Forfeitures of Nomination Deposits.

RETURN
To an Order of the House showing all sums of money received and applied to the
public uses of the Province under the " Election Regulation Amendment Act,
1890;" the date upon which the money was received ; the name of the person on
whose account it was paid to the Returning Officer ; the manner in which it has
been applied ; and all correspondence respecting the same or relating to deposits
made with Returning Officers under the above Act.

Burgoyne Bay, June 21st, 1890.
Hon. J. H. Titrner.
Dear Sir,—I applied to Mr. Broadwell for the return of the two hundred dollars I
deposited as a candidate, and he tells me he has paid it into the Treasury. He should not
have done so, as I got half the number of the highest candidate, as near as it was possible to
get it. The winning number was 57, and I got 28. There is no half vote. If I had one
more I should have more than half. I don't think the Government passed this law to get a
snap judgment on a man, more especially a Government supporter. Therefore I must ask you
to return me the money.

Sir,—I have the honour to acknowledge the receipt of your letter of the 21st ult.,
requesting the return of |200 deposited in the hands of the Returning Officer for the Islands
District. The purport of your letter was referred to the Hon. the Attorney-General's
department, and after due consideration, it was deemed beyond the power of the Executive to
comply with your request, as the provisions of the " Election Regulation Act " (as amended in
1890) clearly define the conditions under which the deposit may be returned.
