Young.\nhis lordship's charge\nHis Lordship, addressing the Urand\nJury, aaid there were two charges to\nbe beard. They had a certain part to\nplay iu the prosecution of justice and\nwere there as a butler between the\nCrown and the accused. Their law\nplaced round tbe man accused a gocd\nmany safeguards. lu the lirst place\nhe had a preliminary bearing before a\nmagistrate. That, the law did not\nconsider enough and the grand jury\nwere called upon to go iuto the whole\n{nets. They only beard the witnesses\nfor the Crown aud the question they\nhad to ask was, had the Crown made\nout a sufficiently good case to call\nupon tbe defence? They bad beard\nthe expression that in a criminal case\nthe accused always had the benelit of\nthe doubt. To tbe grand jury he\nwould reverse the principle and say\nthey should give the benelit of tbe\ndoubt to the Crown, so that the matter might be fully threshed out before\nthe petty jury. In that connection\ntbey might consider whether the time\nhad not arrived when the grand jury\nmight not be done away with. To\nhim it seemed to be rather a waste of\npublic money and tbeir time where a\npreliminary investigation was gone\ninto. Onthe Friday Ursetti was\nat Julian's house. He went out to tbe\nnext house and on returning he was\nattacked by two men whom be leoog-\nuised in the prisoners. One held him\nand the other cut bis throat with a\nrazur. Mike Julian recognised tbe\ntwo prisoners as the men running\naway.\nWitnesses were ordered out ol\nCourt.\nF. Orsetti, examined hy Mr. Scott,\nrepeated the evidence given at the\npreliminary enquiry and which was\nfully published bv us at the time.\nCross-examined by Mi. McCarter:\u2014\nRomeo is higher than Sheldo by eight\ninches. (Prisoners bere stood up,\nshowing hbight of both men to be the\nsame). The men could have killed\nbim if they wanted to. Had uo previous quarrel with tbem.- W.is light\nwhen this happened, BiV-At half-past\nnine o'clock. Saw the men when he-\nwas at freight shed aud theu saw\nthem walking about eix times past\nthe house where he lived. When he\nwent into the housj he toid thein the\nSicilian (meaning Sheldo) had cut\nhim.\nCross-examined by Mr. Gillan: Rumen was the one who caught me. It\nwas a taller man than Sheldo thai\ncaught him and held me. Am positive oue went without a hat. They\ndid not ruu by Gallicano's. San-\nMike Julian at gate when 1 hollered.\nWaa ten or twelve feet from the gate\nwhen they attacked me. Old mini\nJulian, bis wife, Mrs. Demore, May\nCasbato and my brother were in the\nbouse at the time. They all came out\nwhen I hollered. Romeo had razor in\nleft baud. For the\nlirst time since the opening of the\nrailway a good understanding has\nbeen arrived at, and it will be to\nthe advantage of both. The city\nwill have the support and co-operation of tbe C.I'.R. both in regard\nto the power plant and the operation of tlie shops here on an improved and extended basis wbicli\nwill cover tho whole of llie repair\nwork on the Mountain and Shuswap division. This involves the\naddition of new machinery to\nhandle the larger engines now in\nuse on the division, and the fact\nlhat the company have undertaken\nIn have the shops placed on a full\noperating basis within a year will\nmean much to llevelstake.
