WATER ACT"
(Section 310)
IN THE MATTER of the complaint of W* J. Coe and
certain other owners of land supplied with water
through the irrigation system operated by The Okanagan
Centre Irrigation and Power Company, Limited, that the
tolls chargeable under the water agreements entered
into by the said company and the tolls demanded by the
said company exceed what, is just and reasonable, and
IN THE HA3PTER of the application of the said W* J*
Coe and the said other land owners for an order directing the said company to provide a proper depreciation
fund*
BEFORE THE BOARD OF INVESTIGATION:
TOON the above-mentioned complaint and application and upon
hearing Mr* T# G* Norris of counsel for the complainants and
applicants and Mr* J« J» Warren of counsel for The Okanagan
Irrigation and Power Company, Limited, and upon hearing the evidence adduced;
THE BOARD DOTH ORDER:
1* That in lieu of the tolls payable to the said company
under the water agreements entered into by it and the tolls demand ed by the said company the following tolls shall be payable
for the year 192j>»
(a) A toll of |j#20 (three dollars and twenty cents) per
acre payable in respect of all arable land which is so situated
that upon the necessary lateral ditches, flumes or pipes being
provided it can be supplied with water from the existing main
works operated by the said company«
(b) In addition to the toll chargeable under (a) a further
toll of eighty cents per acre payable in respect of all arable
and irrigable land under the system operated by the said company
to which the necessary lateral ditches, flumes or pipes are
provided*
(c) In addition to the tolls chargeable under (a) and (b)
a farther toll at the rate of |2*72 (two dollars and seventy-
two cents) per acre foot for all water delivered during the
irrigating season of 1925 at the request of the water user*
2* The said tolls shall be due and payable on "the 2nd day of
June, I925, provided, however, that any person paying before the
first day of January, 1926, thf fchole or any part of the amount
chargeable to him under this order shall be credited with |1#12
(one dollar and twelve cents) for each and every dollar paid by
him on or before -— June 1, 1925, and $1*08 (one dollar and eight
cents) for each and every dollar paid by him between June lt 1925,
and January lf 1926*
3» That the said Okanagan Centre Irrigation and Power Company
Limited, do set aside on or before the first day of May, 1926,
a sum of not less than $8,000 (eight thousand dollars) as a depreciation fund to mak.e  provision for the replacement of the various
works comprising the irrigation system operated by the said cssBpany*

The moneys so set aside shall be deposited in a special account
in a chartered bank or invested in securities approved by the
Board or such as are permitted under section 13 of the "Trustee
Act" and the said moneys and securities and all interest accruing thereon shall be used for the purpose of replacing, whether
before or after the said 1st day of May, 1926, the various works
comprising the said Irrigation system as the said works become
unsafe or unserviceable and for the purpose of providing extensions to the said irrigation system where such extensions are
requested in writing by owners of land who are liable under clause
1 of this order to pay tolls to the said company and are approved
In writing by the Board and for no other purpose* No part of the
said moneys or proceeds of the said securities shall be used for
the replacement of a structure or a part of a structure which by
reason of It being a part of a larger structure or its relation to
adjoining structures would be substantially depreciated in value
by the collapse or discarding of the larger or adjoining structures*
