We aro informed by tba Colonial Secretary nnd iho Attorney General, and the sumo idea is Mcet- sarily broached subsequently in the editorial of tho Chronicle, (showing the source from which our contemporary draws bis inspiration) that the Assembly of this colony is subject to the Governor's Instructions—that we have iu fact no constitution, beyond that document which His Excellency receives from the Colonial Office for bis gaidance, and wliicli the House of Assembly hns been refused even a sight of. The Colonial Secretary's opinion on matters of law we do not expect to bo very profound ; hut for the legal adviser of the Governor and for even the Chief Justice to acquiesce in so monstrous un absurdity ns litis is almost beyond belief. Supposing for a moment, and we can readily admit the proposition, that the legal gentlemen are ignorant of tbe manner in which colonies are constituted, can there be a more fallacious position than to assume tbat the people of a colony possessing representative insli tutions must bo governed by a secret ■document—that their legislative acts must be in accordance with a guide tliey never taw, aud ure precluded from seeing \>y the Governor's express refusal ? One would think thut ordinary prudence would prevent men who occupy such important positions as those we havo named from risking their reputation on so apparent au absurdity ; but prudence, if it ever did exist among tho Governors udviserB, would seem to have been ruthlessly discarded, and nonsense that ordinary men would feel ashamed of uttering is spoken by these officials without the faintest semblance cf a blush. Leaving aside, however, this fallacious position, these men—these Legislative Councillors — should know something about constitutional law. There is no excuse for ignorance on tho head wo have written ; for even if the members are not versed in Hallam, Macauluy or May, they k ow that every year emanates from lbe Colonial office in London a publication Which giveB in a very few words the constitution of tho various colonies. When men talk, therefore, about the Governor's Instructions being ourcnti- itilution, thoy uro simply exhibiting the most deplorable ignorance—all the " Instructions" in the world, if they came from twenty Queens or twenty Secretaries for the Colonics, could not take away a single constitutional right which we possess by virtue of baving representative Government. The very working of our constitution would tench these uninformed people, if anything can teach them, how utterly absurd is their ground of argument. They know that tbe House of Assembly has the power to stop the supplies—to bring, in fact, the Government to a standstill.— This is really the greatest power that any branch of the Government can exercise ; for it virtually decides whether then thall be a Government or not; yet we are profoundly told thut although our Assembly has this power—the greatest that even the House of Commons possesses— it has not the minor one of saying how the money which it votes shall be spent! We give a man authority over our lives, but he dare not say what clothes we shall wear. Why, ordinary reasoning would show if the greater power is possessed the minor powers must be embraced in that pt neaeion, from the simple fact tbat the power of total destruction can, if carried to its limit, force nil the other demands. Is it not, then, something bordering on the audacious as well as ludicrous, to see these Legislative Councillors, these officials who are dependent on the people's representatives for lh« bread they cat, talk of tbe powers they possess if tbey chose to exercise them, and ia it not beyond ull belief that tbe Treasurer should be so silly as well as so Impertinent as to say the Governor would be justified in not calling another FIOMM of Assembly—that is lo say, that tbe Governor would be justified in setting the constitution as well as the people at de- fiance, and collect and spend the public money as he pleases? Tho breath of the BOOH of Assembly hns given this mail bread, but he is disposed, like his brother dependents on public bounty, to quarrel with his benefactor. Like them be uo doubt feels the sword of retrenchment; but he may probably feel with them, before many months shall have expired, the sword of extinction. It is hard enough for the public' of Vancouver Island to be obliged to sell their properly, to deprive themselves in many instances of even the necessaries of life, to support official idleness, but when official insolence is added to the burden, tho thiug becomes absolutely unbeurnblo.
