TO OWNER ON BUILDING PLANS "!'■■ The question' of the, liability, of.the architect <to-the owner is-, one which has been threshed out in -the courts from time to time, but is-nevertheless one of recurring litigation, because no general rule has ever been laid ■ down ty British or American courts that wil^ cover every specific case. About the only thing that has been universally and finally established is that the _ architect- is human and his work can therefore only approximate 'perfection.' however skilful or learned he may be; -Jience the , owner cannot,-expect absolute perfection in either plans or -specifications. Reviewing opinions of -aiany courts regarding the liability of the architect to the owner, a .legal authority, writing for the American contractor, says: , . It is a.general rule of law that the architect must employ,.reasonable skill and taste in his work. The term ""reasonable" of course, is.rather vague Trot it is presumed to mean reasonable among his profession. It must be .-kept in mind however, that the duty of the- architect, with, reference to any particular, engagement, is limited by the contract which he has entered into with, the owner. The. law cannot im-, pose,^a liability even -as to skill-and 2783—Mr.- Billings, 6531 Maele St. Jcnowledge, which is not contemplated{garage, $130, Knight & Major, Contrs. l>y the contract. And where certain specifications are set out-in the contract, tending to point out the measure of the4architect's duty, it will be construed by the courts to mean a reasonable skill in the particulars mentioned and nothing greater. It is a further general rule of law that an architect is not duty bound to keep secret the plans for a given building, unless he has specifically contracted to do. so. But where an architect engaged to prepare plans for « given building and he, as "is generally customary, gives out the* fact to "the newspapers or any trade publication—which is generally the first to announce such matters—the architect has violated no duty at law which will Tender him "liable in an action for damages, even though the disclosure of the secret may be decidedly injuri- WALLBOARD FACTORY SHARES SELLING WELL , :The. You know the concern has built up a good business in the manufacture, of : Roofing and Building Paper. You know that our well known brands are handled by the leading jobbers of British Columbia and the Northwest as well as New Zealand and Australia dealers'. A Upon the foundation of our established business and connections we desire to develop our plant so as to enable us to manufacture our own raw materials, all the basic products for which are obtainable in B. All the necessary material is obtainable in this province, and the growing demand for this product gives assurance of the success of the undertaking. Yours respectfully, PACIFIC^OFINGCO.,LTD, 7 In order to provide for carrying out. its plans for the development of its business of manufacturing building materials, the PACIRC ROOFING CO., LIMITED / Invites Subscriptions for an issue of, . $125,000 in 3% Cumulative Preference Shares Par Value, $10 per Share Offered at Par with One Share of Common Stock heretofore issued with each Four Shares of Preferred Stock purchased. These Preferred Shares are.a first liability against the Company's property and business, both for payment of dividends and principal. They represent holdings in a business already well established as a successful going concern and which has a market for its products as rapidly as they can be manufactured. I An investment in this concern is one which should appeal strongly to any person connected with the Building fraternity. /. To establish a plant pVERY reader knows the rapid- for the. manufacture , . lf srowmg^useof Wall Board , w*j .*i n j for interior work—now the demand Of Wall ISoara jror lnis pro(fuct ,s increasing to such an extent as to assure steady demand for every plant now turning it out. In the natural resources of B. C. we have everything needed fof. the manufacture of Wall Board. Even more — the quality of the t materials obtainable here assure the turning out 'of a Wall Board far superior to any now on the market. Wall Board is now obtainable only from Eastern Canadian and States plants.. Manufacturing it on this Coast We can turn out a product which, at a good profit to us, can still be offered the public at a pried considerably less than is now demanded for Wall Board on this Coast, in the Northwest or in New Zealand and Australia. We have secured the, services of a Wall:Board expert as Superin-, Undent of this part of our workr-ra man who gave perfect satisfaction as Factory Superintendent of the Beaver Board factory at Buffalo, N'.Y. The success of our Wall Board plant is proven by the fact that four British Columbia jobbers will contract for 6,000,000 feet annually. This leaves only 2,000,000 feet of our estimated output for the great market in the Northwest, New Zealand and Australia. 2. plant has been already purchased, and
it is .expected the contract will be
awarded next week for the" erection of
the first unit. Every effort will be
made to have the, plant ready, for
operation next August to, handle the
season's fruit crop. As it will he impossible; to secure machinery in time
this season, it is planned to evaporate
only apples, but with the arrival of
machinery for next year's crop it is
•loped to be able to handle prunes,
plums, apricots, ■ peaches and other
stone fruits in a most economical manner, while as by-products, the concern
will manufacture apple, butter, apple
sauce and cider. '■';■■.
