Neither team displayed what is\naccounted here championship form but\nplay waa hot at times. Wetmlnster's\ndisplayed more life than the challengers, the latter playing in an up and\ndown manner. At times they pressed\ntheir adversaries bard but again they\nplayed In such a manner as to lead the\nspectators to ask whether the affair\nwas a pink tea. Lacrosse experts\nstate that the Reginas showed good\ngeneral combination play, but lacked\nln pressing toward their goal. Their\nchief aim seemed to be to draw Westminster's home out but the Red Shirts\nrefused to bite at the bait. Westminster played its usual all round game\npressing their adversaries hard at\ntimes when they did not get goals.\nThe general impression here is that\nMonday's game will be a duplicate of\ntoday's and will end with leaving the\nMinto cup on the banks of the Fraser.\nThe game was played before a large\ncrowd. The weather was fair though\nslight showers occurred this morning\nand their air was chilly. Before play\nwas called Westminster presented a\nprotest which had been wired previous*\nly claiming that the Reginas were not\nresidents of the home city of the team\nThe game opened with fast play by\nWestminster which was Ineffectual.\nRegina started tactics of trying to\ndraw out their opponents home. Five\npolicemen were wounded In the struggle, In w,iich the workmen had the upper hand until a detachment of mounted policemen galloped up and cleared\nthe streets. The trouble began when\na body of diggers, after having attended a meeting of the building trades\ntnat had voted to keep up the general strike until tbe postmen attained\nsatisfaction, started to march through\nthe streets singing \"The International\" and crying \"Down with Clemen-\nceau.\" When the police attempted to\nIntervene tuey were met with a storm\nof missiles, including stones, glasses\nand chairs snatched up from the nearest cafes. Then the mounted police\nappeared and order was restored.\nWhile the building trades workmen\nat their meeting voted to continue the\nstrike the vote was far from unanimous. Some, of the speakers urged,\nthat tbe trouble be kept up and that\nviolence be used If necessary. As the\nmeeting broke up the conservative\naction shouted \"There is no Btrike, let\nus go back to work.\" The situation\nwas very quiet thlB evening. YVES\nENGLISH   RUNNER    MAKES    FAST\nTIME IN TWENTY MILES\nFRENCHMAN   WAS   FAVORITE   AMONG MONTREAL ENTHU8IAST8\nMONTREAL, May 20\u2014Shrubb won\nthe 20-mile race here today by a lap\nand a quarter In. the fast time of one\nhour, 64 minutes and 25 seconds. St.\nYves finished out the race ln 1.56.24.\nIt was a big surprise, St. Yves being\npractically a 2 to 1 favorite, reports\nthat Shrubb's right leg had gone back\non him since the Longboat race leading most of the experts to believe that\nhe would fade away after the fifteenth\nmile. Shrubb went out Into the lead\nafter the first twenty yards and setting a fast pace, opened a big lead ln\nthe early stages of the race. Preferring a grass course to the third of a\nmile cinder path the runners ran on a\ntrack laid Just Inside the cinder path\nmeasuring 3 1-5 laps to the mile. Just\nbefore the seventh mile was finished\nby Shrubb, he .had gained a lap lead\non the Frenchman. This\nreduction will apply to this district\nand would, Mr. Ruddick understood,\nconsiderably lessen the charges for\nsmall shipments.\nJoint Meeting Only Hope\nDETROIT, May 20\u2014The misunderstanding between the marine unions\nand the lake carriers' association\nwhich have resulted In the late strike\nmight be reconciled If the two parties\nwould agree to a joint conference, Ib\nthe conclusion announced this after\nnoon by the representatives of the\nboards of arbitration from the six of\nthe lake states who have considered\nthe strike situation. The arbitrators\nln the statement said that the union\nrepresent ill ves had expressed a desire\nfor a conference with the carriers, but\nthat there had been no such conference since the Inception of the dispute\nThey also said there was a great variance of construction or understanding\nof the terms and conditions of employment as understood by .the separate\nparties of the controversy. The arbitrators sent a statement today to\nHenry H. Harvey, secretary of the\nhatlonal civic federation, asking the\nco-operation of the federation towards\nbring about a conference between the\ncarriers and \u2022 the men. Oerroals and a little\ndaughter   tf   Napoleon   Valllancourt.\nTOBUILDWEST\nMore American Roads Seek\nPacific Coast\nVANCOUVER THEIR GOAL\nVANDERBILT SYSTEM IS ACQUIRING NEW LINES IN CHAIN\nACROSS CONTINENT\u2014 GREAT\nNORTHERN LAYING TRACK TO\nBURRARD INLET.\nVANCOUVER, May 20\u2014The total\nbank clearings for the week ending May\n22 were $5,030,621, as compared with\n$3,457,152 (or the corresponding week\no( last year. In 1907 the Hgures were\n$3,845,7x3. The record week was that\nending April 22 when the figures were\n5,068,745.\nTomorrow the track laying gang of\nthe Great Northern railway at work\nbuilding the extension from the head\nof False Creek to Burrard Inlet will\nreach tbe point where the line will\ncross tbe tracks of the C. P. R. along\nthe waterfront. The crossing has been\nauthorized by the railway commission.\nMr. J. H. O'Nell, superintendent of the\nCascade division of the Great Northern\nreached here today from Everett on\nbusiness ln connection with the crossing, the diamond for which is all reudy\nto be placed In position.\nHon. R. G. Tatlow, minister of flu\nance, has been in the Spallumclieen\nsnd Salmon Arm country since Monday for the prpose of Investigating the\ndamage caused by the ousn tires that\ndevastated several miles of country st\nthe beginning of this month and of\nrelieving distress where necessary. A\ngood deal of distress has followed ln\nthe wake of the fire which was more\nserious than people at the coast generally realize. Agents of Insurance companies, who have been ln the districts\nconcerned ln order to adjust their\nrisks and have returned, state that in\nthe Silver Creek valley, there Is still\nsome fire smouldering notwithstanding\nthe rains. While great damage was\ndone to mills and farm property tn the\nneighborhood of Enderby and Mara,\nthere are many Instances of remarkable escapes aided by determined fire\nfighting. At one farm in the Silver\nCreek valley a T>arn was destroyed,\nthough there was scarcely any resemblance to bush for half a mile around,\nbut the flames had power to Jump\nover wide sweeps of territory. People\nwere awe struck by the speed at which\nthe flames rushed along the valley.\nThe Chicago and Northwestern, a\nVandorbilt road, whose system embraces a trackage of 0,665 miles, Is\nmaking preparations to Invade the Pacific coast with terminals ot Seattle.\nA branch line, it Is expected, will be\nbuilt to Vancouver later on. The impending move of Mr. Marvin Hughllt,\nchairman of the executive of the road,\nhas long been anticipated by the representatives of rival railway Interests.\nFor a fortnight paBt prominent officials ot the Chicago and St. Paul, Minneapolis and Omaha railway, another\nImportant portion of the Northwestern\nsystem, and constituting 1700 miles of\nits trackage, have been looking over\nthe ground In Montana, Idano and\nWashington. The building of\nmi: 560 miles of railway would give\nthe system access to the Pacific seaboard. HATHEWAY      ON\nFOUR YEARS' ACCOUNTS.\nThe spring assizes in Nelson this\nyear are certain to last until the close\noi' Wednesday, May 26th, at the earli-\ntsc; tney may lust tor a day or two\nlonger.\nThere is. apparently a common im-\nprebslon tnat tne duration of the pie-\nsent assizes is unusual and extraordinary. Tnis is not the case however.\nEven if the present assizes should last\ntill May ma, it would be a 'total of\n26 days, which would <be a shorter\nperiod than that of many assizes ln\ntnis city. Among the very long sittings within recent.years may be recalled the Kail assizes of 19U4 under\nMr. Justice Morrison, and the Fall assizes of 1BU6, under Chief Justic-V\nHunter.\nThe supreme court of British Columbia has sittings in Nelson four times\na year, the assizes in May and October, 'and civil sittings in December\nand February, These lour sittings are\ncertainly not more than sufficient to\ndispose of the legal business originating in Nelson and the district of\nwhich it is the legal and administrative capital.\nOnce, on a memorable occasion, in\nJune, 1905, there was a special sitting\nof tne supreme court in Nelson, presided oyer by Mr. Justice Irving, to\nhear and dispose of an application for\nan injunction, asked for on behalf of\nthe West Kootenay Power and Light\ncompany to restrain the city of Nelson\nand its contractors from placing rock\nin fhe Kootenay river incidentally to\ntne construction of the civic power\nplant at upper Bonnington Falls.\nWhile the duration of the present\nassizes at Nelson is not a matter of\nsurprise to those informed and Ib, in\nfact, to be regularly; expected; there\nIs general regret that It involves postponement and suspense at Rossland\nand at Fernle.\nBoth sessions of the supreme court\nyesterday were taken up with the\nhearing of the case of Paulson vs.\nHatheway, an action for dissolution of\npartnership in respect of lands, and\nfor an accounting In respect of a joint\nownership dating from December, 1904.\nThe pleadings are complicated by the\ntact that ownership on both sides has\nbeen transferred since the original\nagreement was entered into, and also\nby the fact that the original agreement, while referred to on both sides\nof a very voluminous correspondence,\nwas in large part verbal, the written\nreferences not covering the whole\nground.\nWhen court opened yesterday morning the case of Paulson vs. Hatheway\nwas called. S. S. Taylor. K. C, appeared for the plaintiff and R. S.\n'Lennle -or the defendant.\nMr. Taylor, ln opening, explained\nthat the action was the result of a\ndispute over business relations existing since 1904. In December, 1904, the\nplaintiff, Paul A. Paulson, was the\nowner under agreement for sale of lot\n362, group 1, Kootenay, near Kitchener, the former property of the Columbia and Kootenay Railway and Naviga*\ntlon company, amounting to 2,560\nacres, less the right of way of the B.\nC. Southern Railway company, and also, under agreement with the B. C.\nSouthern Railway company, of S13\nacres adjoining.\nAt that time Paulson entered Into\nan agreement with the defendant, W.\nL. Hatheway, by which the latter was\nto acquire a naif interest in the plaintiff's lands by paying to the plaintiff\nall that he had so far paid on account\nof the lands sad all that still remained\nto be paid, this alleged agreement be*\ning partly verbal and partly in writing.\nThe defendant was also by the alleged\nagreement, to pay half of the money\npaid for surveys, labor and all other\nexpenses. It was also agreed that the\nplaintiff was to control and manage\nall such lands. Elaborate plans for\nImprovement were agreed upon, partly verbally and partly in writing. It\nwas also agreed that the ranch should\nbe planted and stocked, the lands\ndrained, cleared and cultivated, the\ncreeks Improved, and all necessary\nbuildings erected, the defendant agreeing to pay half of all such expenditures.\nIt was also agreed, the plaintlfl al*\nleged, that the defendant might at\nany time transfer his title to his wife,\nCarrie h, Hatheway, sister of the plaintiff, and the plaintiff might transfer\nhis title to his daughter, Clara Arney\nPaulson.\nDeeds were made, accordingly to\nCarrie L. Hatheway and Clara A.\nPaulson.\nThe plaintiff alleges that since November, 1905, the defendants in violation of all such * agreements have\nsteadily refused to pay the agreed upon one-half of necessary and agreed\nexpenditures. The total amount paid\nfor such purpose by or on behalf of\nthe defendants amounts to only $2,450.\nwhile the plaintiff has been obliged\nto advance $5,987.85, and since May 13\n1907, the plaintiff has been advancing\nand expending further unstated sums;\nif he had' not done so the previous expenditures would be largely wasted.\nBecause of subsequent quarrels a\npartnership is felt to be impossible for\nUb future. Clara A. Paulson has\ntransferred her title to her father>the\nplaintiff, who now asks that the partnership be wound up and an accounting made.\nThe first witness called was the\nplaintiff, Paul A. Pauison, who deposed that in November, 1904, he met\nin Spokane, the defendant, William\nLee Hatheway, who was married to\nhis, the plaintiff's sister, a ^o-de-\nfendant in the .act|ion, desqrfbed as\nCarrie L. Hatheway. They, the plaintiff anH the defendant, arranged for a\nhunting and fishing trip. Hatheway\nadmired Paulson's ranch and expressed a desire to take a half interest in\nit. Later correspondence showed\nHatheway offering to help Paulson by\na loan If he did not wish to part with\na i\u00bbalf Interest and was doing so only\nbecause of financial stringency.\nFrom that point Mr, Taylor began\nreading and filing correspondence between the parties, which took up the\nremainder of the morning session and\na large part of the afternoon session\nThe plaintiff was still In the witness\nbox hut was allowed to remain seated.\nAs Mr. Taylor waBa filing letters,\nMr. Lennle offered to the court a volume of attested copies, indexed, of\nthe whole correspondence from both\nsides. This was accepted and simplified matters somewhat but Mr. Taylor\nhad to continue reading to get the\npoints he desired 'before the court.\nIn the afternoon an argument between counsel and bench revealed the\nline of defence.\nHis Lordship remarked that from,\nthe correspondence submitted it seemed to be perfectly clear that the parties to the action understood that\nthere was a partnership between\nthem In respect to the lands ln question.\nMr. Lennle explained that the defendants did not dispute the fact that\na partnership in all the lands referred to, aB a permanent Investment,\nwas the original Intention of the parties to the present cause. But sine\nthe transfer to the present owners.\nCarrie L. Hatheway and Clara A.\nPaulson, former alleged verbal understandings could not be considered\nvalid, and evidently was- not so considered by the, plaintiff since he had\nconiiitently  refused to  transfer any\ntitle in the second block of land, re-\nl'erred to In the plaintiff's claim, to\nthe defendants.\nMr. Taylor then continued reading\nand Ailing other correspondence.\nLater, the plaintiff, in the box, deposed that the defendant, W. L. They administered a decisive defeat to the all-star team that\nRegina scoured the country to secure\nand if they play in anything like form\non Monday the cup will remain where\nit should for the time being, at least,\non the shores of the Fraser.\nThere is no town or city in Canada\nmore deserving of the honor of holding the Minto cup, which Is emblematic of the world's championship In lacrosse, than is New Westminster. For\nyears the people of that teity have\nloyally supported and in every way\npossible encouraged their team. It\nhas been' the ambition of every boy\nin the city to secure a place on the\nteam and the fathers an5 even the\nmothers have encouraged the aspirations of their offspring. In this way\nwas a team built up that was able to\ncapture the world's championship and\ntbe trophy that goes with it. Well\nwishers of Canada's national game\nwho know the way lacrosse has been\ndeveloped ln 'New Westminster cannot hut nope that city will long have\na team capable of successfully defending the Minto cup.\nIn the present series of games New\nWestml rater's aggregation of homebrews present an interesting contrast\nto the Reglna team, which has been\ngathered front almost every part of\nCanada between the Rocky mountains\nand the province of Quebec. Star players have been hired specially for the\ntrip to New Westminster. As soon as\nthe two games to be played there are\nover they will return to their homes\nin eastern Canada and elsewhere.\nJust what Regina hopes to win in Its\nattempt to lift the Minto cup is hard\nto see. Even should they capture It\nfrom New Westminster, on arriving\nhorn with it they would not, a week\nlater, have a team capable of defending\nit. In allowing Reglna to follow the\ncourse it has the cup trustees have\nmade a sad mistake and one which,\nin the interests of lacrosse, It is to be\nhoped will never be repeated. Earl\nMinto in giving the cup meant that It\nshould he competed for by bona fide\nchampionship clubs. It cannot for an\ninstant be contended that the players\nwearing Regina's colors at New Westminster in the present serieB constitute such a club. It would be a cal*\namity for lacrosse were the Regina\nteam to capture the cup.\nOn the other hand there is every\nreason why in the interests of clean\nlacrosse New Westmlnsted should\nretain the cup in the present series.\nIf, however, a bona tide team comes\nwest later and captures the cup New\nWestminster, white regretting its loss,\nwill act the part of sportsmen and will\nbid It goodbye with the hope of going\neast and bringing It back again. MayeB and the dredging work at St. John.\nIt is' to be hoped that between now\nand the assembling of parliament\nagain, none of the honorable members\nof the senate will meet with accident\nat any of the level railway crossings\nthroughout the country, the protection\nof which in the Interests of public\nsafety they so successfully 'opposed\nduring the session just closed.\nAids to Navigation.\nWASHINGTON, May 20.\u2014In lessening the danger of navigation and delay in transportation, the submarine\nbell has become an effective agent and\nIs becoming adopted by maritime interests generally, according to the\nhydrograpnic oir.ee of the navy. The\ngovernment, recognizing the substantial service rendered to shipping by\nthe submarine hells, have decided to\nextend tueir installation from time to\ntime to light vessels and stations on\nboth coasts and upon the great lakes.\nAt present 4G of the light, vessels are\nthus equipped and the signals which\nthey send out are of undoubted aid\nto deep water navigation. E. O'Connor, acting for the'plaintiffs in Cotter vs. Osbourne, known as\nthe plumbers' case, 'moved to dismiss\nthe petition presented by the defendants for leave to appeal direct to the\nprivy council.
