This wns a\ncase in which the appellants, tbe Le\nRoi Mining Co., appealed against tho\nassessment of the assessor, John\nKir Imp, in 1000 alleging that the\nvalue placed bn the ore, $13 50 per\nton, wus too big and that not sufficient\ndeductions were made for the freight\nand tieiitmenl charges.\nThe smelter at Northport vns\nerected by the Le Roi Mining and\nSmelting Oo,, a Washington corpora'\ntion, and tho Lo Roi company entored\ninto a contract with the Red Mountain and the Spokane Falls and\nNorthern railway companies to trans-\npoit its ore from its mine in Rossland\nto the smelter at Northport for a\nperiod of Ave years at tbe rato of 75\ncerts por ton\nOn Mny 38, 1807, the Le Roi Mining\nand Smelting: company agreed to erect\na ameltar at, Northport and further\nagreed wi'hi James Breed to supply\nhim with oto, which he agreed to\nsmelt for $10 por ton, and also to\ntransfer to Mr. Ilreen a quarter interest in the smelter. On January 13,\n1609, the Lo Roi Mining and Smelting\ncompany agreed to transfer ah its\ninterests to tne Northport Mining and\nSmelting company, a Washington\ncorporation. . May no Daly, Ihe attorney\nfor tbe Lo Roi Mining Co., in his\nevidence, said that subject to . the $10\npor ton agreement, the Northport\nMining and Smelting oompanv was at\nthe time of the trial owners of alt the\ninterest in tho smelter at Northport.\nTho evidence of Edw in Durunt went\nto show that the shares of tno North\nport Mining and Smelting company\nwith the exception of the qualification\nshare held by the dir odors, were held\nby the Le Roi Co.\nIt was agreed by appellants and\nrespondent that tbe tonnage of ore\ndelivered foi the quarter ending June\n30, 1000, was 38,1-05 tons. Assessor\nKirkup valued this ut $13.50 per ton\nor a total of $521,977.50, but by his\nevidence this was hearsay, and based\non a letter received as to the provious\nyear's producton.\nMr. Keen finally decided that $0\ninstead of $10 per ton was a fair\ncharge for freight and treatment of\nthe ore. He was further of thu\nopinion that the contract entered into\nwith Ilreen for a $10 rate becamo void,\nwhen it was assigned, for a personal\ncontract cannot be assigned and enforced. He farther held that the contract had been broken by the Le Roi\ncompany shipping a portion of its ore\nto Trail instoad of all to Northport\nM provided for iu the eoMruet. This is an\naction by Fletcher S.Andrews.of Win-\nnip\u00b0g, against Frank Fletcher, of this\ncity, for a trustees accounting of all\ntransactions in connection with the\ntownsito of Slocan City, in which the\nplaintiff claims to be the owner of\nclose upon a one-twelfth interest.\nTbe case is interesting in that the\npapers filed in connection with it\nshow that the owners of the Slocan\nCity townsito made considerable\nmoney out of it, close upon $23,000\nhaving been distributed among them\nin the way of dividends.\nIn liia statement of claim the plain\ntiff alleges that under an agreement\ntbe defendant agreed to account and\npay to bim his proportion of tho purchase money of lots sold as well as\nhis proportion of money from lots\nwhich thereafter were sold. All the\nmembers of tbe council were present\nexcept Alderman Morrison. The letter\nwas read by City Cleric Strachan as\nfollows:\nTo\"the mayor and oity council,\u2014\n1 big to make the following proposition: If you will grant to mo the\nfollowing piivileges, that is to say:\n(1) The parcel of land tbat the city\nengineer and myself looked at yesterday, lying near the falls on Cottonwood creek as a mill site; (2) Whatever water the city does not require\nfor operating itselectiic light plant;\n(:t) Exemption from municipal taxes\nfor 20yeais,\nI will agiee to build and operate a\nHour mill and elevator. Tho mill to\nbe capable of grinding 100 barrels of\nflour on a 24-hour ron. I further\nundertake that the mill will be\nequipped with the latest and be?t\nmachinery on the market now and,\nwilt be second to none in western\nCanada. There is\nfrom six to 10 inches of mineral in\nthe breast, it is gradually widening\nand it is thought it will inrease to the\nfull width ol the same lend in the\nworkings nearer tne Mir luce.
