Wednesday, October 26th, 1938.
An adjourned meeting of the Senate of The
University of British Columbia was held on Wednesday,
October 26th, 1938, at 8:00 p.m., in the Board and
Senate Room.
Present:  President L. S. Klinck (in the Chair),
Dean F. M. Clement, Dean J. N. Finlayson, Dean D.
Buchanan, Dr. Blythe Eagles, Dr. D. G. Laird, Dr. M. Y.
Williams, Mr. A. H. Finlay, Mr. F. H. Soward, Mr. H. N.
MacCorkindale, Mr. A. R. Lord, Mr. William Morgan, Mr.
Sherwood Lett, His Honour F. W. Howay, Mr. A. E. Lord,
Miss Isobel Harvey, The Most Rev. A. U. de Pencier and
Mr. J. N. Burnett.
Expressions of regret at their inability to attend
the meeting were received from Mr. Logan, Mr. Boving and
Mr. Oliver.

Reports of Committees:
On Procedure In regard to the Election
of Chancellor and Members of Senate
Mr. A. E. Lord presented, as a report of the
Committee on Procedure in regard to the Election of
Chancellor and Members of Senate, draft Amendments to
the University Act as proposed by the University
Solicitor.  The sections of the University Act dealing
with the "Election of Chancellor and fifteen members of >

Wednesday, October 26th, 1938.
Senate to be elected by Convocation", and the proposed
changes prepared by the University Solicitor, had been
mimeographed and mailed to all members of Senate.
The proposed amendments were considered, section by
section, and adopted, with alterations, as follows,-
"PROPOSED CHANGES IN THE UNIVERSITY ACT PREPARED BY
THE UNIVERSITY SOLICITOR AND SUBMITTED TO SENATE
BY THE COMMITTEE ON PROCEDURE IN REGARD TO THE ELECTION OF CHANCELLOR AND MEMBERS OF SENATE.
An Act to amend the "University of British Columbia
Act"
HIS MAJESTY by and with the advice and consent
of the Legislative Assembly of the Province of
British Columbia enacts as follows:
1. This Act may be cited as the "British Columbia
University Act Amendment Act, 193   "
2. Section 63 of the "British Columbia University
Act" being Chapter 299 of the "Revised Statutes of
British Columbia, 1936" is hereby repealed and the
following is substituted therefor:
63. The votes at any election by the Convocation shall be given for the Chancellor and
the members of the Senate respectively by
voting-papers, in such form as may be made
and approved by the Senate pursuant to
Section 76 as hereby re-enacted, being
delivered to the Registrar of the University
at such time and place as may be prescribed
by the Senate.
3. Section 66 of said Chapter 299 is hereby
repealed and the following is substituted therefor:
66. At least fourteen weeks prior to the date
fixed for the election of the Chancellor
"or", or      o_r members of the Senate, the Registrar
"and" as in   shall send a copy of the election register
para.63?      to each member of the Convocation whose
address is known. 642.

4. Section 71 (2) of said Chapter 299 is hereby
repealed and the following is substituted therefor:
71. (2)  The Registrar shall forthwith send
a written notice of nomination to each
person duly nominated with a request that
such person forward to the Registrar forthwith after the receipt of the Notice
information as to the residence of the
candidate; degrees and dates of same;
occupation; offices held at the University
of British Columbia or in other organizations; other professional or business
interests; publications.
5. Section 72 of said Chapter 299 is hereby
repealed and the following is substituted therefor:
72. The nomination papers shall be delivered
at the office of the Registrar, or, if
sent by mail, shall be received by him
not later than twelve weeks prior to the
date of the election, and if not so delivered and received shall be invalid
and not acted upon.
6. Section 76 of said Chapter 299 is hereby
repealed and the following is substituted therefor:
76. In case a poll is necessary the same
shall be taken by the Registrar in
accordance with such rules respecting
the same as may be from time to time made
and approved by resolution of the Senate
and such rules shall specify the form
of the voting-paper and the method of
voting and counting such votes to be used
in the taking of such poll, and generally
such other matters as may be deemed necessary by Senate to the proper conduct
of the election, with the proviso that
such regulations shall not conflict with
the provisions of the Act.
7. Section 77 of said Chapter 299 is hereby
repealed and the following is substituted therefor:
77. It shall be the duty of the Senate to
appoint two or more persons to act as
scrutineers at each election. 643.
Wednesday, October 26th, 1938.
8. Section 78 of said Chapter 299 is hereby
repealed and the following is substituted therefor:
78.  At ten o'clock of the forenoon of the
day fixed for the election, the voting-
papers shall be opened by the Registrar
of the University in the presence of
not less than two scrutineers.
9. The Schedule to this Act Is hereby repealed."

Dr. Eagles    ) That the draft bill as
submitted by the University
Solicitor be approved as
amended, and forwarded to
the Solicitor with instructions to forward the same
to the Honourable the
Minister of Education.

A letter from the Registrar, under date of October
20th, 1938, was read.  Copies of the letter had been
mailed to the members of the Senate.  The communication
contained the request that, in the event of the Senate
endorsing the proposed amendments to the Act, the Senate
would either,-
(a) Request the Legislature to provide that the
changes, if passed, become operative following but not in regard to the forthcoming
election, or
(b) Take no action at the present time in regard
to the setting a date for the election, nor
until the action of the Legislature in
respect to the proposed amendments is known,
and Senate has made and approved rules, as
called for In the proposed amendments of
Paragraphs 63 and 76, in regard to the form
of the voting-paper and the method of voting
and counting votes. * 644.

Mr. Soward) That in accordance with the request
of the Registrar, as contained in
recommendation (b) of his letter,
no action be taken at the present
time in regard to the setting a
date for the election, nor until the
action of the Legislature in respect
to the proposed amendments is known;
and Senate has made and approved
rules, as called for in the proposed amendments of Paragraphs 63
and 76, in regard to the form of
the voting-paper and the method of
voting and counting votes; and that
the present Committee be asked to
draft and submit to Senate rules
and regulations for the conduct of
the Elections of Senate.
Carried
It was agreed that these rules and regulations could
be submitted to Senate prior to, or when, the proposed
amendments to the Act are enacted.
On Senate Elections, 1939

Dean Clement ) That the report of the Committee
on the place and time of the
Senate Elections, and the naming
of scrutineers, be laid on the
table.

On new Department of Commerce
Dean Buchanan, on behalf of the Committee, presented a report on the question of the constituting of
a new Department of Commerce.
In view of the fact that the work in Commerce has 645.
Wednesday, October 26th, 1938,
been in operation and that no expenditure would be
involved, the Committee recommended that a Department
of Commerce be constituted.
It was noted that the intention was to take
Commerce out of the existing Department of Economics,
Political Science, Commerce and Sociology and make it
a separate department.

Dean Finlayson) That this recommendation be
received, and that the whole
matter be referred to the
Faculties for consideration
and report at the next meeting of the Senate.

Mr. A. E. Lord asked leave to introduce to Senate
the matter of a proposed Faculty of Law.
Dean Clement)
Judge Howay ) That Senate receive for information a statement from Mr. Lett,
representing the Board, and
from Mr. Lord, representing the
Senate, regarding the question
of the establishment of a
Faculty of Law.
Carried
Mr. Lett reviewed the whole matter of the proposed
constitution of a Faculty of Law in the University
since it was first discussed in 1922.  As a result of
recent representations to the Board of Governors, made
by the Law Society of British Columbia, the Board had
appointed a Committee to confer with a Committee from
K 646.
Wednesday, October 26th, 1938,
the Law Society, in regard to the question.
Judge Howay )
Archbishop de Pencier) That the matter of the
formation of a Faculty
of Law in this University be dealt with at
a special meeting of
the Senate.
Carried
Judge Howay)
Mr. Lett   ) That the records of the meetings
which have been held by the Committee appointed by the Board of
Governors with the Committee of
the Law Society, to which Mr.
Lett has made reference, be
mimeographed and sent to all
members of the Senate.
Carried
Dean Buchanan called attention to requests for
other new Faculties and Departments, which it was
agreed should be given consideration along with the
request for a Faculty of Law.
The meeting adjourned.
