Not only does the Council attempt to curry out the uncoti- ititntional proceeding of rejecting a portion or the bill, bat it takes away the schedule and sends down to the Hou-e a skeleton of a measure, embracing nothing but a few empty figures. Whatever changes it desires to make in a bill, it has no right to mangle aud curtail it, so that the Lower House is compelled to resort to its own records to kuow the details of the 'measure. Independent of this the resolutions sent down hy the Ciiuuril do not tell the truth. It is said in these resolutions that the schedule contains matters foreign to the Hill of Supply. Now there i3 really nothing loreign in the bill, unless a reJuction in the amount asked for by the Executive can be bo termed. Everything in the measure is intimately connected wiih the aids or supplies to be granted for the year. Under any circumstances, however, the Upper House cannot touch tbe schedule. They must either accept tho measure as a whole or reject it. No privilege bo- longing to the Commons con be more clearly or succinctly put forward than this. As fur back as July 1673, the Commons resolved : " That all aids and supplies and aids to His Majesty in Parliament, are the sole gift of the Commons; and all bills for the granting of any such aids and supplies ought to begin with the Commons ; aud that it is the undoubted and fole right of the Commons to direct, limit, aud appoint in such bills the ends, purposes, considerations, conditions, limitations, and qualifications of such grants ; which ought not to be changed or altered by tbe House of Lords.'' The principle was accepted by the Lords and continues at the present moment as much a constitutional right as tbe existencc-of the CommoiiB as a legislative body. This is not the only unconstitutional aot the Upper House has committed the presont session. Various Ways and Means bills, for the purpose of relieving the people of certain taxes wore rejected, contrary to all Parliamentary wage. " Bills exclusively relating to matters of supply and ways and means," according to May, " tbe Lords agree to respect." The only exception to this rule was in 1860 when the Lords threw out the Paper Duties Repeal Bill; but the Commons enforced their right in the subsequent session by incorporating the bill with other ways nnd means bills-- a sys* tem of "tacking" which is denounced as irregular, but which is nevertheless accepted, although reluctantly, by the Upper Houso. The Lords were virtually compelled to pass the Paper Duties Repeal Bill the very next Parliamentary session, end thus it has been firmly established that the Uppe- Ilouso cannot interfere in the Ways and Means bills of the Lower House. To define the lutter's position, tbe following resolutions wero passed :- " 1. That the right of granting aids and supplies to the Crown Is in the Cuiiiraons alone. 3. That the power of the Lord* to njorl bills relating to taxation was justly rrgarded by thn House wilh peculiar jealousy, as affecting the right of tho Commons to grunt tho supplies and to provide thu ways and means lot the service of thc year; and 3d, That to guard for tho future against au undue exercise of that power by the Lords and to secure to the Commons their rightful control over taxation and supply, this House has within its own hands the power so to impose and remit taxes and to frame bills of suppiy, that tlic right of the I ommons as to the matter, manner, measure and time, may bo maintained inviolate." As these resolutions vrere passed pre- ▼ioas to the Lords' acceptance of the Paper Duties Repeal Bill, the claims of the Commons were clearly recognized by the Upper House. Here, then, we have the constitutional rights of the Lower Honse plainly set forth—their Supply Bills cannot be altered or amended in any way and tbeir Ways and Means Bills, especially when they aim at reducing the burthens of the people, cannot be interfered with. Btit as wo have shown, our Upper House has done both. It Iibb thrown out the Ways and Means bills wbich were framed to reduce taxation, •nd it has amended the Bill of Supply by rejecting tbe schedule. It has indeed acted so wildly, so imprudently, that we are obliged to come to the conclusion that the members really do not know what they are doing. When their ection shall have been placed before Lord Carnarvon we will be very much surprised if he does not send every member adrift, from tbe Chief Justice down. Men who have no more sense than to get the Government of the colouy into its present mess, through their unconstitutional acta—who stand in the way of the Supply Dill being passed, because they differ from the ideas of expenditure entertained by the Lower House —wbo are in fact willing to plunge tbe country into financial embarrassment, because their unconstitutional proceedings do not meet the views of the Assembly— aro surely unfit to hold the most important public positions in the colony.
