The indemnity granted by this clause shall not be available (a) to any person, firm or corporation engaged in the business of garaging, repairing, servicing, storing or dealing in automobiles or to the agents or employees of such person, firm or corporation or (b) to any person, firm or corporation in respect of a claim arising out of damage to the person or property of the Insured or of any person operating the automobile. The Insurer shall not in any event be liable under sections A or B:— I (a) To the Insured or, if more than one, to all the Insureds for any amount in excess of the limits stated in sections A and B of item 4 (four) of the application, and costs or expenses as defined under the foregoing paragraphs (I), (2), (3). (4); or 2 (a) To indemnify the Insured in respect of bodily injury (including death resulting therefrom) caused to any employee of the Insured engaged in the operation, maintenance or repair of the automobile, or to the children of the Insured or to the wife or husband of the Insured; or if the automobile is insured for any use other than "private use" in respect of bodily injury caused to any person or persons being conveyed therein; or 3 (a) To indemnify the Insured in respect of damage to the property of the Insured or to the property of others used by or in charge of the Insured or used by or in charge of any of the Insured's employees or carried in or upon the automobile. Collision Section C—The Insurer agrees to indemnify the Insured against direct damage or loss to the automobile including its Damage to equipment while in or on said automobile if caused solely by accidental collision with another object either moving or Own stationary or by upset. Each collision covered under section C shall give rise to a separate claim in respect of which the Automobile. Insurer's liability shallbe limited to the amount of damage or loss in excess of the sum payable by the Insured as stated in section C of item (four) of the application. The Insurer shall not in any event be liable under section C:— 1. For any amount in excess of the actual cash value of the automobile at the time the damage or loss occurs: or 2. For damage or loss (a) from fire, however caused; (b) arising from the theft of the automobile, or any of its parts; (c) to any tire unless caused in an accidental collision which also causes other damage or loss to the automobile; (d) to rugs, robes, baggage, 'personal belongings and extra bodies. Loss by Fire Section D.—The Insurer agrees to indemnify the Insured against direct damage or loss to the automobile including its or Trans- equipment caused by (a) accidental fire or lightning, or caused by (b) the stranding, sinking, collision, burning or derail- portation. ment of any conveyance on land or water, in or upon which the automobile is being transported, including general average and salvage charges, for which the insured is legally liable. The Insurer shall not in any event be liable under section D:— I. For any amount in excess of the actual cash value of the automobile at the time the damage or loss occurs, or if the automobile is insured for any use other than "private use", for any amount in excess of the specific amount stated in section D of item 4 (four) of the application, or 2. For damage or loss- to rugs, robes, baggage, personal belongings and extra bodies; or 3. For damage or loss arising from theft of the automobile, or any of its parts. Loss by Thelt. Section E.—The Insurer agrees to indemnify the Insured against direct damage or loss to the automobile, including its equipment while in or on the said automobile, caused by theft. Each theft covered under section E shall give rise to a separate claim and where there is no theft of the automobile but any part or parts or any equipment of the automobile is stolen therefrom, the Insurer's liability in respect of each claim shall be limited to the amount of damage or loss in excess of the sum payable by the Insured as stated in section E in item 4 (four) of the application. The Insurer shall not in any event be liable under section E:— I. For any amount in excess of the actual cash value of the automobile at the time the damage or loss occurs, or if the automobile is insured for any use other than "private use", for any amount in excess of the specific amount stated in section E of item 4 (four) of the application; or 2. For damage or loss caused by (a) theft by any person or persons in the Insured's household or by any employee of the Insured engaged in the operation, maintenance or repair of the automobile, whether the theft occurred during the hours of such service or employment or not; (b) the conversion, embezzlement, theft or secretion by a mortgagor, vendee or lessee, or by a custodian or trustee authorized by the Insured; (c) theft of tools and repair equipment other than in the case of theft of the entire automobile; (d) theft of rugs, robes, baggage, personal belongings and extra bodies. EXCLUSIONS FROM PERILS. The Insurer shall not be liable under any section A, B or C of the insuring agreements for any loss or damage arising while the automobile is being used with a trailer attached, and the Insurer shall not be liable under any section A, B, C, D or E of the insuring agreements for any loss or damage arising while the automobile is being used (a) otherwise than for the purposes specified in item 3 (five) of the application, or (b) for demonstrating or testing, or (c) as a taxicab, public omnibus, livery, jitney or sight-seeing conveyance, or for carrying passengers for compensation, or if rented or leased, or (d) in any race or speed test, or (e) in any illicit or prohibited trade or transportation, or (f) for carrying explosives, or (g) outside the boundaries of the Dominion of Canada, Newfoundland and the United States (exclusive of Hawaii, Porto Rico and Alaska), except for loss or damage occurring on a ferry or steamer plying between ports within said boundaries: the Insurer shall not, by this contract, indemnify the Insured against any liability imposed upon the Insured under any Workmen's Compensation Act, Plan or Agreement. Take names and addresses of all witnesses, also badge number of policeman present (if any). Independent witnesses are important. 2. If any other vehicle involved take name and address of owner and driver and registration number of car—also operator's license (if any). 3. If after lightlng-up time, note if all lamps are lighted in accordance with regulations. 4. Carefully note exact nature and condition of damage done. 5. Make a rough sketch plan of position of each car involved in accident, and take notes of exact time of accident, the condition of the road (such as wet or dry). 6. Report the accident immediately to the Corporation's nearest Claim Department. If in trouble, wire the Head Office for instructions. The more promptly and fully we are advised, the mora effectively we can deal with the matter. 7. Do not run away from the scene of accident. 8. Do not say that you are insured and do not admit responsibility, or make any payment or promise to any third party. The Corporation will determine whether or not you are at fault. 9. Do not assume that the accident is of no importance and that nobody can say you are to blame. Trivial accidents sometimes result in troublesome claims. Let the Corporation have the full details and take over the trouble and responsibility. SAFETY CODE REMINDERS 1. Be sure your brakes are in good working order. 2. Be alert In your driving and anticipate sudden emergencies. 3. Obey all traffic and parking regulations. 4. Keep to the right and comply with road markings and signs. 5. Slow down at crossings, schools and dangerous places. 6. Never pass cars on hills, curves or crossings. 7. Adapt your driving to road conditions, rain, ice, soft spots in roads. 6. Vancouver B. C. Dear Sir; WITHOUT PREJUDICE 1 have been requested by Mr. James Yuen to reply your letter of Feb.8, regarding Mr.Horace McKay's accident case. He said that he is unemployed now, and at any time desirous for a city relief. On account of his financial strigency, Mr. James Yuen is unable to assist Mr.McKay in any way in paying the large hospital and doctor bills. On the other hand, according to the accident report filled at the police station, the report is illustrated in the below diagram; A-McKay's car stopping corner Cambie and 23rd. Ave. about 2-3 ft from curb. B- James Yuen's car travelling. James Yuen's car was travelling on Cambie St. proceeding South towards North, while McKay's car was stopping at corner 23rd.Ave.and Cambie St. 2-3 feet from curb as shown in diagram. Apparently, Mr. McKay was doing something at the back of his car, and he was hit by Yuen's car. At the time of accident, the weather was foggy and the victim's car had no front or baok lights whatsoever, discovered after the accident. Thuajas told by the accident report, Mr. James Yuen had shown no dement' in his driving, and the accident was purely accidental. Refer to 1933 Traffic and Parking By-Laws . 1. Item 10—Every person insured agrees that the Insurer upon making any payment or assuming liability therefor under or by reason of this policy shall be subrogated to the extent of such payment to all rights of recovery against any person or persons other than the person insured and every person insured authorizes the insurer to use his name in any and all actions or proceedings to enforce such rights and agrees to execute all documents (if any) properly required by the insurer to secure to it such rights. Fire or Lightning or the Stranding, Sinking, Collision, Burning or Derailment of Any Conveyance on Land or Water, in or upon which the Automobile is being Transported, Including General Average and Salvage Charges, for Which the Insured is Legally Liable; Provided always that the Insurer shall not be liable under this subsection:— (a) For any amount in excess of the actual cash value of the automobile at the time the loss or damage occurs; or for any amount la excess of the specific amount, if any, stated in subsection 2 of section B of Item 6 of the application; or (b) For loss or damage to rugs, robes, radios, baggage, personal belongings and extra bodies; or (c) For loss or damage occurring after theft of the automobile and before recovery of the automobile by the Insured; Subsection 3. Theft; Each theft covered hereby shall give rise to a separate claim, and, except where the automobile is stolen, the Insurer's liability in respeot of each claim shall be limited to the amount of loss or damage in excess of the sum, if any, payable by the Insured, stated in subsection 3 of section B of Item 6 of the application; Provided always that the Insurer shall not be liable under this subsection:— (a) For any amount in excess of the actual cash value of the automobile at the time the loss or damage occurs; or for any amount In excess of the specific amount, if any, stated in subsection 3 of section B of Item 6 of the application; or (b) For loss or damage caused by (1) theft by any person or persons in the Insured's household or by any employee of the Insured engaged in the operation, maintenance or repair of the automobile, whether the theft occurred during the hours of such service or employment or not; or (2) the conversion, embezzlement, theft or secretion by a mortgagor, vendee or lessee or other person in lawful possession of the automobile under a mortgage, conditional sale, lease or other contract or agreement, whether written or oral; or (3) the voluntary parting with title or possession, whether or not induced so to do by any fraudulent scheme, trick, device or false pretense; or (4) theft of tools and repair equipment other than in the case of theft of the entire automobile; or (5) theft of rugs, robes, radios, baggage, personal belongings and extra bodies; or (6) theft of equipment of the automobile unless such equipment is in or on the automobile at the time the loss or damage occurs. STATUTORY CONDITIONS Unless the context otherwise requires, wherever the word " Insured" is used in these statutory conditions, it shall mean a person insured by the policy whether named or not, but elsewhere in the policy the word "Insured" means the insured person named therein. MATERIAL CHANGE I. (a)The insured named in the policy shall promptly IN RISK notify the insurer, or its local agent, in writing, of any change in the risk material to the contract and within his knowledge. (b) Without restricting the generality of the foregoing, the words "change in the risk material to the contract'' shall include:— Sale (i) any change in the insurable interest of the insured named in the policy in the automobile by sale, assignment or otherwise, except through change of title by succession, death or proceedings under The Bankruptcy Act; Mortgage or Lien and in cases other than motor 'vehicle liability policies: (ii) any mortgage, lien or encumbrance affecting the automobile after the application for the policy; Other Insurance (in) any other insurance of the same interest, whether valid or not, covering loss or damage insured by the policy or any portion thereof. 2. The automobile shall not, with the knowledge, consent or connivance of the insured named in the policy be used or driven:— (a) by any person under the influence of drink or drugs so as to be incapable of proper control of the automobile; or (b) by any person not qualified and authorized by law to drive the automobile; or in case the law does not prescribe any qualification or authority, by any person under the age of sixteen years; or Prohibited Trade (c) for any illicit or prohibited trade or trans portation; or PROHIBITED USE Intoxication Unlicensed Driver Racing USES PROHIBITED WITHOUT PERMISSION Trailer Explosives Taxicab or Bus LOSS OR DAMAGE TO PERSONS OR PROPERTY INSURED TO GIVE NOTICE OF ACCIDENT AND CLAIM (d) in any race or speed test. 3. Unless permission is expressly given by an endorsement of the policy and in consideration of an additional stated premium, the automobile shall not be rented or leased nor shall it be used:— (a) with trailer attached; or (b) to carry explosives; or (c) as a taxicab, public omnibus, livery, jitney, or sight-seeing conveyance or for carrying passengers for compensation or hire. 4. (1) The insured shall promptly give to the insurer written notice, with all available particulars, of any accident involving loss or damage to persons or property, and of any claim made on account of accident; shall verify by affidavit or statutory declaration, if required by the insurer, that the claim arises out of the operation or use of an automobile described in the policy and that the person operating or responsible for the operation of the automobile at the time of the accident is a person insured by the policy; and shall forward immediately to the insurer every writ, letter, document or advice received by him from or on behalf of the claimant. CO-OPERATION OF (2) The insured shall not voluntarily assume any liability INSURED AND or settle any claim except at his own cost. The insured INSURER IN CLAIM shall not interfere inany negotiations for settlement orin SETTLEMENT any legal proceeding, but, whenever requested by the insurer, shall aid in securing information and evidence and the attendance of any witness, and shall co-operate with the insurer, except in a pecuniary way, in the defence of any action or proceeding or in the prosecution of any appeal. LOSS OR DAMAGE 5. (1) Upon the occurrence of any loss of or damage to TO THE AUTO- the insured automobile, the insured shall, if such loss or MOBILE damage is covered by this policy: Insured to give (a) forthwith give notice thereof, in writing, to the Notice of Claim insurer, with fullest information obtainable at the time, and shall, at the expense of the insurer, and as far as reasonably possible, protect the automobile from further loss or damage, and any such further loss or damage accruing directly or indirectly from a failure to protect shall not be recoverable hereunder. No repairs shall be undertaken or any physical evidence of the loss or damage removed without the written consent of the insurer, except such repairs as are immediately necessary for the protection of the automobile from further loss or damage: or until the insurer has had a reasonable time to make the examination provided for in statutory condition 7. Proof of Loss (b) deliver to the insurer within ninety days of the date of the loss or damage a statutory declaration stating, so far as the insured knows or believes, the place, time, cause and amount of the loss or damage, the interest of the insured and of all others therein, the encumbrances thereon, all other insurance, whether valid or not, covering the automobile, and that the loss or damage did not occur through any wilful act or neglect, procurement, means or connivance of the insured, EXAMINATION OF (2) The insured shall submit to examination under oath, INSURED and shall produce for examination, at such reasonable place as is designated by the insurer or its representative all documents in his possession or control which.relate to the matters in question, and shall permit extracts and copies thereof to be made. INSURER LIABLE FOR CASH VALUE OF AUTOMOBILE (3) The insurer shall not be liable beyond the actual cash value of the automobile at the time any loss or damage occurs,and the loss or damage shall be ascertained or estimated according to such actual cash value with proper deduction for depreciation, however caused, and shall in no event exceed what it would cost to repair or replace the automobile or any part thereof with material of like kind and quality; provided that in the event of any part of the automobile being obsolete and out of stock, the liability of the insurer in respect thereof shall be limited to the value of such part at the time of loss or damage not exceeding the maker's last list price. IN CASE OF DISAGREEMENT (4) In the event of disagreement as to the nature and extent of the repairs and replacements required, or as to their adequacy, if affected, or as to the amount payable in respect of any loss or damage, such questions shall be determined by appraisers before recovery can be had hereunder, whether the right to recover on the policy is disputed or not, and independently of all other questions. APPRAISAL (5) The insured and the insurer shall each select one appraiser, and the two so chosen shall then select a disinterested umpire. Thereafter the two appraisers together shall estimate or appraise the loss or damage, stating separately sound value and damage, or determine the adequacy of such repairs or replacements, and, failing to agree, shall submit their differences to the umpire. APPOINTMENT (6) In case either party fails to name an appraiser within OF APPRAISERS seven clear days after being served with written notice so to do, or in case the appraisers fail to agree upon an umpire within fifteen days after their appointment, or in case an appraiser or umpire refuses to act or is incapable of acting, or dies, a Judge of a Superior, County or District Court having jurisdiction in the county or district in which the appraisal is to be made may appoint such appraiser or umpire on the application of the insured or of the insurer. AWARD (7) An award in writing of the two appraisers, or of one appraiser and the umpire, shall determine the nature and extent or adequacy of the repairs and replacements made or required, or the amount of such loss or damage. COSTS OF APPRAISAL WAIVER (8) Each party shall pay the appraiser selected by him, and shall bear equally the other expenses of the appraisal and of the umpire. 6. Neither the insurer nor the insured shall be deemed to have waived any term or condition of this policy by any act relating to the appraisal or to the delivery and completion of proofs of loss, or to the investigation or adjustment of the claim. INSPECTION OF AUTOMOBILE 7. The insurer shall be permitted at all reasonable times to inspect the automobile and its equipment. OTHER INSURANCE 8. (1) If the insured named "in the policy has or places OF THE SAME any additional or other valid insurance of his interest in INTEREST the subject matter of the contract or any part thereof, the insurer shall be liable only for its rateable proportion of any loss or damage. (2) Where by any other valid insurance indemnity is provided for a claim under this policy against a person not named herein but insured hereby, the insurer shall only be liable under this policy, in respect of any such claim, to the extent of any deficiency in the amount of such other insurance of such claim, not exceeding in any event the limits of liability of the insurer under this policy. TIME AND 9. (1) An insurer shall pay the insurance money for MANNER OF which it is liable under a contract within sixty days after PAYMENT OF the proof of loss has been received by it, or, wherean INSURANCE MONEY appraisal is had under statutory condition 5, within fifteen days after the award is rendered by the appraisers. WHEN ACTION (2) The insured may not bring an action to recover the MAY BE BROUGHT amount of a claim under the policy unless the requirements of statutory conditions 4 and 5 are complied with nor until the amount of the loss has been ascertained as therein provided, or by a judgment against the insured after trial of the issue, or by agreement between the parties with the written consent of the insurer. LIMITATION OF (3) Every action or proceeding against an insurer under a ACTIONS contract in respect of loss or damage to the automobile shall be commenced within one year next after the happening of the loss and not afterwards, and in respect of loss or damage to persons or property shall be commenced within one year next after the cause of action arose, and not afterwards. WHO MAY GIVE 10. Notice of claim may be given and proofs of claim NOTICE AND may be made by the agent of the insured named in the PROOFS OF CLAIM policy in case of absence or inability of such insured to give the notice or make the proof, such absence or inability being satisfactorily accounted for, or in the like case, or if such insured refuses to do so, by a person to whom any part of the insurance money is payable. CANCELLATION 11. (1) The policy may be cancelled at any time at the request of the insured named therein, and the insurer shall upon surrender of the policy, refund the excess of paid premium above the customary short rate premium for the time the policy has been in force. (2) This policy may be cancelled at any time by the insurer giving to the insured named in the policy fifteen days' notice in writing of cancellation by registered post, whether registered within or without Canada, or five days' notice of cancellation personally delivered, and refunding the excess of paid premium beyond the pro rata premium for the expired time. Repayment of excess premiums may be made by money, post office order, postal note or cheque. Such repayment shall accompany the notice, and in such case the fifteen days above mentioned shall commence to run from the day following the receipt of the registered letter at the post office to which it is addressed. NOTICE 12. Any written notice to the insurer may be delivered at or sent by registered post to the chief agency or head office of the insurer in this Province. Written notice may be given to the insured named in the policy by letter personally delivered to him or by registered letter addressed to him at his last post office address notified to the insurer, or, where no address is notified and the address is not known, addressed to him at the post office of the agency, if any, from which the application was received. In this condition the expression "registered" shall mean registered within or without Canada. B for which a premium is specified in Item 6 of the application •tnd no other, tEhi* Agreement ^.tneasenj,— SECTION A THIRD PARTY LIABILITY The Insurer agrees to indemnify the Insured, his executors or administrators, and, in the same manner and to the same extent as if named herein as the Insured, every other person who, with the Insured's consent, uses or is responsible for the use of the automobile, against the liability imposed by law upon the Insured or upon any such other person for loss or damage arising from the ownership, use or operation of the automobile within Canada, Newfoundland or the United States of America, or upon a vessel plying between ports within those countries and resulting from: Subsection l.^ri Bodily Injury To or Death of Any Person; Provided always that the Insurer shall not be liable under this subsection:— (a) For any liability imposed by any Workmen's Compensation Law upon any person insured by this policy; or (b) For loss or damage resulting from bodily injury to or the death of any person insured by this policy or the children, wife or husband of any such person; or • (c) To any person, not the owner of the automobile, engaged in the business of" an automobile parage, repair shop or service station or as an automobile dealer, for loss or damage sustained while engaged in the operation or repair of the automobile; or (d) For any loss or damage resulting from bodily injury to or the death of any person being carried in or upon or entering or getting on to or alighting from the automobile; or (e> For loss or damage resulting from bodily injury to or the death of any employee of any person insured by this policy while engaged in the operation or repair of the automobile; or (f) For any amount in excess of the limits stated in subsection 1 of section A of Item 6 of the application, and expenditures provided for in the additional agreements of this section; Subsection 2. Damage to Property; Provided always that the Insurer shall not be liable under this subsection:— (a) For loss of or damage to property carried in or upon the automobile; or (b) To any person, not the owner of the automobile, engaged in the business of an automobile garage, repair shop or service station or as an automobile dealer, for loss or damage sustained while engaged in the operation or repair of the automobile; or (c) For any amount in excess of the limits stated in subsection 2 of section A of Item 6 of the application, and expenditures provided for in the additional agreements of this section. Additional Agreements. IT here indemnity is provided by subsections 1 or 2 of this section the Insurer further agrees:— (a) Upon receipt of notice of loss or damage caused to persons or property, to serve any person insured by this policy by such investigation thereof, or by such negotiations with the claimant, or by such settlement of any resulting claims, as may be deemed expedient by the Insurer; and (b) To defend in the name and on behalf of any person insured by this policy and at the cost of the Insurer any civil action which may at any time be brought against such person on account of such loss or damage to persons or property; and (c) To pay all costs taxed against any person insured by this policy in any civil action defended by the Insurer and any interest accruing after entry of judgment upon that part of the judgment which is within the limits of the Insurer's liability; and (d) In case the injury be to a person, to reimburse any person insured by this -policy for outlay for such medical aid as may be immediately necessary at the time. Liability of Insured to Reimburse Insurer. It is a condition of the insurance granted under this Section, and it is hereby agreed that every person insured by this policy shall pay or reimburse the Insurer, upon demand, any amount which the Insurer has oaid by reason of the provisions of any statute relating to automobile insurance and which the Insurer would not otherwise be liable to pay under this policy. SECTION B LOSS OF OR DAMAGE TO INSURED AUTOMOBILE The f&sjrrer agrees to indemnify the Insured against direct loss of or damage to the automobile, including its equipment, occurring in Canada, Newfoundland or the United States of America, or upon a vessel plying between ports within those countries, caused solely by: , Subsection 1. Accidental Collision with Another Object, Either Moving or Stationary,' or by Upset; Each collision or upset covered hereby shall give rise to a separate claim in respect of which the Insurer's liability shall be limited to the amount of loss or damage in excess of the sum, if any, payable by the Insured stated in subsection 1 of section B of Item 6 of the application; Provided always that the Insurer shall not be liable under this subsection:— (a) For any amount in excess of the actual cash value of the automobile at the time the loss or damage occurs; or (b^ For loss or damage (1) from fire, however caused; (2) occurring after theft of the automobile and before recovery of the automobile by the Insured; (3) to any tire unless caused in an accidental collision which also causes other loss or damage to the automobile; (4) to rugs, robes, radios, baggage, nersonal belongings and extra bodies; (5) to equipment of the automobile unless such equipment is in or on the automobile at the time the loss or damage occurs; 5ubeection 2. Fire or Lightning or the Stranding, Sinking, Collision, Burning or Derailment of Any Conveyance on Land or Water, in or upon which the Automobile is being Transported, Including General Average and Salvage Charges, for Which the Insured is Legally Liable; Provided always that the Insurer shall not be liable under this subsection:— (a) For any amount in excess of the actual cash value of the automobile at the time the loss or damage occurs; or for any amount is excess of the specific amount, if any, stated in subsection 2 of section B of Item 6 of the application; or (b) For loss or damage to rugs, robes, radios, baggage, personal belongings and extra bodies; or (c) For loss or damage occurring after theft of the automobile and before recovery of the automobile by the Insured; Subsection 3. Theft; Each theft covered hereby shall give rise to a separate claim, and, except where the automobile is stolen, the Insurer's liability in respect of each claim shall be limited to the amount of loss or damage in excess of the sum, if any, payable by the Insured, stated in subsection 3 of section B of Item 6 of the application; Provided always that the Insurer shall not be'liable under this subsection:— (a) For any amount in excess of the actual cash value of the automobile at the time the loss or damage occurs; or for any amount in excess of the specific amount, if any, stated in subsection 3 of section B of Item 6 of the application; or (b) For loss or damage caused by (1) theft by any person or persons in the Insured's household or by any employee of the Insured engaged in the operation, maintenance or repair of the automobile, whether the theft occurred during the hours of such service or employment or not; or (2) the conversion, embezzlement, theft or secretion by a mortgagor, vendee or lessee or other person in lawful possession of the automobile under a mortgage, conditional sale, lease or other contract or agreement, whether written or oral; or (3) the voluntary parting with title or possession, whether or not induced so to do by any fraudulent scheme, trick, device or false pretense; or (4) theft of tools and repair equipment other than in the case of theft of the entire automobile; or (5) theft of rugs, robes, radios, baggage, personal belongings and extra bodies; or (6) theft of equipment of the automobile unless such equipment is in or on the automobile at the time the loss or damage occurs. STATUTORY CONDITIONS Unless the context otherwise requires, wherever the word " Insured" is used in these statutory conditions, it shall mean a person insured by the policy whether named or not, but elsewhere in the policy the word "Insured" means the insured person named therein.
