The minutes were read and - approved.  Clerk read   a   communication   from  ,  the city  solicitor   recommending   that.  , thecity repair tlie, plow owned  by ' J\.  Samson  and injuied   ou   city   work.  Referred' to public works committee.  Communication ,   from      the'"city  *  solicitor   infoi'ming   the   council- lhat  the C. P. R.   had   Piled   notice,of   its  intention to appeal to a judge-of .the'  supreme court'ag.iinst the   decision   of  the/ court  of   revision.    The  solicitor  stated thar. there was some,  ambiguity  ���������in the railway act unci  in' (he assessment .act,    and    that ' it'   would   <>be,  ' idifiicult   to   ,-say    what    construction  would be "placed   upon   them   by   the  court.    The  company   appealed   on  a  variety'of grounds:    That it   w.is  not  within: the power of the city to assess  real estate held   in   the  city   by   the  company, no matter for what   purpose  or for what uses it was held; the valuation placed on the property   was ���������,too  high; part  of   the   property   'assessed  was a part of   the ' i ighl-of-way.    The  only point to be. decided by  the  court  on the uppeid would be ii������ to   whether  the prope.rt \ywas assessed at..a  higher-  figure t'ban otlier property of tlie same,  character ��������� and   enjoying    the i, same  natural advantages.    The solicitor did  ,not believe it was the intention of the  legislature to   allow   any   company   to  hold land for j)iiiely  speculative   purposes in any city of 'lhe- province   and-  escape   taxation.     Ho  'would   suggest  communicating with Greenwood, which'  ,., was in the same position in   regaid   to    system partly inst-ill  ' the matter, and arrange for -sending   a i developed lhe   f.i  joint delegation to Victoriirto'-iinpress   wojdd be useless1  on  the   legislatu  ���������e the necessity of  prompt action in having an amending  act passed definitely settlin/ the  question. It .was not a purely local  question. Other towns would be incorporated sooner or Inter and- they  would find themselves in the, same  bout. The company .woulc' probably  make the, appeal and keep the question  hanging fire until after the House adjourns, and then lel'use- to' pay 'taxes  on (he assessment, when it was too  late for tlie cil v lo  secure   relief,   and  the city would lose this and' probably'  another year's taxes. The matter was  left to the solicitor to communicate  with the member at Victoria and with  the ofliciiils of Greenwood,. looking  towards joint action.  The chief of the (ire department reported that there had been but one  call to a fire from Aug. 1 lo .Dec. 31,  1900.- Property and appliances weie'  in good condition.'  Chief Bain inquired if the Chinese  were to be allowed to celebrate their  ne,w year with fire, works and 'music  from ' their band.' Permission wa.i  granted under-regulations to, he prescribed by the chief.  Fiom Medical Health Ollioer Cross,  recommending, that ,in view of the,  smallpox epidemic raging iu Spokane  and , northern Washington, everyone  be, icquired lo be vaccinated within  live days or.furnish certificate of immunity from a medical practitioner.  This created 'much discussion, and it  was decided'lo procure for the: use. of  the council, which is the local board of  health, a copy of the'provincial buard  of health regulations.
