Copper Company's\n-     Men Out\nRECOGNITION OF THE UNION\nTHI8 AND NO DISCRIMINATION\nARE THE MATTERS IN DIS-\nPU1\u00a3\u2014 LEMIEUX ACT ARBITRATION DID NOT RESULT IN A\nSETTLEMENT\n(Special to The Daily News.)\nGRAND FORKS, June 28\u2014The arbitration board which eat at Greenwood lately in regard to the disagreement between the B. C. Copper company and the Greenwood Miners' union\nnot having come to a satisfactory settlement, rue union has declared a strike\nand tonight posted the following notice\nln this city. Tills is signed by the\nstrike committee and -hears the seal of\nthe union: \"otrike workmen stay away\nfrom Greenwood. Greenwood Miners'\nunion No. 22, Western Federation ot\nMiners, have declared a strike against\nthe mines and smelter of the British\nColumbia Copper company for the recognition of Greenwood Miners' union\nand for discrimination against its members.\n\"On June 1, U07 Greenwood Miners'\nunion and the manager of the B.C. Cop-\npet1 -company adopted a wage scale to\nbe paid the employees of, the B. C.\nCopper company at their mines and\nsmelter. In May, 1908 the manager of\nthe B. C. Copper company reduced the\nwages of his employees and from tha'\n, time to the present time has refused to\nsubmit a copy of the scale of wages he\nis paying his employees to Greenwood\n' Miners' union and he has tried to disrupt Greenwood Miners' union' by blacklisting our active members. The properties ot the B. C. Copper company\nare closed down at present and we intend to keep them closed down luttiU\nthe management recognizes Greenwood\nMiners' union. At least 90 per cent\nof the employees of the B. C, Copper\nbefore it closed down were members of\nGreenwood Miners' union. The strike\ncommittee will notify the public through\nthe press when the strike is called off.\nthe B. c. Copper company operates\nthe smeuer at Greenwood and tlie\nMother ^ode and Oro Denoro mines in\nthat neighborhood. Both the mines and'\nsmelter which have up to the present\ntime been run on the open shop principle, are at preheat closed down as a\nresult of a shuitage of coke, due to tihe\n' strike of the coal miners ln eastern\nBritish Columbia and western Alberta.\nThis Btrike is now well on its way to\na settlement and within a short time\nalter the resumption of] operations in\nthe coal mines the B.C. Copper company would have been In a position to\nstart up its smelter again and with it\nits mines. Ws, however, the calling\nof the strike Is likely to-prevent, unless a settlement is arrived at shortly.\nThe coal strike commenced on April\n1, but the copper company had enough\nfuel on nand to last It for about ona\n.month, so that the smelter was no\\t\nclosed until about May 1. About the\ntime of the closedown the Greenwood\nMiners' union applied for a board o't\narbitration, its demands ibeing as follows:\n1. Tnat the management of the B.C.\nCopper company recognize a committee\nfrom Greenwood Miners' union No. 22\nW.-...*., to adjust all grievances between the B. C. Copper company and\nits employees.\n2. That the B. G. Copper company\ncease discriminating against members\nof Greenwood Miners' union No. 22,\nW.F.M.\n3. That tne B.C. Copper company\nreinstate J. B. King and T. Y. McKay\nin their employment and pay the said\nJ. B. King and T. Y. McKay their wages\nin full from the time of their dismissal until such time as they are reinstated.\n4. That the B.C. Copper company\nshall not discriminate against men on\naccount of their political opinions.\nThat the B.C. Copper company shall\nnot alter the existing conditions of employment of t.helr employees without\nnotifying the president or secretary of\nGreenwood Miners No. 22, W.F.M. and\nall notifications shall ibe ln writing.\n6. That the management of the B.C.\nCopper company, or any ol) its officials\nshall not use any Influence or ln any\nway Interfere with their employees lh\ntheir choice of doctor or doctors.\n. .. 'that the management of the B.C.\nCopper company cease soliciting the\nboard of trade and certain individuals,\nfor the purpose of discrediting Greenwood Miners' union, No. 22 W.F.M.\nThe dominion department of, labor\ngranted a board of conciliation under\nthe Lemieux act, judge P. B. Wilson of\nCranbrook being the . cfoalrntfin, and\nMward Cronyn ot Toronto and John\nMclnnls, M.P.P., of Grand Forks being\nthe representatives of the company and\nmen respectively. The finding ot the\nchairman and the company's representative' -was against the men, although the\nlormer favored recognition of the union,\nVlhrough both parties to the dispute getting together, while that of. Mr. Mclnnls\nwas in their favor. The chairman offered a basis upon which he thought the\ncompany and men could come together.\nIt was as follows:\n\"1. That the union eliminate any\npractice of discrimination as against\nnon-union men.\n\"2. That upon the cessation of suc'h\nprocedure the company recognize and\ndeal -with the union ln regard to questions affecting union men.\n\"3. That no discrimination be shown\nagainst any person by reason of his\ntaking and active part lh the union,\n\"The whole industrial situation in\nthis camp Ib unfortunate. A feeling of\ndistrust pervades the whole atmosphere\nand so long as that feeling continues\nso long will trouble continue. Unless\nsome feeling can arise which will tend\nto a belief by each party in human nature, even if the party Is of the opposite side, no cessation of the present\ntrouble can be contemplated. If the\nemployer will fairly recognize fair\nunion1 labor and the union will fairly\ndeal wth the employer, then troouble\nwill cease; otherwise it will continue\nforever,\"\nThe union rejected the majority report and accepted the minority one of\nMr Mclnnls and following this decision\nn strike has been declared. The Daily\nNews yesterday wired George Heather-\nton, secretary of the Greenwood union,\nasking whether a strike had been declared and his reply read as follows:\n\"Greenwood, June 28, 1909.\n\"Nelson Dally News, Nelson, B.C.\n\"Yes; for recognition of the unloji\nand refusing to give us a scale of\nwages paid employees.\n\"GEO. The old\n6 horse power motor which operated\nthe crustier was replaced by a new 150\nhorse power motor, snipping from\nNo. 2 will be resumed in a dary or two.\nrne Argo Mining company has heen\ngranted a charter and will shortly put\nstock on the market. The company is\ndriving a tunnel at Greenwood to tap\nthe high grade teads at depth. The\ntunnel which is 6x8 feet is now In over\n100 feet, a force of nine men being employed. It Is expected that the first\nlead oG silver gold ore will be struck\nat 600 feet.\nJ. L. Martin Is about to let a contract\nfor a 200 foot tunnel on tue Rio Tinto\ngrup, suth of Phoenix. The Rio Tinto\ngroup includes seven different claims\non which a great deal of development\nhas already been done,\nH. B. iWalkem, engineer In charge of\nthe surveying for the C.P.R. branch\nfrom Phoenix south to Central camp,\nwas in town yesterday and states that\nthe survey will be completed (or the\n12 miles In about, two weekB. The\nroute wltl require the construction of\nconsiderable trestle work to cross the\ngulches. One bridge will be 200 feet\nlong and some 160 feet high.\nProspects on the west fork of the\nKettle river appear to-be taking a new\nlease of lire, many experts have visited\ndifferent properties which has resulted\nin several options being taken, the\nBelle and Dayton being among the recent claim secured. An effort hns also\nbeen made by one of the local companies to secure the Le Roi near Bride-\nviile.\nChief constabie Bunbury and constables Docksteader, Dlnsmore and\nAlexander left early this morning to patrol the .boundary line west of Midway\nand scour the country in the vicinity in\nsearch of the bandits who held up the\ntrain near Ducks last Tuesday. FOURNIER'S CASE\nThe papers of eastern Canada aro\ntaking up finite generally the case of\nMr. Jules Fournler, editor of Le Na-\nttonallste of Montreal, who was sent\nto jail for three months for contempt of\ncourt, because he had the temerity to\nexpress in his paper what most other\npeople who knew anything about the\nmatter thought concerning a bank forgery case recently tried at Levis, Que.\nMr, Fournier's charge was practically\ntnat this case was hushed up by those\ncharged with the administration of\njustice because of the prominence of\nsome of the people alleged to be implicated.\nMr. Fournier's charge. It Is true, was\na grave one and deserved the ful-est\ninvestigation. Instead of this Mr. Fournler waa hailed before sir Francois\nLangellei-, a justice of tne superior\ncourt, on a charge of contempt of court\nand, being found guilty, was sentencad\nto three months in jail without the option of a fine He was lodged with tho\nordinary offenders undergoing sentence,\nbeing forced to wear the regulation Jail\nuniform und generally being treated as\nwould be a criminal of the lowest type.\nIt may Ibe noted that Mr. (Fournler had\nno option of trial by Jury. He was accused of libelling the bench and was\nbrought betore a member of the bench\nand tried and condemned.\nThere is no question but that Mr.\nFournler may have been hasty in what\nhe said, for he is an impulsive young\nman, without any great experience in\njournalism or familiarity with the pitfalls which beset the path of an editor, especially in a province where the\nmembers of ihe bench appear to be particularly touchy on the question of their\ndignity. But, granting tnis, the course\npursued by the bench in dealing with\nhim smacks of tyranny. This fact is\nrecognized by papers of all shades of\npolitics and thought and there is a\ngeneral condemnation of the manner in\nwnich this young man lias been treat;\ned\nAs a result of the agitation that the\npapers have aroused there Ib some pro-\nspect of securing Mr. Fournler his freedom. In the meantime.Blr LomerGouln,\npremier and attorney general of Quebec, has announced that he is Investigating tiie charges mode by Le Nation*\naliste. Should his investigation show\nthat Mr. Fournier's charges were justified a nice situation will he created\nMr. Fournler will have been punished\nfor having done a public service. In\nany case, however, It will be generally\nagreed, lie has been the victim of a\nJuuge's ideu of the sanctity of the\nbench as opposed to ordinary common\nsense.\nOrdinarily, it will .be generally agreed,\nthe bench should be above criticism.\nTills, however, should not be taken to\nmean that any and every action of a\nmember of the bench is above criticism,\nJulges are only human and it is possible for them to err. To say tliat a\njudge might do anything he wished\nwhile sitting on the bench and tliat\nany and all criticism of his actions\nwould be contempt .ot court would ha\nputting the liberty of the subject In a\nnew light. This, however, is pretty\nnearly, if not exactly, tbe situation in\nregard lo the case of young Mr. Fournler.\nEDITORIAL NOTE\nAll tliat is now required to make the\nDominion day celebration a success is\nthe weather. Surely the weather man\nwill be kind.\nDispatches my that Mr. Hugh X>.\nLumsden lias resigned his position as\nchief engineer of the National Transcontinental railway. The explanation of\nhis action will bo awaited with interest.\nFrom the country's standpoint it is\ntoo bad that a strike of the employees\nof the IJ C Copper company should crop\nup just as the coal strike was being\nsettled. It is only tne country's great\nnatural resources that enables it to keep\nup in the face of continuous setbacks of\nthis kind.\nThe now Intercolonial commission is\nshowing that It recognizes one of the\nreasons, at least, why the railway has\nnot been a paying proposition in the\npast and has undertaken a wholesale\nreduction In the staff. If the commission goes ahead on these lines and conducts the road on business lines, eliminating the political pull and the graft\nwhich have flourished to the present the Intercolonial will soon be\npaying a fair return on its cost, instead\nof failing to meet operating expenses.\nTiie London Times Is now advocating\nthe appointment of a Canadian board\ntor the Grand Trunk railway. This, it\nwould appear to most people, Is the\nonly sensible course for the company\nto- pursue, but all suggestions along\nthese lines have been frowned down\nby the London board of directors and\nthe English shareuolders. ln the meantime the road continues to show unsatisfactory financial results. A board\non the ground which would be able to\njuuge conditions and act accordingly\nmight not make the road the paying investment the shareholders might desire, but it is pretty safe to say that it\nwould bring better results, at least.
