C. ^ J Can Make Marriage laws London, July 29.—The Judgment ot the juilicuil committee of the privy council on tbe Ne Temere '.'use, delivered today, iu eflect is to confirm the answer given by tbe four judges of' the Supreme Court of Canada that the Lancaster marriage bill was ultra vires. Tbeir lordships evdressed the opinion that provincial legislatures In legislating on tbe ^olemnlza - tion of marriage withiu the province could impose conditions aftecting the valid.ty ot the contract. Concerning question No. 2.: "Does the law of the province of (Juebec ren der null and void unless contracted belore a Roman Catholic driest a marriage otherwise legally binding lai ing \a) persons Loth Roman Catho - lies aud (li) persons, one of whom is a Roman Catholic."' Their lordships considered it tuperlluous in view of their decision arrived at in answer question No. 1 to the eflect that the larliament ot Canada bad not authority to enact the bill. The uecoud question raised a constitutional issue they were uot culled upon to deal with. Lord Chancellor Hulduue opened by reciting ,n lull the questions submitted by the government of Canada to thc Canadian supreme court, as ai- readypublisbed, und went ou to quote ihe answers given by the Canadian un. The decisioa on these ques - tions, the lord chaucellorcoiitiuued, turns on the canstruction to be placed ou Sections ill and 92 ot the British North America Act of 1W7. Section Dl enacts thut the parliament of the Dominion may muke laws for the peace, order and good government of Canada, relating to all matters not coming within classes of subjects by. uct assigned exclusively to the legislatures of the provinces. And for greater certuiuty, but not so ad to restrict the generality of tlie ior»g«- ing terais of this section, it declares that uutwith-tundiug anything m the act the exclusive legislative authority or the parliament of the Domiu - ion extends to uil niutu-rs somiug w.thiu .the classes of subjects enumerated. Uue of these is.marriuge uud divorce. The section concludes with tbe declaration tbue »uy matter com iug within any of ihe enumerated claa bes shull uot be deemed to como with in the clu.iu of matters local or priv ute nature Comprise din the euumeru lion of classes of subjects by the act assigned exclusively to the legislatures ol the province. Section 92>, went ou his lordship, en ucts thut iu each province the legislature muy exclusively make laws ia relation to niatt?rs coming within tbe classes of subjects enumerated in this section. Among these is tbe eolenin- iaution of marriage within the province. Tbc enumeration also includes, among other things, property, eivil rights and generally mutters merely of locui or private nature within the province. ln the course of iho argument, weat mi Lord Haldane, it became appar - eut that the real controversy between tho parties was us to whether all questions relating to the validity of the contract of marriage, including the conditions of the validity, were within the exclusive jurisdiction by section 91. If this is so, theu the pro viuciul power extend- only to tbe dir ection and regulation of the formalities by which the contract is to be authenticated aud docs not extend to any question of validity. This was the view contended for by one set of counsel. Lost Opportunity Sic Thomas Lipton tells a humor - uua story of a Scotschman who went to a race meeting lor thc tirst time iu bis life, The old man's friends persuuded bim to risk *i\penco on a horse—a 40 to 1 chaace. With much trepidation the Scotchman bunded out tbe sixpence, and, strange to relate, tbe horse won. When the bookmaker handed out « sovereign uud sixpence to Saudy, the latter could not believe his own eyes. "Do you mean to loll me 1 get all tins lor my saipence?" he asked. "You do," replied the bookmuker. "Ma conscience'" exclaimed Saudy "Toll me, mon, how long bus this thing been goiag on?" V Woman's Rights It is your inalienable right to demand in a range— Economy, Promptness and Satisfaction. It is your privilege to expect the same attention, progress and efficiency in the things you use in your daily work as have been brought about in other and often less important lines of endeavour. The Gurney-Oxford i» the foremost example of cooking efficiency. The Gurney Economizer regulates all the drafts by lifting or dropping one small lever. It keeps the fire alive for hours with practically no coal consumption. It saves 1 tun of coal in fi. The Gurney Economizer is found only on the Gurney-Oxford range. The Gurney-Oxford Oven is absolutely and alwaye heated the same on nil sides and in allcomers because the heat is evenly distributed. This is a sure and unfailing guarantee that whatever comes out of the Gurney Oxford Oven is crisp and light and delicious this is thc final test and the point most often advanced by those who cook on a Gurney- Oxford, those who believe it is woman's right and privilege to have in her kitchen the labor, time and money »aving principles embodied in the Gurney- Oxford.
