street, of which complainant was in charge.
Complainant gave his evidence with a rolo*
biliiy which somewhat amused the Court. He
slated that he had searched thc drawers most
carefully where the gold was kept, and
*' could not find a cent, either gold, silver or
brass;" prisoner then came in, and hearing
ofthe loss took out the drawers and produced
from thera a gold dollar, a hall-dollar (bogus)
and a $20 piece, although complainant said
he had turned everything out of the drav,er
before and found nothing.

The prisoner emphatically pleaded not
guilty, and'the case wa. remanded lur a week
to allow Mr. Bottrell to be present.

Assault.—Two decent-looking men-of-
war's men were charged this morning by Nel-
eon Baker, a cripple, with assaulting him on
Johnson street yesterday, by striking him
with a stick and with their lists, nnd also
with breaking a pane of glass iu the huu c of
which he had charge. Complainant snid the
men were drunk ai the time, and ho was
quite willing to forgive tho assault, but
would like to have the window paid for.
The ."Jacks" "acknowledged thc corn" and
the master-at-arms of their ship giving both
the men very good characters, and agreeing
to pay for the broken window, the men were
discharged.

and Capt. H. B. Good, in which several blows
