The 48th Battalion, Lieut.-Col. W. J. H. Holmes commanding, has been warned tor active service. This is the battalion in which Prince Rupert's second contingent is serving. A telegram has been received from the Department ot Militia, instructing Col. Holmes to prepare for an early departure from the Willow's camp to England. The immediate destination it is assumed is the Canadian base at Shorncliffe. Nothing official has been issued with respect to the date of departure. A report is in circulation that the corps will leave Victoria Sunday, the 1611. inst. Col. Holmes, however, states that it Is Impossible to say on what date the start will be made. Paris, May 12.—Official report says:—"The fighting north of Arras continues. The enemy having been reinforced, delivered several attacks upon our position, which were, hov- ever, without result. "We have made progress in the wood east of Carency, taking 1,256 prisioners. We had taken three successive lines of trenches bordering on the wood north of Carency, after which we penetrated the wood threatening closely the last line of communication which remains open to the defender's position. L B. Warton Among The Killed Among the late lists of those who have met their deaths in action, appears the name of R. I. B. Warton of the Canadian Engineers. His name has not apeared as yet among the Canadian casualties, but is reported as having been forwarded to relatives as killed. His name appears as R. I. Warton of the 1st Canadian Engineers the regiment to which he belonged. The news of his death will 5 be received with deep regret here, where he was so well and favor- g ably known. Mr. Warton, who was the law partner of W. E. g Fisher in this city, was about 34 years of age. He went to Vancouver and joined the Engineers In North Vancouver very early In the war. From time to time word has been received by his partner here of his work at the front, in which he told of the exciting work that they had in giving lines for the trenches, the work being done at night, under cover of darkness. Mr. Warton who was a native of England, came to Canada after completing his law course in the old land. He practised in Atlinin the early days of that camp, and later resumed practise in Vancouver, In the law office of Sir Charles Hibbert Tupper. The news is now received that Mr. Warton, a barrister of this city, who bad a great number of friends here, has%iot his death in the noblest of causes—the defence of his country's honor, against the arrogant pretensions of Germany, which is resorting to all forms of barbarity, in its attempt to make itself felt. Mr. War- ton belonged to n class of citizens that has made the British nation what it is. Modest, and unassuming ln his ordinary walk of life, he never rested when the call to arms was sounded, until he got to the front. The circumstances connected with his enlisting, showed the characteristics of the man. Tie had a slight defect in his hearing, and fearful that this would result in his being rejected here where he was known, he did not attempt to enlist here, bul quietly slipped off to Vancouver, without revealing the fact to even his intimate friends. Sensitive lest he might be rejected, he did not reveal the fact of his intentions until be had passed the examination and was received into the Engineers. Coal mining rights of the Dominion in Manitoba, Saskatchewan and Aiberta, the Yuken Territory, the Northwest Territories and a portion of the Province of British Columbia, may be leased for a term of twenty-one years at an annual rental of $1 per acre. Not more than 2,560 acres will be leased to one applicant. Applications for a lease must be made by the applicant In person to the Agent or Sub-Agent of the district in which tke rights appllei for are situated. In surveyed territory the lac* lust be described by sections, or| legal subdivisions of sections, and In unsurveyed territory the tract applied for shall be staked out by the1 applicant himself. Each application must be accompanied by a fee of $5, which will be refunded lf the rights applied for are not available, but not otherwise. A royalty shall be paid on the merchantable output of the mine at the rate of five cents per ton. The person operating the mine shall furnish the Agent with sworn returns accounting for the full quantity of merchantable coal mined and pay the royalty thereon. If the coal mining rights are not being operated, such returns should be fur nished at least once a year. The lease will include the coal mining rights only; but the lessee may be permitted to purchase whatever available surface rights may be considered necessary for the working of the min6 at the rate of $10 per acre. Koss had not lied when he said 93,- 000,000 acres had been set aside. He nad himself reiterated the statement on a subsequent occasion. But it had been erroneously reported that he had said "surveyed" whereas lis had used the word "reserved." The surveyor-general had reported 29,- 000,000 acres as surveyed. Rev. Mr. Cooke wants to know how the extra 64,000,000 acres are to be accounted for. "The 93,000,000 acres under reserve for pre-emption are made up of areas the extent of which is determined by certain boundaries. This does not necessarily mean that all tha land so included is fit for pre-emption, bu' that throughout the whol» extent of the 93,000,000 acres any land suitable for pre-emption is available for settlers. With respect to the charge by Rev. Mr. Cooke that the government had withheld the reports of the assessors submitted to tke Agricultural Commission regarding the amount of land available within twenty miles of a railway, no evidence had been withheld deliberately er otherwise. The evidence given before the commission being altogether too bulky was not printed. The Attorney-General held the charge that the government had falsified the land maps with the Idea of deceiving the public was too ridiculous an assumption to be given any credence. The maps had been made from actual instrument surveys of qualified land surveyors. To the charge that large areas of land had been alienated by the government, Mr. Bowser said that in view of the unreliability of Rev. Mr. Cooke's statements with whicli he had already dealt he did not think much heed need be taken of this charge. The government had administered the land laws practically as It had found them.
