I have  forwarded Mr*Grey schedule of pipe lines at
Since I  taw you I have learned that a matter that may
have a very great bearing on the situation at the  Gentry is  now being
fought out  in the Courts between the Glenmore  irrigation District
and Mr*Thomas Bulman.   Stated shortly  it  is as follows*
Before the Glenmore Irrigation District was formed Mr*
Julman    drew water frcm Mill creek through certain works constructed
by the Central Okanagan Lands Co.by arrangement with the Co*,which
works were later taken over by the District.The District also took
over certain reservoir dams at the Head waters of Mm creek,originally]
eenstrueted by the Irrigation Ce*
Since taking over the works the District has repaired
and maintained the flumes and ditches,and also repaired amd strengthe-
ened and raised the reservoir dams.
They have also supplied Mr.Bulman with water every year
both stream flow and storage,at the same time billing him for his
proportionate  share of the cost of maintenance,of the flume and ditch
tjoint] and of the repairs^raising ©f the damsfwhich bills Mr.Bulman
has  so  far refused t© pay, ,
This year the District  refused to  supply Mr.Bul^ian with
any water,and closed his headgate*which has  forced Mr*lulman^apply
for an injunction ordering the District +o  supply him with water
through their works on the ground that the works are appurtenant to
his  lands   *
This will bring the  question of appurtenafccy sSe^rley
before the Courts. |
You are in practically the same position as Mr* Bulman
who agreed t© pay the Irrigation Co* certain money,and I beleive did
pay them,on their constructing the joint works*
I saw Mr*Forrington and he  said he would find out when
the Comptroller would be  in the valley next,but as to what  stand the
Dept*would take regarding appurtenancy,he of course    could give no
information,and I  doubt very much,if the Comptroller would commit
himself or the Department on such a matter*
