either have to\nwork them or allow them tb* be sold\nfor taxes, thus putting them on the\nmarket again for purchase by those\nwho rwould work them. In New Zealand, where the mines were all hefld\nunder lease, there was a provision of\nthis kind.\nW. H. Alderldge said he understood\nthat the government had in mind some\nchanges in taxation, not only on mining properties but also on timber\nlands, etc. The present system was\nhardly fair to a company such as lie\nrepresented, for It was taxed twice, on\nits mines and en its smelter. The government might decide to tax not only\nclaims and mines, but also all mining\nplants and other such property connected with them. It might be all right\nto pass a general resolution on this\nsubject, but there was the possibility\nthat any new system of taxation introduced might be worse than the\npresent one, from the standpoint of\nthe industry,\nE. Jacobs said he had some information which might be interesting. In\n1904 a mining convention had been\nheld In Victoria at which this question\nof taxation had been mast thoroughly\ndiscussed and a delegation had approached the government upon the\nmatter. The reply of the government\nhad been to ask for a substitute which\nwould he satisfactory to the mining\ninterests nnd at the same time provide the funds necessary for the carrying en of the affairs of the province.\nThe committee which hnd the matter\nJn charge had been unable to suggest\na substitute and so no change had\nbeen made. In the country from\nwhich he came there were no crown\ngrants of mining properties, but all\nsuch were held under lease. When a\nproperty had not been worked for a\ncertain time, without permission having been granted by the minister ot\nmining for its continued inoperatlon,\nthe lease reverted to the government.\nHere, however, the situation was different. The properties were crown\ngrants. To confiscate them would\nmean the destruction of the confidence\nIn the investing world in the country\nand thus prevent the advent ofl capital\nwhlcli was so necessary at this stage\nof tbe province's development. The\nonly mining men In the province who\nclaimed an injustice wag being done\nthem were the placer men, wlio complained that they could not secure\ncrown grants of their properties, but\ncould only hold them under lease.\nHow, he would like to know, could tlie\nvalue of :i mining property be determined. A mine might be considered\nof high value one day and >the next\nbarren rock might ihe struck and ils\nvalue would ho gone. Under existing\nconditions it would hardly lie practical\nto introduce tho lease system in this\nprovince, and there were few who\nwould say to tax plants, the same as\na smelter was taxed. Either the present system of taxation must he continued, or alt property on the surface\nmust ho assessed, or some other sort\nof tax paid.\nMr. Harris, In closing the debate,\nsaid that he was glad of the testimony\nof Mr. Jacobs. There were two systems of assessing property which\nmight he adopted. Either the owner\nshould be required to place a price\nupon his property for assessment purposes, which he would have to accept\nif anyone offered him that amount for\nthe property, or an assessor should be\nappointed to value the properties and\nthe owner could take his choice as to\nwhether he would value his own property or whether he would let the assessor do it. Silveton, Slocan, Sandon\nand other places had been disastrously\naffected by the closing down of mines\nin their vicinity. There should be\nsome means provided that would make\nit necessary to operate mining properties *by those who owned them.\nA. D, Wheeler said that after 25\nyears' experience in this country ho\ncould say that when a mine was shut\ndown if wns because it could not be\noperated at a profit.\nOn motion of James Anderson, seconded by H. Giegerlch, the resolution\nof Mr. Harris was given the six\nmonths' hoist.\nS. S. fowler moved, seconded by A.\nD. Wheeler, a hearty vole of thanks to\nthe president of the Nelson board of\ntrade for having called to the convention nml to the board of trade for the\nuse of Its rooms and for the courtesies\nand the hearty welcome extended to\nthe delegates. The -collapse occurred suddenly and at a moment when the doctors seemingly had\nthe greatest hope for hte recovery.\nThroughout yerfterday bulletins issued from the sick room indicated progressive Improvement. The bulletin\nposted at 6:30 p. m. gave the king's\ntemperature, pulse and respiration as\npractically normal. Apparently tho\ndrainage of the wound was perfect, as\nno fever was present, and during the\nday the king had been able to take\nnourishment.\nThe public at large was satisfied\nthat the king was on the road to recovery, bnt within the pavilion, where\nthe king lay, there was a feeling of\nanxiety, chiefly because of King Leopold's great age. After a wakeful day\nthe patient was able to sleep for a\nbrief period early in the evening, and\nthe night, passed quietly until 2 o'clock,\nwfcen alarming symptoms appeared.\nSuddenly the king turned and called\nto Dr. Thlriar: \"Doctor, I am suffocating.\" Dr. Depage was summoned,\nand the two physicians did everything\npossfble to prolong life .without avail.\nThe end came quickly and after a spell\nof weakness, peacefully. Prince Albert arrived at the death bed albout 25\nminutes later. He was accompanied\nby Princess Clementine. Prince Albert\nkissed the dead king and left the\nchamber weeping.\nIt appears that the doctors wero\ntotally unprepared for such a fatal termination. It was a nun, acting as\nnurse, who flrst noticed the heavy\nbreathing of the king. She called Dr.\nThlriar to the bedside. Both Doctors\nThlriar and Depage resorted to Injections of morphine, but this had no effect, and shortly after the end came.\nBRUSSELS, Dec 16.\u2014One of the\nmost powerful men in Belgium, who has\nknown King Leopold better than any\nman. is Senator Winer, the king's trusted friend and confidential legal adviser.\nHe assisted in the Congo project\nand probably will handle the disposition\nof the kings fortune, and his tace\nbeamed with good nature as he talked\nrapidly about the king and the Congo.\nHe insisted that Leopold was greatly\nmisunderstood.\nThe senator snid: \"The king was a\nslave to work and business. McMORRIS   Manager\nLATE KING LEOPOLD.\nThe death or King Leopold of Belgium removes one of the most remarkable men of contemporaneous times.\nDuring Ills reign, which extended a tew\ndays over 44 years, lie did much to advance Belgian interests, his most important move in tills direction being the\nestablishment of the Congo Free State.\nThis, however, was only one instance\nof his efforts to extend Belgian in-\nIluence abroad. Previous to his coming\nto the throne he had traveled extensively and, good business man that lie\nwas, saw that the prosperity of his\ncountry depended upon the development of Us foreign trade. To this end\nall his efforts were directed and Bel-\nglum und the Belgians have benefited\nimmensely as a result. But, while Leopold was assisting his country in this\nway, he was also looking out for his\nown private interests with the result\nthat he was, it was generally admitted,\ntlie richest monarch in Europe In hls\nown right. Whether Intentionally or\nnot, he was setting them an example.\nWhile doing much tor his country\nin the way of developing its trade, he\nwas also giving lt sound constitutional\ngovernment, as such fs understood by\nBelgians, and, as a result, always got\non well with his people, although perhaps he never became a popular idol\nwith them as monarchs sometimes do\nwith their subjects. His private life\nand his relations with his family were\nnot such as could be expected *to win\nlilm respect at home, while it; was the\ncause ol strong denunciation abroad.\nWith his children, two daughters, his\nonly son having died an infant, he was\na hard man. It may have been that\nliis daughters erred In a grent many\nways, but King Leopold in his treatment of them showed himself anything\nbut a loving and forgiving father.\nAnother thing concerning which fault\nhas been found with the late king was\nthe rimnner in which the nffuirs of\nCongo Free State have been managed\nAs the head of the Congo Free State\nhe has been held responsible lor all\nthe atrocities which have been inlilcted\nupon the natives from time to time ln\ntlie endeavor to make money out of\ntheir labor. The chief complaint\nagainst him was that he failed to take\nadequate means to stop the atrocities\nwhen they were drawn to his attention.\nWhatever may be said for or against\nthe late king ta connection with\"7!mi\nmatter there can be no possible excuse urged tor the atrocities themselves.\nThrough King Leopold's death tin\nCongo Free State will become a le-\npendency of Belgium, provided th_\npeople of that country agree to accept\nthe responsibility of governing It. '\"p\nto the present the Orange Free State,\nwlille lu reality under Belgian control,\nhas been nominally an independent\ncountry, governed for -the sole purpiso\nof mnklng money out of It, ;li3 late\nKing Leopold being at the head of the\norganization which controlled it. C, Dec. 16;\u2014On Tuesday afternoon at 2 o'clock one J. Clark\nwaa \"charged before J. K. Johnson,\ncounty magistrate, with being a vagrant. The witnesses were Provincial\nConstable Jensen, Miss Alice M. Opie,\nschool teacher, at Alice Siding; Victor\nCarr, schdol trustee at Alice Siding,\nand Clarence Pease, a boy of 14.\nSomeone had last uSnday night\nbroken into the school house at Alice\nSiding and broke up the furniture tor\nfirewood. Many little articles In the\nschool were also found missing and the\naccused In this case was suspected aa\nhaving been the one who broke into\nthe school house. The evidence showed\nthat the accused last Sunday morning\ncalled at the home of Victor Carr, at\nAlice Siding, three miles from Creston,\nand had asked for something to eat.\nHe was furnished with food and left at\nonce. A man's tracks were laiter on\ntraced from Mr. Carr's house to tlie\nschool house. Much other damaging\nevidence was given and the charge of\nvagrancy was sustained and the accused was sentenced to six months at\nhard labor in the common gaol at Nelson. Constable Jensen made a very\nclever arrest in this case. Having received word on Monday morning that\nAlice Siding school had been broken\nInto, Constable Jensen at once set to\nwork on the case and left the same\nday by the afternoon train for Kootenay Landing. Arriving there he found\nthat a man answering the description\nof the man he was looking for had been\nthere but had gone to Sirdar, having\nfailed to catch the barge to Nelson.\nMr, Jensen went on to Sirdar and found\nhis man walking on the track. Jensen\nthen recognized him as the same man\nwhom he had given a bed to In the\nCreston police station when lie, along\nwith a couple of other man, had been\nturned out of the hotel.
