Determining Guilt in Eighteenth-Century England : Revisiting the Old Bailey Record Westwood, AJ

Abstract

This thesis delves into the concept of guilt in eighteenth-century England and how it was determined by the courts. Through the analysis of murder trials from the Old Bailey Court Records, this thesis works to address questions regarding what the public perceptions of male violence were, as well as, how much eighteenth-century politeness and codes of civility and honour influenced court proceedings, the deliberation of the judges and juries, as well as the defences made by accused men in court. This thesis also looks into gendered violence and whether or not there are similarities or variable differences in the kinds of verdicts received by men involved in domestic murder compared to those received by men who murder those of the same gender.
