Of late weeks it has been too ready a comment that the camp seemed slowly but surely dying out and that it was just a ���question of lime before we might all have to "walk" out. Nevertheless, it may surprise many to know that there has been received, up to date, at the local banks, a very considerably larger amount of gold than at this time last year, in spite of the fact that the season's operations were delayed fully six weeks behind those of last year, and the output'may be estimated at $150,000. It becomes our painful duty to call the attention of miners to an official advertisement iu connection with the imposition and collection of royalty upon gold taken out and levied by the Government. We would rather refrain from making any remarks upon the subject, but as this last notice is of such vital interest to all miners who are or may become liable to the tax, we feel it our duty to call their special attention to it. The Act, as passed, provides for payment every quarter, but the recent Order' in Council, which affects this and contiguous Mining Divisions, provides that the tax be paid on the first daj* of each and every month. This, undoubtedly, necessitates much inconvenience and loss of time and money to miners, who will have to come to Atlin each month, even if only to make a "nil" return. The Gold Commissioner is- instructed to put into force and effect all the powers contained in the Assessment Act for the collection of the royalty.' The peremptory action on the part of the Government is presumably due j to the very great variance between Mhe amount paid in royalty and the amount of gold known to have been won in previous seasons. COURT MATTERS. County Court is Opened this Week. Several Cases of Much Importance Before the Chief Justice��� Grand and Petit Juries Em- pannelled. . The judgment rendered in the case of Leshander vs. Irvine, mentioned in another column, is as follows : "As to the facts, I find upon the evidence that the alleged partnership is not proved. Counsel for the Defendant stated that it is a common practice in this district to allow the 'grouping' of claims not held in partnership. Upon consideration, I find, therefore,' that the 'grouping ' of these claims is merely a circumstance material to be considered in weighing the evidence and cannot be taken as in itself conclusive in any way. "Judgment for Defendants, with costs on the claim and for the amount claimed with costs on the counter claim." (Signed). A. J. McCou., Judge. We have learned that there is a very strong probability that Atliii may be favoured with a visit from The Hon. Mr. James Dunsmuir, Premier of British Columbia, and some other member of the Cabinet. Our informant advises us that these gentlemen will be accompanied by Mr. C. W. D. Clifford, M.L.A., anil tliat they will endeavor to come in during the residence ol" Chief Justice McColl. It is -their intention to personally look into the existing state of affairs in the district and recommend to the Government such matters as may require adjustment. Here is an opportunity for the Atliii Board of Trade to show itself. One of the first' cases of importance to come before Chiel Justice McColl, sitting iii County Court, on Monday, was that of Bulette vs. 'Anderson Brothers; a case arising out of a claim by the plaintiff for an interest in the gold taken out of claims on" Spruce creek and operated by the defendants. From ihe evidence produced it was shown that a double-set of books was kept and that these were ' so manipulated as to give rise to an apparent intention to mislead. Tlie Chief Justice did not spare the litigants and very strongly commented upon their actions, dismissing the case upon the grounds of conduct tainted with fraud, and giving costs to neither side. ��� Geo. McDonell, for Defendants.; /The case of Leshander vs. Irvine, in which the plaintiff claims an interest in the defendant's claims on Spruce creek, and that he was a partner and entitled to a pro rata'of all gold won, the Chief Justice is to give his decision at an early date. Under-the Placer Mining Act of 1899 there, is no clause covering the grouping of claims whereby all parties interested -in the group constitute themselves into a mining partnership. The question involved is one of moment as a very large number of claims in the district had been grouped prior to the passing of the Act of 190;., and . the issue raised has a great bearing upon the interests of individuals, ��� who, in some instances grouped for working purposes, while others grouped for representation without any direct intention of actually forming themselves into a mining * partnership. The Chief Justice's decision will be anxiously looked for by many miners in the camp. Geo. A. Stewart Potts appeared for the Plaintiff, and A. L. Belyea for the Defendants. Taku Jack vs. Fetherstouhaugh was held over until Friday, and is a case in which plaintiff sues for Sioo.being the value of a dog shot by the defendant. Defendant claims justification for his action and enters a counter-claim for damage done to his property by plaintiff's dog. The Yellow Jacket case, as between McCaulay etal. vs. Clay et al. came up for trial on Thursday; A. L. Belyea appearing for the former and D. G. McDonell,, for the latter. \ Brookes vs. Sawers:���being an appeal against the decision of IS. M. N. Woods, S. M. The appeal was allowed by the Chief Justice. The -Bankers' Ball, On Wednesday evening the citi zens of Atlin were the guests of the officials of our-two local banks- A very large number of the residents both of Atliii and ^Discovery- availed themselves of the invitation c given by these gentlemen to a Ball, which was'held in the Atlin Entertainment Hall, and the attendance, especially of the fair sex, was the largest yet seen in town at any similar function. Satisfactory reports have been received from Canyon creek, a tributary of Dixie, where Messrs. Mc- Caughey, Garrison and Winters, of Skagway, in partnership wilh PI. A. Baxter, of Atlin, are operating a small hydraulic plant. The prospects have proved so good that the owners have decided to increase the capacity of their plant. Good reports continue to come from McKee creek, from the individuals and the hydraulic company. Mr. Brophy is now in charge of the Atlin Mining Co.'s property. To sum up, the indications are that this season's' output of placer gold from Atlin will exceed that of last year, and, further, that it will go far to offset last year's deficit in the annual returns. There has not been a fraction of the gold won which the district will yet produce. The momentary quiet spell need not discourage us, the harvest is yet to come.
