SECTIOH 310
la the matter of the complaint of Y* B* McDonagh, B* C*
Maile, IS* 0* Shanks. W* H* Prowse, T* A* Gray, J* E* Aberdeen,
F* H* Keane, W* J* Arnold and (3* H* Venables to the effect
among ether things that the tolls chargeable under the water
agreements entered into with the Okanagan Centre Irrigation and
Power Company Limited and the tolls demanded by that company
exceed what is just and reasonable and that the quantities of
water to be delivered by virtue of the said water agreements are
unreasonably restricted*
BEFORE THE BOARD OF IF7ESTIGATI0]!:
Upon the above mentioned complaint and upon hearing Mr* T*
(J* Iforris of counsel for the complainants no one appearing on
behalf of the Okanagan Centre Irrigation and Power Company Limited although duly notified of the date, time and place fixed for
the hearing of the said complaint and upon hearing the evidence
adduced
THS BOARD DOTH ORDER:
1* That in lieu of the tolls payable to the said The Okanagan
Centre Irrigation and Power Company Limited under the water
agreements entered into by it and the tolls demanded by the said
company the following tolls shall be payable for the year 1926,
IRRI§ATIOSF TOLLS :-
fa) A toll of five dollars and fifty cents an acre payable
in respect of all land irrigated during the irrigation
season of 19E6 with water delivered by the company
upon the application of the person lawfully occupying
the land so irrigated (which person is hereafter referred to as "the water user") o      "w        o
(b) A toll at the rate of three dollars anfr aoro-foot
for all water delivered during the irrigation
. season of 1986 by the company upon the application
y0* of the water user in excess of the quanity repres-
enting one acre-foot for each acre of land for which
the water user applies or has applied for water to
be delivered*
DOMESIIC TOLLS:-
(c) A toll of two dollars a month payable in respect of
each dwelling house to which water is delivered
under pressure for domestic use*
fd) A toll of one dollar a month payable in respect of
each barn to which water is dslivered under pressure for stpok watering*
fe) A toll of one dollar a month payable in respect of
each parcel of land on which there is a house or
barn or both to which water for domestic use or stock
watering or both is delivered in open ditch or flume*
(f) A toll of five cents per month per hundred square
feet of area of every lawn and garden in respect of
which the water user applies for water under pressure for sprinkling purposes*
2*     That the tolls chargeable under subclause (a) of Olause 1
shall be due and payable without deduction on the thirtieth_day of
•Tone 1926 and on the first day of July 1926 the company shall be
entitled to add to every sum of money payable under said subclause
fa) which remains unpaid on the said first day of July an amount
equal to tea per centum of the sum so remaining unpaid*
3*     That the tolls chargeable under subclause (b) of Clause 1
shall be due and payable without deduction on the fifteenth day
of September 1926 and on the sixteenth day of September the company
ehall be entitled to add to every sum of money apyable under said
subclause fb) which remains unpaid on the sixteenth day of September an amount equal to ten per centum of the sum so remaining
unpaid* 4*     That the tolls chargeable under subclauses fo), (d),
fe) and ff) of Clause 1 shall be subject to a dlsoount of ton
per centum if paid quarterly on or before the twentieth day of
the first month of the quarter for whioh the water is to be delivered.
5*     That the company shall deliver water to every parcel of
land which has at any time been irrigated frea the water system
operated by the oompany and in respect of which an application
for water is or has been made by the lawful occupant of the
parcel and in respect of which the tolls chargeable for the year
1925 pursuant to the order made by the Minister of Lands have been
paid irrespective of whether or not a water agreement respecting
the delivery or supply of water to the parcel is or has been
entered into*
6*     That the company shall deliver to saoh parcel of land
which has at any time been irrigated from the water system operated by the company and in respect of which an application for
watef is or has been made such flow of water as will supply te the
parcel between the commencement of the irrigation season and the
BOth day of August 2L926 the quantity of water applied for by the
occupant of the parcel up to two acre-feet per acre* Provided
that if at any time before the said 20th day of August it appears
to the company that the quantity of water then available for distribution is insufficient to permit of water being delivered at
the aforesaid rate of flow until the said 20th day of August the
company may with thw written consent of the Board reduce the rate
of flow of water to all parcels in respect of whioh more than one
acre foot of water per acre is or has been applied for. Such
reduction shall be made proportionately to the quantity applied
for in excess of one acre-foot per acre*
7*      That the company shall expend prior to the first day of
May 1927 in the maintenance, repair and replacement of the various
works comprising the water system operated by the oompany:
fa) A sum of money equal to the total of the sums
collected by the company prior to the said first

(a)   day of Kay 1927 on account of domestic and
irrigation tolls for the year 1925 less the sum
of $  12,611*17 and
fb)   A sum of m&ney equal to the total of the sums
pafd to the company prior to the first day of
May 19S7 on account of the tolls chargeable
under this order less the sum of $  4,808*29
8*  The company shall keep and produce for inspection at any
time by ths Board complete records, statements, time books,
invoices, receipts, bank books and other documents shewing in
detail all replacements of works made during the said period
together with the cost thereof*
